The following guests were present: Paul Samson, Central Missouri Professional Service; Kyle Kittrell, River City Habitat; and Madeleine Leroux, News Tribune. 1) Introductions Those present introduced themselves. 2) Approval of the November 21, 2013 Committee meeting minutes Councilman Bray moved and Councilman Branch seconded to approve the November 21, 2013 minutes, motion carried. Councilwoman Tergin was absent for this vote. *Councilwoman Tergin arrived at this time (7:37 a.m.). 3) Consent Items 1. Vacation of a Sanitary Sewer Easement at 5500 Bagnall Drive (River City Habitat for Humanity, Requestor) (David Bange) 2. Vacation of Right-of-Way for Sam's Club (Shane Wade) 3. Approval of the 2014 Committee Meeting Calendar 4. Ground Lease for Central Bank at the Jefferson City Memorial Airport (Britt Smith) Minutes/Jefferson City Public Works and Planning Committee 2 January 23, 2014 Councilman Branch moved and Councilman Bray seconded to approve the consent items, motion carried. 4) New Business 1. Water Company (David Bange) Mr. Bange explained staff is requesting that the Committee endorse the recommendation to lodge a formal complaint with the Public Service Commission against Missouri American Water Company for their inaction regarding numerous safety concerns. Councilwoman Tergin moved and Councilman Bray seconded to have staff file a complaint with the Public Service Commission in regard to the water company, motion carried. 2. Clay Street Update and Funding (David Bange) Mr. Bange explained the Clay Street Bike Plaza design is nearing completion and staff intends to use CDBG funds to supplement the STP and local funds that have been designated for its construction. Councilwoman Tergin moved and Councilman Bray seconded to approve the use of CDBG funds for this project, motion carried. 3. Bus Purchase Appropriation (Matt Morasch) Mr. Morasch requested the Committee endorse the purchase of a para-transit bus with the receipts of recently auctioned para-transit buses and sales tax funds designated for Transit. Councilwoman Tergin moved and Councilman Bray seconded to refer the appropriation to the City Council with recommendation to approve, motion carried. 4. Salt Funds (Britt Smith/Matt Morasch) Mr. Smith explained staff will request a supplemental appropriation to restore the street material budget. Councilman Branch moved and Councilwoman Tergin seconded to refer a supplemental appropriation to the City Council with recommendation to approve, motion carried. 5. Lease Deferral at the Jefferson City Memorial Airport (Britt Smith) Mr. Smith explained the main runway will be closed for approximately four months and will inconvenience the airport tenants with some having to relocate their aircraft during the construction. Staff proposes a 50 percent reduction in ground lease fees charged to all airport hangar tenants during the closure. Councilwoman Tergin moved and Councilman Bray seconded to refer a resolution to City Council to adopt a 50 percent lease deferral, with recommendation to approve, motion carried. 6. Weight Limit on the Dunklin Street Bridge (Britt Smith) Mr. Smith explained due to a recent MoDOT structural evaluation of the bridge, staff will post the new weight limit of 30 tons. As this limit may have an effect on some businesses, staff is in the process of making contact to ensure they are aware of the situation and can change their patterns as appropriate. Building Code Construction Commission (Janice McMillan) Chairman Scrivner requested this item be tabled to the February Committee meeting. 8. Economic Development Assistance Grant (Jayme Abbott) Ms. Abbott explained staff is proposing to submit application to assist with the US Hwy 54 and Stadium Boulevard Access, Capacity, and Safety Improvements project. The proposed project is being undertaken to address safety issues caused by traffic backing up onto the highway from the westbound exit ramp and relieve congestion on Stadium Boulevard. Councilman Branch moved and Councilwoman Tergin seconded to authorize staff to submit the grant for approval, motion carried. 9. Cooperative Bidding of Sewer Projects with Cole County Projects (Eric Seaman) Mr. Seaman explained doing the cooperative bid would have significant restoration cost savings for the City. Councilman Bray moved and Councilman Branch second to forward the resolution to the City Council with recommendation to approve, motion carried. 5) Other Topics 1. Chapter 8 (Buildings and Building Regulations) Section 19 (Amendments is amended as follows: Section 113.1: MEANS OF APPEAL: Any owner, agent or other person shall have the right to appeal a decision of the code official refusing to grant a modification to the provisions of this code covering the manner of construction or materials to be used in the erection, alteration or repair of a building or structure. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or an equivalent form of construction can be used. The appeal shall be to the Building and Fire Code Appeal Commission as provided in chapter 7 of the City Code eireuit eeurt efGele GeHRt)' as established iR Artiele 536 efthe Revised Statutes efMisseuri. Section _b Chapter 13 (Fire Prevention and Protection) Section 108 APPEAL is amended as follows. 4. Delete Section 108 in its entirety and insert the following in its place 1 08.1. Any owner, agent or other person shall have the right to appeal a decision of the code official refusing to grant a modification to the provisions of this code covering a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply or an equally good or better method of fire prevention is used. Section ~. Chapter 7 (Boards and Commission) is hereby amended by the addition of a new article XXII (Building Code Construction Commission) as follows: Sec. 7-740. Established There is hereby created the Building and Fire Code Appeal Commission. Sec. 7-741 Members; Terms; Appointment; Officers A. Membership. The Commission shall consist of five (5) members and three (3) alternates. B. Appointment. The first appointments to the Commission shall be as follows: two regular members and one alternate shall be appointed to serve for three (3) years. the second two regular members and one alternate shall serve for two (2) years and the final one member and one alternate shall serve for one year. Thereafter. each new member shall be appointed for three (3) years or until a successor has been appointed. Appointments to fill vacancies shall be for unexpired terms only. C. Qualifications. The Commission shall be composed of persons with the following qualifications: 1. Professional engineer (experience in electricaVmechanicall; or 2. Professional engineer (experience in structural/civil); or 3. General Contractor for building or home construction; or 4. Fire protection engineer or person with five years' experience e~eerieaeed in fire prevention; or 5. Registered architect; or 6. Only with the approval of 2/3 of the Council may a layperson without the above referenced qualifications be appointed to the Commission. Not more than two members shall be from the same profession or occupation, and at least one person shall be a fire protection engineer or person with fire protection experience. Persons residing within the City shall be given preference; however, if no qualified City resident is available, non-residents may be appointed to the Com mission. D. Commission chair, vice chair, and secretary. The board shall select from its members a chairperson and vice chair. The vice chair shall chair the meetings in the absence or disqualification of the chairperson. The Director of Planning and Protective Services or his/her designee shall serve in ex- officio capacity as secretary to the board, who shall keep a detailed record of all proceedings on file in the Planning and Protective Services. E. Quorum. A quorum of members shall be three. Sec. 7-742. Alternates. During the absence of a regular commissioner, an alternate shall be appointed by the Chair to sit on the commission for the hearing before the commission. In such circumstances the alternate shall have the full power and authority of the regular commissioner. Sec. 7-743. Application for appeals. A. Definitions for this section. As used in this section, code official shall mean any person charged or authorized to enforce or interpret the Building Code or Fire Prevention code. but shall not include the Board of Adjustment. B. Who may appeal. The owner of a building or structure or any person directly affected by a decision of a code official may appeal to the Commission any decision of the code official refusing to grant a modification, variance or waiver to the provisions of the Building code or Fire Prevention code covering the manner of construction or materials to be used in the construction, erection, alteration, or repair of a building or structure. C. Grounds for Appeal. Application for appeal may be made when it is claimed that the true intent of the code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of the code do not fully apply, an equally good or better form of construction can be used, or undue hardship is created by strict compliance with the letter of the code but has no significant effect on the health, safety and welfare of the public or any individual. D. A fee as provided in schedule Y of the City Code shall be submitted with the application. Sec. 7-744. Appeal Hearings. A. Date of Appeal Hearing. 1. Appeals shall be heard within 30 days of the filing of an appeal. 2. In order to hear an appeal the chairman shall call a meeting of the Board to hear the appeal at any time in which a quorum may be gathered. 3. The Director of Planning and Protective Services shall notify the applicant of the date of the meeting at least five (5) days before the date of the hearing. The applicant may waive the five (5) day notice requirement in writing. B. Continuances. If less than four (4) members are present to consider a specific appeal, the appellant shall be entitled to a continuance of the meeting. Either side may be granted a continuance if a necessary and proper person cannot be available for the hearing. The Chair shall rule on any such motion. C. Exemption of members. A member of the commission shall not vote on any question in which that member is engaged as contractor, material dealer, or in the preparation of plans or specifications, or in which the board member has anv personal interest. D. The Hearing procedure for all hearings brought under this section shall be as follows: 1. Procedures: a. The Hearing shall be open to the public and on the record and all meetings of this body shall comply with Missouri's sunshine law. b. The Chairperson shall conduct the hearing and shall rule upon all motions by the parties. c. Any party to the Hearing may be represented by counsel and have the right to present evidence. d. The technical rules of evidence shall not apply in the hearing. Any relevant evidence may be admitted and considered by the Chairperson if it is the sort of evidence of which responsible persons are accustomed to rely in the conduct of serious affairs. Objections to evidence shall be noted and a ruling given by the Chairperson. e. All testimony shall be under oath, which may be administered by the Chairperson. f. A recording shall be made by the City or a written record of the hearing may be made by a reporter to be employed by the City, the cost of which shall be paid by the City should the proceeding be eventually held against the City and by the applicant if it should not. g. All decisions by the Board must be made upon substantial and competent evidence presented at the hearing 2. Conduct of the Hearing. a. The Chairperson shall proceed in the following manner. The City will be allowed to present its evidence first. Witnesses called by the City will be directly examined with an opportunity for the opposing party to cross-examine, followed by an opportunity for the City to re-direct. The Chair may then allow questions to be asked by Commission members. Once the City's case is presented, the appellant will have an opportunity to present his or her case. The same procedure for questioning witnesses will be followed. Then the City will have an opportunity for rebuttal, if it so chooses. b. At the conclusion of the evidence the Commission shall, by motion, affirm. modify or reverse the decision of the code official by a concurring vote of three (3) of its members. c. The appellant may request that the Board issues findings of facts and conclusions of law explaining the decision based upon the evidence presented. Upon such request the Chairman with the assistance of the City Counselor shall issue such findings fact within 30 days of the date of the hearing. d. Notice of the decision shall be provided to all parties pursuant to Chapter 536 RSMo. e. Any person aggrieved by this decision. including the city. shall. within 30 days after notice of the ruling as required by Chapter 536 RSMo., file his or her administrative appeal pursuant to the rules established in Chapter 536 RSMo., for review of a contested case in the circuit court of Cole County. If no action is taken to appeal the decision of the Commission as required by Chapter 536 RSMo .• the decision shall be final. Section 4. Schedule Y is amended as follows: Sec. 7-740. Appeal to Building and Fire Code Appeal Commission $120.00 Section 5. This Ordinance shall be in full force and effect from and after the date of its passage and approval. With Committee approval the Engineering and Wastewater Divisions will be able to focus their efforts on specific projects and thereby complete the projects in a timely and productive manner. The attached sheets contain the cash flows for streets, sidewalks , storm water, airport, transit , and wastewater (bonded and cash) projects. The sheets reflect the budgeted funds for the various programs along with specific projects that Public Works plans to work on this coming year. The % cent sales tax sheet made some adjustment in funding years due to the need to fund the major airport runway project (summer 2014) and the projects related to commitments to the Capital Region Hospital expansion. The adjustments were mainly made by delaying some storm water funds to 2016/17. I would also like to make the Committee aware that the City/County projects indicate $5 mi llion dollars of funding and not the originally agreed to $5.5 million. If funding remains at that level the City may be missing out on $1 million of joint City/County projects being completed within the City. The Wastewater work plan indicates $10 million in bonded projects and approximately $530 ,000 in cash funded projects. Those projects relate to fulfilling pending EPA commitments as well as projects related to the new Lafayette Interchange which is anticipated to begin later this fall. This topic will be reviewed at the February 2014 Public Works and Planning Committee meeting. If you have any questions concerning the work plans prior to the meeting please let me know. Thanks . Smith, P .E . ~ Winter Storm Chemical Usage Update Attached is a table showing our usage for snow/ice remova l c hemicals from FY2009 to present. As you will note , we ha ve experience 11 storms this year requiring snow fighting activities and several of those also included ice events. Due to the action of the cit y council in January to permit the purchase of additional mat erials , we have not experience any salt supply shortage issues. As of this writing , we have approximate 1,700 tons of salt (50% of our storage capaci t y). This amount is sufficient to provide for 4 average storm eve nts. cc Matt Morasch , P. E. As you may recall during the process of discussing the replacement of one of the para-transit buses the Committee had some questions concerning the information contained in this schedule. The schedule demonstrates the number, type, age , purchase price and the first year in which the when the vehicle may be replaced in accordance with FTA (Federal Transit Authority) guidelines. The first section of the sheet demonstrates the information for the route buses (regular and tripper). As noted in the table , the City has 12 buses so that we may have 9 buses available for use on any given day. The buses range in model year from 2005 to 2012. The buses were purchased with federal funds with the City contributing a 20% match. FTA requires the City to keep these style buses for at least 12 years. However, we anticipate an average useful life of about 17 years before replacement. This is in part due to the fact that the buses are of high quality as well as our robust maintenance program. The spare ratio allows for mechanical and routine maintenance as well as breakdowns without any interruption to the reliability of service. Because these types of motor coaches are constructed by the manufacturer as they receive the orders it can often take up to two years from the time the order is placed until we actually receive the bus for use. The second section illustrates the information for the para transit mini buses. The City has 10 mini buses with 8 scheduled for use daily. They range in model year from 2006 to 2013. These mini buses were purchase with federal grants with the City providing a 20% match. The FTA requires the City to keep these buses for at least 5 years before replacement. As illustrated by the sheet the City is past that schedule with our four oldest buses being 8 years old. The City maintains the buses well , however they are not as high quality as the large buses. The spare ratio for these buses allows the City to rotate them through the maintenance program, while maintaining reliable service. The recent effort to purchase a new para transit mini bus will replace one of the 2006 models. There have been some issues with those models as two of the four 2006 models have had motors replaced in them. Just this last week two other mini buses were sent out for major repair issues, leaving no spares available. These style buses can typically take 9 months to a year to receive after they are ordered. Demonstrated by the attached schedule, the City maintains a considerable fleet to provide a quality transit service. The capital costs have generally been supported by grant funds with the City's matching shares coming from the % cent capital improvement sales tax. The operational cost center for transit is supported by user fees, various grants and the City's general fund. While we move forward with improving the City's transit system it is good to keep in mind all parts of the equation, the operational costs, the capital costs and the level of services provided, because each relates to the other. One example of how this equation works is demonstrated by the tripper route service aimed at school traffic. To operate the tripper route system, it requires three or four additional large fleet buses (capital costs). On the operational cost side it requires driver hours and of course fuel and maintenance for the additional fleet buses. By providing this useful service the City has increased its fleet of large buses by 25-33%.
