Members present: Mayor, Thomas Anderson; Councilmembers, Nancy Laurent, Sarah Lutz, William Reiser, Thomas Crosby; Clerk Donna Roeh1; Planning and Zoning Administrator, Robert Derus; Public Works Director, Ron Duran; police Chief, Charles Hoover; Attorney, Richard Schieffer, Engineer, Lyle Swanson 1. Minutes of January 16, 1979: Thomas Crosby asked that the following changes and or additions be made to Item 5 Page 150: Line 1: "sketch" rather than "site plan". Additions to line before motion: "Thomas Crosby cited possible uses of other equipment in- cluding semitrailers and mobile homes. He also read portions of Nor. Schieffer's memo of December 15, 1978 and indicated his concern that the council would set a bad precedent by permitting the caboose to remain." Motion by Reiser, seconded by Laurent to accept minutes of January 16, 1979, as corrected. Motion declared carried 2. HAMEL SENIOR CITIZENS Rose Faue, President of the Hamel Senior Citizens club and Bernadette Ziehwein, Vice Pres., appeared to discuss the possibility of Medina supplying $500 to their club to enable them to retain the services of a coordinator from Community Services who no longer can help them because of a lack of funds. Discussion of asking Corcoran for one-third of the cost as one- third of t hemembership is from Corcoran. Motion by Laurent, seconded by Lutz to enter into a contract with Suburban Community Services for $375 and notify Corcoran that they will be asked for $125. Motion declared carried Thomas Crosby asked that the following reason. be listed for entering into a contract: The continuation of an existing program left without a coordinator. 3. FINANCE COMMITTEE Thomas Crosby explained to committee members Dean Preston and Bob Linkenheil the rpoblems involved with budgeting for police and roads, particularly salaries; also the possibility of having a city manager or full time clerk. Dean Preston asked when council would need such information. Council felt as soon as possible, especially information regarding clerk and or clerk/treasurer. 4. PUBLIC HEARING, HWY. 55 and CO. RD. 116 UPGRADING, 8:10 P.M. Allen Pent of Minnesota Department of Transportation presented background information on plans to signalize and upgrade Co. Rd. 116 and Hwy. 55. Be stated that upgrading had been requested by the city,property owners and businesses of the area. Accident figures for the intersection have been 9 in 1976; 12 in 1977 and figures for 1978 are not available as of yet. Project is due for letting in 1980 and construction in 1981. Project would be 75% Federally funded, 25% divided among County, State and Medina. Cost of the signal will be $80,000 with 25% to be paid by Medina. Both Medina and Federal approval is needed to proceed with the project. Project will provide well defined lanes, a 6" raised concrete median, signals and lighting and railroad warning lights. Hwy. 55 will be widened west of Hwy 101 thru Co. Rd. 116 intersection; 2 thru lanes will be provided in eaeh direction to 1000 ft. west of Rd. 116. There will be bituminous shoulders and turn. lanes. Slivers of additional right-of-way will be required along Hwy. 55, in some areas. Approximately 1 acre of wetland will need to be filled and a portion of Elm Creek may need to be relocated. Don Mayer--762 Hwy. 55--Barrier more than a minor convenience, will affect 9 businessess who need east -bound traffic. Fred White--902 Hwy. 55--Have people coming into our business with trailers that could not make a turn due to the divider. �:dd Peggy Rasmussen.-842 Hwy.55--60% of morning business would not be able to turn in or be able to turn to head back east. Charles Yates--822 Hwy. 55--36% of business is conducted before 8:00 A.M. by traffic heading east. My station would be unavailable. Also a sale of the station that was being negotiated has been called off by potential buyer. Bruce Luxford--752 Hwy. 55 My business would be hadicapped by median for anyone eastbound. Joe Raskob--500 Hwy. 55--Could not a depressed grass median be constructed, such as near 101? Gerry Dykhoff--562 Hwy. 55--Ideal solution would be a service road on north side of highway. Al Pent-- Frontage roads are initiated by municipalities, city would need to secure right of way; also a service road must be 300 ft. from highway. Schaefbauer--872 Hwy. 55--I work one block from home and would have to drive 5 miles to Loretto to turn around. Don Mayer -- Could Hwy. 101 be signalized and traffic slowed down? Robert Felt1--922 Hwy. 55--What is purpose of signal, to increase volume of traffic thra intersection or for safety? Both If volume of traffic from Medina Ballroom is greater than any other business then median should be continued to the east. Hamel Rd. --I represent Wallace Doerr, owner of property on westerly edge of this project. Are you going to provide access to his property? One-way traffic will be provided. Could entire roadway be moved to the south to provide additional lanes? Railroad property is not negotiable. 55--If not funded by Federal government would State fund a smaller project and perhaps lower the speed limit? No state funds are available, reducing speed limit dolls not stop accidents. 55--I have been stopped for lane crossing at Hwy. 101 to make a left turn to head east because there is not 1000 ft. from my property to the intersection. The same situation could be created here. Who would pay for a service road? I do not know what the policy of the city is with regards to service roads. Would you close all entrances if putting in a service road. What is projected traffic count for 1981? There is a 4-5 % increase per year. Of the 66 high hazard project, where does this project rank? In the top 20 If project were constructed without barrier what percent of objective would be obtained? Would not do the project without the barrier. What observations does Medina's city engineer have? When using Federal funds their regulations must be f &lowed. Could the barrier be broken in some areas? Would need to study that possibility How many miles worth is a traffic light worth? Not very far. Valid problem is getting back into an eastbound lane, this should be studied. Would like to see something done to cut down on accidents but not at the expense of cutting off business. Motion by Lutz, seconded by Reiser to close the public Hearing. Motion declared carried public Hearing closed at 9:35 P.M. Thomas Crosby --When is a decision by Medina needed and is any other information necessary? Al Pent --May not do anything more until Medina approves, would then ask Federal approval of the design. If not approved by Medina, as presented, then alternative suggestions should be forwarded. If not approved the project would be shelved. An answer by the first week of March would be sufficent. Rd. 116 and Hwy. 55 until March 6, 1979. Motion declared carried. 5. BUILDABLE LOT SI7P, Anne Theis, representing the Planning Commission appeared to present recommendation of the Planning Commission regarding regulations for a buildable lot size; that is a 2 acre lot must have 1 acre of suitable soils for a septic system. She explained that the planning Commission is having problems in interpreting the ordinances and they need a decisions for the Northridge plat that is before them. Nancy Laurent felt that the Council had made a decision some years ago and that there must be 2 acres of suitable soils. Robert Derus explained that the Planning Commission had spent much time on their recommendat- ion and Council should consider carefully. Councilmembers Reiser, Crosby and Anderson felt that 2 acres would be needed for a convent- ional on -site system but that the Septic Ordinances needs to be worked on and completed. 6. OPEN BURNING ORDINANCE Richard Schieffer explained memo comparing Medina's ordinance to the state regulations. Motion by Crosby, seconded by Lutz to authorize the attorney to rework Medina's ordinance with authority to issue permits given to the Chief of Police. Motion carried unanimously Reasons for designating the Chief of Police as the permit authority are the mobility of the Chief and the fact that Medina has 4 fire districts, each with a fire chief, and continuity of enforcement is needed. 7. POLICE DEPARTMENT Scales Motion by Reiser, seconded by Crosby to purchase weighing scales for $3100, amount to be taken from the Revenue Sharing account and to notify neighboring communities that scales will be available for a fee. Motion declared carried 8. PUBLIC WORKS DEPARTMENT Paul Winter Richard Schleifer explained that the unemployment division would rehear Paul Winter's unemploy- ment claim and that the city would be subject to some liability if board were to rule on Mr. Winter's behalf. He stated that William Clelland of his firm would be attending the hearing. Morris Holmberg Ron Duran reported that Morris Holmberg, the property owner west of Deer Hill, has requested the dedicated easement of Addison Lewis, which serves his property, be snowplowed and upgraded in the spring. He will be having someone farm his land in the spring. Richard Schieffer explained that the Council has the discretion of upgrading roads if they deem a public necessity. Nancy Laurent stated that Mr. Holmberg should come forth with a better reason before any work can be done. Motion by Reiser, seconded by Laurent to deny request for opening road and to inform Mr. Holm- berg that not opening the road will not affect his legal rights and that the city cannot just- ify spending city money at this time. Motion declared carried 9. ROBrRT GARNER Discussion and reports on Mr. Garners request for licenses to operate the Big Woods Saloon Motion by Laurent, seconded by Reiser to grant an On -Sale Intoxicating Liquor license to Robert Garner, president of Garner's Inc./dba Big Woods Saloon, for the remainder of the 1978 licensing period at a charge of $958.35. Motion declared carried Motion by Laurent, seconded by Reiser to grant an Off -Sale Intoxicating Ligu.or license to Robert, Garner, President of Garners Inc. /dba Big Woods Saloon, for the remainder oft �C{ the 1978 licensing period at a charge of 041.65. Motion declared carried Motion by Laurent, seconded by Reiser to grant a Sunday Liquor license to Robert Garner, President of Garners Inc.,edba Big Woods Saloon, for the remainder of the 1978 licensing period at a charge of $83.35. Motion declared carried 10. WEED INSPECTOR Thomas Anderson reported that he would take the appoinftent of the Weed Inspector under advisement. 11. CIGARETT LICENSE Motion by Reiser, seconded by Lutz to grant a 1979 Cigarettelicense to Countryside Cafe. Motion declared carried 12. METRO PLANNING FUNDS Robert Derus asked for additional time to complete the report that must accompany the resol- ution requesting funds. 13. ORONO COMMUNITY MUCATION ruNDS Motion by Crosby, seconded by Reiser to enter into agreement with Orono for 1979 for a fee of $269.30. Motion declared carried Community Education 14. VEHICLE INSURANCE Discussion as to whether or not to continue Collision coverage on certain city vehicles particularly trucks. Matter was tabled until February 20th to allow for figures as to premiums on all vehicles. 15. BILLS Motion by Reiser, seconded by Crosby to pay the bills including overtime wages to street department personnel. Order checks # 7876-7937 in the amount of $99,732.44 and Payroll Checks #5239-5263 in the amount of $9304.66. y9, & 3`j,70 Motion declared carried 16. BUDGET Holidays Discussion of paid holidays for Medina employees in comparison to other communities. Motion by Crosby, seconded by Lutz to specify the following as legal holidays; New Years Day; Presidents Birthday, Memorial Day, Fourth of July, Labor Day, Columbus Day, Veteran;s Day, Thanksgiving, Christmas, and one personal holiday. Motion declared carried Overtime pay Discussion of complying with State regulations regarding overtime pay after 48 hours per week. Motion by Crosby, seconded by Reiser to approve overtime pay if prior approval is secured from head of a department or the Mayor, except in cases of emergency. Motion declared carried Consensus of Council was that a week began at 12:01 A.M. of a Sunday. Clerk's Salary Discussion of clerk working on a full time basis for two months with the help of an assistant when needed. Salary figured on a 6 hour day. Motion by Laurent, seconded by Lutz to pay city clerk $15.00 for attendance at Council and $10.00 for attendance at Planning Commission meetings. 17. BUILDING INSPECTING Discussion of Medina employing their own building inspecor in conjunction with another city Thomas Anderson reported that he had received a call from Loren Kohnen, inspector for 160 Independence and Loretto. He would be interested in discussing a posistion with Medina. Donna Roehl reported that Allen Olson of °rono had discussed, with her, the fact that they will still do inspecting for Medina but would not be offended if Medina seeks its own inspector. Mayor Anderson stated that he had discussed with Mr. Kohnen various methods of determining salary. Council asked that Mr. Kohnen furnish a resume' and his alternatives for pay. Robert Derus stated that he would contact Mr. Kohnen. Motion by Crosby, seconded by Reiser to adjourn. Motion declared carried Meeting adjourned at 12;10 A.M. / o--e 4UZ.L, , Clerk February 6, 1979
