January 8, 1952 The regular meeting of Town Council was held today at 4 p.- M. and was attended by Mayor Dutton, who presided, Councilmen Hosti, Strong, Lovell, Meddin, Town Attorney Solms, Supt. Reed, Chief MoCutchen, Jr. J. W. Lang and Mr-. William F. Whalen. Mr. Whalen reported to Council that he had fenced off the Right -of -Way of the Old Central. of Georgia that abutts his prop- erty over two years ago for protection in an endeavour to stop the public from using his property and that he did not intend to violate a Town Ordinance. Mr. Whalen was excused. Supt. Reed reported that a total of 7,0001 of water main has been laid to date and also 7 fire plugs. The Mayor asked the status of sewerage operations, Mr. Reed stated he had found infiltration on Chatham Avenue near the Varnedoe cottage, also five big leaks on Jones and that these had been corrected. The Mayor stated that he wanted these conditions corrected as quick- ly as possible where they show yp as he didn't want this to go into next seasons operations. Mr. Reed stated that the Treatment plant needed some work, one of the main things is the effluent line leading into the river is overloaded that he needs about 1-500' of 1)1 pipe to dump sewerage into Horsepen creek at 12th Street. Mr. Lang was requested to obtain figures on this. The Mayor asked about the broken rails on the Board Walk and also stated that he wanted to get the side walk on Butler Avenue south of 16th Street constructed as soon as possible. .Mr-. Reed informed Council that there were some unusual high spring tides for several days during December and that the ocean water had covered the old parade ground at Ft. Screven and also come over the seawall at Tilton Street flooding that area considerably, he stated that a dkke could be built at the Ft. Screven area with sand located in that section. Chief McCutchen reported that Mr. Harlow of the Dual Co. is here to work on the meters and stated that he will be here until the job is finished, he found that water was getting in the heads and he will try to correct it, the Mayor instructed the Town Attorney to write the Dual Company relative to the Guarantee that the Town has with them, he doesn't want the meters patched up, what ever is to be done should be corrected now. The Mayor asked Mr. Reed if anyone was living in any of the buildings at the Treatment plant, Mr. Reed stated that a building was occupied by Robert Lee Thomas, colored, that he had been given notice to move but so far he has not. It was moved, seconded and passed that he be given 15 days notice to 128 128 move_. Mr. Solms was instructed to take a dispossesory warrant if he had not moved at the end of 15 days. Chief MoCutchen reported that the dog catcher had pick- ed up some dogs and he was instructed to collect $2.00, $1.00 for fee and $1.00 for 1951 license before the dog be returned to the owner.. It was moved, seconded and passed that discounts be allowed the following: J. J. Hunter, F. R. Schuman, Mrs. I. E. Wilson, Harry Wilson, W. B. & L. M. Griffin, Mrs. W. W. Wolfe, D. B. Gaines, Smith & Chivers, Ann & Sol Lesser, Max Krapf, Est. L. Greeno, Rita Ginsberg'and Nathalie Konter. A Mr. Lang stated that the new meters had arrived but that he had had no customers as yet, he was instructed that the meters must be installed by April 1, 1952, but that they would not be charged until May 1, 1952 for water service. It was moved, seconded and passed that bills f r the month of December for General Government amounting to $2017.48 be pai4 and likewise bills for the Water Department amounting to $1377.14 be paid. Councilman Lovell stated that in regards to repairing the water tank that it was necessary to have the estimates' re- vised to take care of painting the inside of the tank, that he had an offer to sell the Ft. Screven tank for $9,270.00. The Whitmire Company's estimate to repair the Butler Avenue tank was $5,780.00. It was moved, seconded and passed that the offer of the Whitmire Tank Company be accepted to repair the Butler Ave. tank at a cost not to exceed $6,000.00 and that the Town sell the Ft. Screven tank to the Brown Steel Company for $9,270..00. (Coun- cilman Lovell will see Town Attorney Solms.) A petition was presented by Mr. A. Leopold Alexander, for the Santa Elena Company, owners of Beach Lot 114, Ward 5, requesting permission to subdivide this Lot in keeping with requirements of the Building Code. It was moved, seconded and passed that the petition be granted. 1 129 129 It was moved, seconded and passed that the following Ordinance be adopted. AN ORDINANCE AN ORDINANCE TO PREVENT COMMERCIAL FISHING, SHRIMPING, AND /OR THE TAKING OF SHELL FISH OR CRUSTACEANS WITHIN ONE . MILE _ OF THE. MUNICI- PAL CORPORATE LIMITS ALONG THE BEACHES OF SAID MUNICIPALITY ALONG THE ATLANTIC OCEAN EXTENDING FROM THE SAVANNAH RIVER. ON THE NORTH TO. INLET RIVER ON THE SOUTH; FOR THE REGULATION, PROTECTION AND CONSERVATION OF SAID FISH,_SHRIMP, SHELL FISH OR_CRUSTACEANS IN ORDER_TO PROVIDE FOR_ THE HEALTH, SANITATION AND WELFARE OF SAID MUNICIPALITY; PROVIDING THE PENALTY FOR VIOLA- TION THEREOF; AND FOR OTHER PURPOSES. BE IT ORDAINED by the authority of the Mayor and Councilmen of-the Town of Savannah Beach, Tybee Island, in Council assembled, and it is hereby ordained by authority of the same: SECTION 1. It shall be unlawful to operate a boat, ship and /or any other vessel in the waters of the Atlantic Ocean within one mile of the corporate limits of the Town of Savannah Beach, Tybee Island, for the purpose of fishing, shrimping, the taking of shell fish and /or crustaceans with power driven nets for com- mercial purposes East of the said beaches of the Municipality extending from the Savannah River on the North to Inlet River on the South. SECTION 2. It shall be unlawful to operate any power driven boat, power driven ship and /or power driven vessel commonly known as a commercial fishing boat or commercial shrimping boat within one mile of the beaches of Savannah Beach, Tybee Island, from the Savannah River on the North to Inlet River on the South whereby the operation of the same causes unsanitary waste to drift upon the beaches and /or causes any other unsanitary condition to be created as a result thereof. SECTION 3. The area along the Atlantic Ocean immediately East of the . beaches of the Town of Savannah Beach, Tybee Island, and extending Eastwardly for one mile, bounded on the North by the Savannah River and on the South by Inlet River, is hereby declared to be a sanctuary and refuge wherein commercial fishing, that is, the taking of fish, shell fish, shrimp and /or crustaceans by power driven ship and /or boat in large quantities for commercial sale of the same is strictly prohibited. This said sanctuary and refuge is for the purpose of conserving the said fish, shell fish ,and crustaceans and is not intended that this shall prevent pleasure fishing and shrimping within said area. This said sanctuary and /or refuge is also established as a health measure to the inhabitants of Savannah Beach, Tybee Island. 130 SECTION 4. Any person violating the provisions of this ordinance, upon conviction in the Mayor's Court thereof, shall be subject to be fined not to exceed $100.00 and imprisoned not to exceed 30 days, either or both. SECTION 5. That all ordinances or parts of ordinances conflicting with the provisions of this ordinance are. hereby repealed. 130 1 1 1 131 131 It was moved, seconded and passed that the following Ordinance be adopted. AN ORDINANCE AN ORDINANCE TO AMEND AN ORDINANCE ESTABLISHING THE WATER DEPARTMENT: PRESCRIBING IN. THE MULES AND REGULATIONS. FOR. THE OPERATION OF THE WATER WORKS AND WATER DEPARTMENT; PROVIDING. FOR THE ELECTION _ OF A MANAGER . AND. SUPERINTENDENT; ESTAB- LISHING THE RATES FOR WATER SERVICE AND.WATER SUPPLY; PROVIDING FOR HEALTH REGULATIONS PER- TAINING TO THE WATER SYSTEM; ALL.. IN ACCORDANCE WITH THE.PROVISIONS OF AN ACT ADOPTED IN 1922 AND THE ACTS AIVNDING .. THE SAME;. AND -FOR OTHER PURPOSES. BE IT ORDAINED by the authority of the Mayor and Councilmen of .the Town of Savannah Beach, Tybee Island, Georgia, in Council assembled, and. it is hereby ordained by authority of the same. SECTION 1. That ,Section 3 of the Amended Water Ordinance, 41eretofore.adopted,.which said Section 3 amended Section 8 of the Original Water Ordinance, is amended by changing the date therein, "May 1, 1952" to April 1, 1952; so that the said section shall read as follows: "All commercial users shall install water meters not later than April 1, 1952." SECTION 2. Any person violating the provisions of this ordinance,.upon conviction thereof, shall be subject to be fined not to exceed $100.00 and imprisoned not to exceed 30 days, either or both. SECTION 3. That all ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby re- pealed.
