HomeMy Public PortalAbout14346 Dammert and Broadway Sanitary Relief (11155)ORDINANCE NO. 14346 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Dammert and Broadway Sanitary Relief (SKME-551) (11155) in unincorporated St. Louis County, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase &/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the County of St. Louis within the Martigney Creek Watershed wherein live and work numerous people; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Dammert and Broadway Sanitary Relief (SKME-551) (11155) as hereinafter set forth, said easements and temporary easements being more particularly described below: The foregoing ordinance was adopted on April 14, 2016 Parcel #17 A 10.00 FOOT WIDE EASEMENT across a tract of land conveyed to Cynthia M. Ribaudo by deed recorded in Deed Book 13972, Page 0243 of the St. Louis County, Missouri, Recorder’s Office said tract being Lots 6 through 10 in Block 1 of Frost’s Addition to Luxemburg as recorded in Plat Book 10, Page 27 of said Record’s Office and being more particularly described as follows: COMMENCING at the westerly corner of said Cynthia M. Ribaudo tract of land; THENCE South 53 degrees 51 minutes 49 seconds East along the southwestern line of said Cynthia M. Ribaudo tract a distance of 62.69 feet to the POINT OF BEGINNING of the centerline of herein described 10.00 FOOT WIDE EASEMENT; THENCE North 36 degrees 14 minutes 47 seconds East along said centerline a distance of 15.65 feet to a point; THENCE South 60 degrees 51 minutes 56 seconds East along said centerline a distance of 65.15 feet to a point; THENCE North 40 degrees 00 minutes 45 seconds East along said centerline a distance of 62.76 feet to the POINT OF TERMINATION of said centerline of the 10.00 FOOT WIDE EASEMENT, said POINT OF TERMINATION being South 54 degrees 06 minutes 08 seconds East along the northeastern line of said Cynthia M. Ribaudo tract a distance of 130.93 feet from the northern corner of said Cynthia M. Ribaudo tract, excepting therefrom those portions covered by the existing 10.00 foot wide easement conveyed to Lemay Ferry Sewer District by deed recorded in Deed Book 1699, Page 274 of said Recorder’s Office. Also two (2) TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any sewer in the above described sewer easement, said TEMPORARY CONSTRUCTION EASEMENTS being more particularly described as follows: A 15 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #1 lying adjacent to the northwestern and northeastern lines of herein described 10.00 FOOT WIDE EASEMENT, bounded on the southwest by the southwestern line of said Cynthia M. Ribaudo tract of land and bounded on the northeast by the northeastern line of said Cynthia M. Ribaudo tract of land excepting therefrom those portions covered by the existing 10.00 foot wide easement conveyed to Lemay Ferry Sewer District by deed recorded in Deed Book 1699, Page 274 of said Recorder’s Office. COMMENCING at the westerly corner of said Cynthia M. Ribaudo tract of land; THENCE South 53 degrees 51 minutes 49 seconds East, along the southwestern line of said Cynthia M. Parcel #25 A VARIABLE WIDTH EASEMENT across part of Lot 17 of Bismarck Heights Addition as recorded in Plat Book 5, Page 89 of the St. Louis County, Missouri, Record’s Office and being more particularly described as follows: BEGINNING at the westerly corner of said Lot 17; THENCE North 36 degrees 50 minutes 11 seconds East along the northwestern line of said Lot 17 a distance of 70.00 feet to the northerly corner of said Lot 17; THENCE South 53 degrees 52 minutes 06 seconds East along the northeasterly line of said Lot 17 a distance of 15.20 feet to a point; THENCE South 43 degrees 14 minutes 21 seconds West a distance of 46.65 feet to a point; THENCE South 36 degrees 50 minutes 11 seconds West a distance of 23.70 feet to a point on the southwesterly line of said Lot 17; THENCE North 53 degrees 52 minutes 06 seconds West a distance of 10.00 feet to the POINT OF BEGINNING, excepting therefrom those portions covered by the existing easements recorded in said Plat Book 5, Page 89. The 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the above described construction. The TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above described construction. THE 20.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the above described construction. Parcel #36 A 10.00 FOOT WIDE EASEMENT across part of Lot 1 in Block 1 of McDermott’s Subdivison of Hoffmeister Heights as recorded in Plat Book 4, Page 97 of the St. Louis County Missouri Recorder’s Office and being more particularly described as follows: COMMENCING at a point being the west corner of said Lot 1 said point also being on the southeastern right-of-way line of Dammert (40 foot wide) Avenue, THENCE along the northwestern line of said Lot 1 and the southeastern right-of-way of Dammert (40 foot wide) Avenue North 36 degrees 50 minutes 11 seconds East a distance of 43.24 feet to the centerline of a 10 foot wide easement , THENCE leaving said northwestern line of Lot 1 and the southeastern right-of-way of Dammert (40 foot wide) Avenue, South 43 degrees 20 minutes 43 seconds East for a distance of 25.37 feet; THENCE South 36 degrees 50 minutes and 11 seconds West a distance of 38.91 feet to a point being the end of said centerline of 10 foot easement said point also being South 53 degrees 10 minutes 49 seconds East a distance of 25.00 feet from the point of beginning.
