AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary easements in certain real property within The Metropolitan St. Louis Sewer District
for the purpose of construction of sewers and related appurtenances in the project known as
FF-04 Quiet Village Sanitary Relief (Thames Court to Fiesta Circle) (11747) in unincorporated
St. Louis County, Missouri to serve the needs of residents of the area, and authorizing staff to
proceed with further condemnation efforts related to the project, including but not limited to the
purchase &/or the filing of all necessary court pleadings or documents to commence and
prosecute formal legal proceedings for the acquisition of said easements and temporary
construction easements.
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area
of the County of St. Louis within the Missouri River Watershed wherein live and work numerous
people; and
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and
the residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over and across said area in order to relieve and
alleviate these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous
conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or
otherwise easements and temporary construction easements in real property for the construction
of sewers and related appurtenances in the project known as FF-04 Quiet Village Sanitary Relief
(Thames Court to Fiesta Circle) (11747) as hereinafter set forth, said easements and temporary
easements being more particularly described below:
The foregoing ordinance was adopted on April 14, 2016
Parcel #01
A 10.00 FOOT WIDE EASEMENT across Lot 45 of Park West Plat No. 3 as recorded in Plat
Book 89, Page 15 of the St. Louis County, Missouri Recorder’s Office and being more
particularly described as follows:
COMMENCING at the northern corner of said Lot 45, said northern corner also being the
southwestern corner of Lot 112 in Quiet Village Plat 6 as recorded in Plat Book 100, Page 34 of
said Recorder’s Office; THENCE South 60 degrees 33 minutes 33 seconds East along the
common line between said Lot 45 and said Lot 112 a distance of 41.98 feet to the Point of
Beginning of the center line of herein described 10.00 FOOT WIDE EASEMENT; THENCE
South 01 degrees 24 minutes 30 seconds West along said centerline a distance of 33.05 feet to
POINT “A”; THENCE South 60 degrees 16 minutes 49 seconds East along said centerline a
distance of 29.15 feet to the POINT OF TERMINATION #1 of herein described 10.00 FOOT
WIDE EASEMENT, said POINT OF TERMINATION #1 also being on the northeastern line of
said Lot 45, said POINT OF TERMINATION #1 being South 08 degrees 46 minutes 15 seconds
East a distance of 37.31 feet along the common line of said Lot 45 and Lot 44 of said Park West
Plat No. 3 from the northeastern corner of said Lot 45; THENCE BEGINNING at said POINT
“A” North 89 degrees 21 minutes 31 seconds West along said centerline a distance of 62.11 feet
to the POINT OF TERMINATION #2 of herein described 10.00 FOOT WIDE EASEMENT,
said POINT OF TERMINATION #2 also being on the northwestern line of said Lot 45, said
POINT OF TERMINATION #2 being South 26 degrees 27 minutes 17 seconds West a distance
of 59.17 feet along the common line of said Lot 45 and Lot 61 of said Park West Plat No. 3 from
the said northern corner of Lot 45, excepting therefrom those portions covered by the existing
easements recorded in said Plat Book 89 Page 15.
Also three (3) TEMPORARY CONSTRUCTION EASEMENTS for use during the construction
of any sewer in the above described sewer easement, said TEMPORARY CONSTRUCTION
EASEMENTS being more particularly described as follows:
A 15.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #1 lying adjacent to the
western line of herein described 10.00 FOOT WIDE EASEMENT, bounded on the north by the
said common line between Lot 45 and Lot 112 and bounded on the south by the northern line of
herein described 10.00 FOOT WIDE EASEMENT, excepting therefrom those portions covered
by the existing easements recorded in said Plat Book 89 Page 15.
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #2 lying adjacent to
the eastern and northeastern lines of herein described 10.00 FOOT WIDE EASEMENT, bounded
on the north by the said common line between Lot 45 and Lot 112 and bounded on the east by
the said common line of Lot 45 and Lot 44, excepting therefrom those portions covered by the
existing easements recorded in said Plat Book 89 Page 15.
COMMENCING at the said northern corner of Lot 45; THENCE South 60 degrees 33 minutes
33 seconds East along the said common line between Lot 45 and Lot 112 a distance of 63.58 feet
to a point; THENCE South 08 degrees 46 minutes 15 seconds East along said common line
between Lot 45 and Lot 44 a distance of 43.70 feet to the POINT OF BEGINNING of herein
described VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #3; THENCE
North 88 degrees 27 minutes 18 seconds West a distance of 46.79 feet to a point; THENCE
North 01 degrees 24 minutes 30 seconds East a distance of 14.73 feet to a point; THENCE along
the southern and southwestern lines of herein described 10.00 FOOT WIDE EASEMENT the
following bearings and distances: South 89 degrees 21 minutes 31 seconds East a distance of
18.77 feet to a point and South 60 degrees 16 minutes 49 seconds East a distance of 31.83 feet to
the POINT OF BEGINNING.
The three (3) TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon
completion of the above described construction.
Parcel #02
A 10.00 FOOT WIDE EASEMENT across Lot 112 of Quiet Village Plat 6 as recorded in Plat
Book 100, Page 34 of the St. Louis County, Missouri Recorder’s Office and being more
particularly described as follows:
COMMENCING at the northwestern corner of said Lot 112, said northwestern corner also being
the northeastern corner of Lot 61 in Park West Plat No. 3 as recorded in Plat Book 89, Page 15 of
said Recorder’s Office; THENCE North 85 degrees 16 minutes 37 seconds East along the
northern line of said Lot 112 and the southern right-of-way line of Leisure (50.00 foot wide)
Lane a distance of 22.18 feet to a point of curvature; THENCE 1.44 feet along said northern line
of Lot 112 being a curve to the right having a radius of 600.00 feet and a chord bearing of North
85 degrees 20 minutes 44 seconds East to the Point of Beginning of the center line of herein
described 10.00 FOOT WIDE EASEMENT; THENCE South 04 degrees 12 minutes 17 seconds
East along said centerline a distance of 83.85 feet to a point; THENCE South 01 degrees 24
minutes 30 seconds West along said centerline a distance of 16.08 feet to the POINT OF
TERMINATION of herein described 10.00 FOOT WIDE EASEMENT, said POINT OF
TERMINATION also being on the northeastern line of Lot 45 of said Park West Plat No. 3, said
POINT OF TERMINATION also being South 60 degrees 33 minutes 33 seconds East a distance
of 41.98 feet along the common line of said Lot 112 and said Lot 45 from the northern corner of
said Lot 45, excepting therefrom those portions covered by the existing easements recorded in
said Plat Book 100 Page 34 and Deed Book 3741 Page 334.
Also two (2) TEMPORARY CONSTRUCTION EASEMENTS for use during the construction
of any sewer in the above described sewer easement, said TEMPORARY CONSTRUCTION
EASEMENTS being more particularly described as follows:
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #1 lying adjacent to
the western lines of herein described 10.00 FOOT WIDE EASEMENT, bounded on the north by
the said northern line of Lot 112, bounded on the southwest by the said northeastern line of Lot
45 and bounded on the west by the eastern line of an existing 10.00 foot wide easement as
recorded in said Plat Book 100, Page 34 with a line offset 15.00 feet to the west and parallel to
the western line of herein described 10.00 FOOT WIDE EASEMENT, excepting therefrom those
portions covered by the existing easements recorded in said Plat Book 100 Page 34 and Deed
Book 3741 Page 334.
A 15.00 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #2 lying adjacent to the
eastern lines of herein described 10.00 FOOT WIDE EASEMENT, bounded on the north by the
said northern line of Lot 112 and bounded on the southwest by the said northeastern line of Lot
45, excepting therefrom those portions covered by the existing easements recorded in said Plat
Book 100 Page 34 and Deed Book 3741 Page 334.
The two (2) TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon
completion of the above described construction.

A VARIABLE WIDTH EASEMENT across Lot 214 of Quiet Village Plat 14 as recorded in Plat
Book 113, Page 54 of the St. Louis County, Missouri Recorder’s Office and being more
particularly described as follows:
Beginning at the southeastern corner of said Lot 214, said southeastern corner also being the
northerly right-of-way line of Thames Court (50’ wide); THENCE North 54 degrees 16 minutes
24 seconds East along the eastern line of said Lot 214 a distance of 169.24 feet to a point;
THENCE North 78 degrees 38 minutes 17 seconds West along the northern line of said Lot 214
a distance of 7.17 feet to a point; THENCE South 35 degrees 18 minutes 12 seconds West a
distance of 6.93 feet to a point; THENCE South 54 degrees 16 minutes 24 seconds West a
distance of 90.99 feet to a point; THENCE South 59 degrees 54 minutes 39 seconds West a
distance of 68.10 feet to a point on said northerly right-of-way line of Thames Court (50’ wide);
THENCE 9.75 feet along said northerly right-of-way line of Thames Court (50’ wide) being a
curve to the right having a radius of 50.00 feet and a chord bearing of South 41 degrees 19
minutes 18 seconds East to the POINT OF BEGINNING of herein described VARIABLE
WIDTH EASEMENT, excepting therefrom those portions covered by the existing easements
recorded in said Plat Book 113, Page 54.
Also a TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any
sewer in the above described sewer easement, said TEMPORARY CONSTRUCTION
EASEMENT being more particularly described as follows:
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT lying adjacent to the
western lines of herein described VARIABLE WIDTH EASEMENT, bounded on the northeast
by the said northern line of Lot 214, bounded on the southwest by the said northerly right-of-way
line of Thames Court (50’ wide), bounded on the northwest by a line COMMENCING at the
southeastern corner of said Lot 214, said southeastern corner also being the northerly
right-of-way line of Thames Court (50’ wide); THENCE 26.59 feet along said northerly
right-of-way line of Thames Court (50’ wide) being a curve to the left having a radius of 50.00
feet and a chord bearing of North 50 degrees 58 minutes 03 seconds West to a point; THENCE
North 59 degrees 54 minutes 39 seconds East a distance of 39.04 feet to a point; THENCE South
68 degrees 24 minutes 21 seconds East a distance of 6.17 feet to a point; THENCE North 22
degrees 09 minutes 33 seconds East a distance of 7.90 feet to a point; THENCE North 59
degrees 54 minutes 39 seconds East a distance of 94.21 feet to a point; THENCE North 35
degrees 18 minutes 12 seconds East a distance of 18.46 feet to the northern line of said Lot 214,
excepting therefrom those portions covered by the existing easements recorded in said Plat Book

The TEMPORARY CONSTRUCTION EASEMENT will become null and void upon
completion of the above described construction.

A VARIABLE WIDTH EASEMENT across Lot 107 of The Resubdivision of Quiet Village Plat
9 as recorded in Plat Book 103, Page 86 of the St. Louis County, Missouri Recorder’s Office and
being more particularly described as follows:
BEGINNING at the northwestern corner of said Lot 107, said northwestern corner also being the
northeastern corner of Lot 106 of said The Resubdivision of Quiet Village Plat 9; THENCE
North 85 degrees 15 minutes 49 seconds East along the northern line of said Lot 107 and the
southern right-of-way line of Trieste (50.00 foot wide) Drive a distance of 30.34 feet to a point;
THENCE South 48 degrees 58 minutes 12 seconds West a distance of 31.93 feet to a point;
THENCE South 14 degrees 14 minutes 19 seconds East a distance of 99.87 feet to a point; South
07 degrees 15 minutes 25 seconds West a distance of 6.03 feet to a point; THENCE North 86
degrees 52 minutes 31 seconds West along the southern line of said Lot 107, said southern line

construction of any sewer in the above described sewer easement, said VARIABLE WIDTH
TEMPORARY CONSTRUCTION EASEMENTS being more particularly described as follows:
COMMENCING at the said northwestern corner of said Lot 107; THENCE North 85 degrees 15
minutes 49 seconds East along the said northern line of Lot 107 a distance of 30.34 feet to the
POINT OF BEGINNING of herein described VARIABLE WIDTH TEMPORARY
CONSTRUCTION EASEMENT; THENCE North 85 degrees 15 minutes 49 seconds East along
the said northern line of Lot 7 a distance of 7.59 feet to a point; THENCE South 34 degrees 21
minutes 03 seconds West a distance of 37.64 feet to a point; THENCE South 05 degrees 14
minutes 02 seconds East a distance of 25.31 feet to a point; THENCE North 84 degrees 45

The VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT will become null
and void upon completion of the above described construction.

A 6.00 FOOT WIDE EASEMENT across Lot 106 of The Resubdivision of Quiet Village Plat 9
as recorded in Plat Book 103, Page 86 of the St. Louis County, Missouri Recorder’s Office and
being more particularly described as follows:
A 6.00 FOOT WIDE EASEMENT lying adjacent to the eastern line of said Lot 106, bounded on
the north by the southern right-of-way line of Trieste (50.00 foot wide) Drive and bounded on
the south by the northern line of Lot 62 of Park West Plat No. 3 as recorded in Plat Book 89,
Page 15 of said Recorder’s Office and the northern line of Lot 111 of Quiet Village Plat 6 as
recorded in Plat Book 100, Page 34 of said Recorder’s Office, excepting therefrom those
portions covered by the existing easements recorded in said Plat Book 103 Page 86.
Also a VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT for use during the
construction of any sewer in the above described sewer easement, said VARIABLE WIDTH
TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows:
COMMENCING at the northeastern corner of said Lot 106; THENCE South 85 degrees 15
minutes 52 seconds West along the northern line of said Lot 106, said northern line also being
the said southern right-of-way line of Trieste Drive a distance of 6.00 feet to the POINT OF
BEGINNING of herein described VARIABLE WIDTH TEMPORARY CONSTRUCTION
EASEMENT; THENCE South 04 degrees 44 minutes 08 seconds East along the western line of
herein described 6.00 FOOT WIDE EASEMENT a distance of 119.89 feet to a point; THENCE

The VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT will become null
and void upon completion of the above described construction.

A 10 FOOT WIDE EASEMENT across Lot 30 of Quiet Village Plat 7 as recorded in Plat Book
101, Page 25 of the St. Louis County, Missouri Recorder’s Office and being more particularly
described as follows:
A 10 FOOT WIDE EASEMENT lying adjacent to the northeastern right-of-way line of Momarte
Lane (50’ wide), bounded on the northwest by the northwestern line of said Lot 30, bounded on
the southeast by the southeastern line of said Lot 30, said southeastern line also being the
northwestern right-of-way line of said Momarte Lane (50’ wide), excepting therefrom those
portions covered by the existing easements recorded in said Plat Book 101, Page 25.
Also a TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any
sewer in the above described sewer easement, said TEMPORARY CONSTRUCTION
EASEMENT being more particularly described as follows:
A 15 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT lying adjacent to the
northeastern line of herein described 10 FOOT WIDE EASEMENT, bounded on the northwest
by the northwestern line of said Lot 30, bounded on the southeast by the southeastern line of said
Lot 30, said southeastern line also being the northwestern right-of-way line of Momarte Lane
(50’ wide), excepting therefrom those portions covered by the existing easements recorded in
said Plat Book 101, Page 25.
The TEMPORARY CONSTRUCTION EASEMENT will become null and void upon
completion of the above described construction.
Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is
hereby authorized to enter into contracts to acquire by purchase to the extent possible or to
continue with the condemnation process by preparing and/or filing all necessary court pleadings
and documents to institute and prosecute legal actions in condemnation to acquire all easements
for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan
St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private
property rights as hereinabove set out.
