AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary easements in certain real property within The Metropolitan St. Louis Sewer District
for the purpose of construction of sewers and related appurtenances in the project known as
DC-02 & DC-03 Sanitary Relief (Brentwood Blvd to Conway Rd) Phase II (12471) in the Cities
of Rock Hill, Ladue and Brentwood, Missouri to serve the needs of residents of the area, and
authorizing staff to proceed with further condemnation efforts related to the project, including
but not limited to the purchase &/or the filing of all necessary court pleadings or documents to
commence and prosecute formal legal proceedings for the acquisition of said easements and
temporary construction easements.
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area
of the County of St. Louis within the Deer Creek Watershed wherein live and work numerous
people; and
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and
the residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over and across said area in order to relieve and
alleviate these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous
conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or
otherwise easements and temporary construction easements in real property for the construction
of sewers and related appurtenances in the project known as DC-02 & DC-03 Sanitary Relief
(Brentwood Blvd to Conway Rd) Phase II (12471) as hereinafter set forth, said easements and
temporary easements being more particularly described below:
Parcel #36
A VARIABLE WIDTH EASEMENT in United States Survey 1930, Township 45 North, Range
6 East, St. Louis County, Missouri and being more particularly described as follows:
COMMENCING at the point of intersection of the southeastern line of property described in a
deed to R&R Investment Holdings, LLC, as recorded in Deed Book 19873, Page 2087 of the St.
Louis County Recorder’s Office, said southeastern line being also the northwestern line of
propert y described in a deed to the City of Brentwood, as recorded in: Deed Book 2607, Page
116; Deed Book 6149, Page 543 and Deed Book 6149, Page 545 of said Recorder’s Office, with
the southwestern line of the Missouri Pacific R.R. Creve Coeur Branch, width varies; THENCE
South 44 degrees 59 minutes 32 seconds West, 6.16 feet along said southeastern line to the
POINT OF BEGINNING of said VARIABLE WIDTH EASEMENT; THENCE continuing
South 44 degrees 59 minutes 32 seconds West, 15.08 feet along said southeastern line; THENCE
leaving said southeastern line North 50 degrees 48 minutes 26 seconds West, 456.50 feet to the
northwestern line of said R&R Investment Holdings property; THENCE North 68 degrees 22
minutes 16 seconds East, 17.18 feet along said northwestern line; THENCE leaving said
northwestern line South 50 degrees 48 minutes 26 seconds East, 221.20 feet to the southwestern
line of said Missouri Pacific R.R. Creve Coeur Branch; THENCE along said southwestern line
South 35 degrees 36 minutes 56 seconds East, 9.77 feet to a point in a curve on said
southwestern line; THENCE southeastwardly 116.97 feet along said southwestern line along a
curve to the left, having a radius of 2,914.79 feet, the chord of which bears South 52 degrees 03
minutes 43 seconds East, 116.97 feet; THENCE leaving said southwestern line South 50 degrees
48 minutes 26 seconds East, 102.08 feet to the POINT OF BEGINNING.
Also two (2) TEMPORARY CONSTRUCTION EASEMENTS for use during the construction
of any sewer in the above described sewer easement, said TEMPORARY CONSTRUCTION
EASEMENTS being more particularly described as follows:
A 27.50 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT #1 lying adjacent to the
southwestern line of the herein described VARIABLE WIDTH EASEMENT, the northeastern
line of said TEMPORARY CONSTRUCTION EASEMENT having a length 60.03 feet on said
southwestern line and bounded on the southeast by the southeastern line of said R&R Investment
Holdings property.
A VARIABLE WIDTH EASEMENT TEMPORARY CONSTRUCTION EASEMENT #2 lying
adjacent to the northeastern line of the herein described VARIABLE WIDTH EASEMENT,
bounded on the southeast and northeast by the southeastern and northeastern lines of said R&R
Investment Holdings property.
The above two (2) TEMPORARY CONSTRUCTION EASEMENTS will become null and void
upon the completion of the above described construction.

6 East, St. Louis County, Missouri, and being more particularly described as follows:
COMMENCING at northern corner of property described in a deed to R&R Investment
Holdings, LLC, recorded in Deed Book 19778, Page 2484 of the St. Louis County Recorder’s
Office, said corner being on the southeastern line of Manchester Road, 80 feet wide; THENCE
South 68 degrees 06 minutes 17 seconds West, 8.98 feet along the southeastern line of said
Manchester Road to the POINT OF BEGINNING of the herein described VARIABLE WIDTH
EASEMENT; THENCE leaving the southeastern line of said Manchester Road South 30 degrees

during the construction of any sewer in the above described sewer easement, said TEMPORARY
CONSTRUCTION EASEMENTS being more particularly described as follows:
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #1 lying adjacent to
the southwestern lines of the herein described VARIABLE WIDTH EASEMENT, bounded on
the southwest and southeast by the southwestern and southeastern lines of said R&R Investment
Holdings property and bounded on the northwest by the southeastern line of said Manchester
Road, excepting therefrom those portions covered by the existing easement recorded in Deed
Book 5210, Page 474 of said Recorder’s Office.
A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #2 lying adjacent to
the northeastern lines of the herein described VARIABLE WIDTH EASEMENT, bounded on
the northeast and southeast by the northeastern and southeastern lines of said R&R Investment
Holdings property and bounded on the northwest by the southeastern line of said Manchester
Road.
The above two (2) TEMPORARY CONSTRUCTION EASEMENTS will become null and void
upon the completion of the above described construction.

being on the northwestern line of Manchester Road, 80 feet wide; THENCE South 68 degrees 06

POINT OF BEGINNING of the herein described 15.00 FOOT EASEMENT; THENCE

The above TEMPORARY CONSTRUCTION EASEMENT will become null and void upon the
completion of the above described construction.

(2), recorded in Book 11044, Page 1414 of the St. Louis County Recorder’s Office, said corner
being on the center line of the Former Missouri Pacific Railroad Right of Way and also being on
the western line of property described in a deed to Rebecca Wood, recorded in Book 9578, Page
1427 of said Recorder’s Office; THENCE South 67 degrees 11 minutes 26 seconds West, 26.29
feet along the southeastern line of said Tract (2); THENCE leaving said southeastern line North
28 degrees 58 minutes 33 seconds West, 47.21 feet; THENCE North 23 degrees 33 minutes 05
seconds West, 38.07 feet to the northwestern line of said Tract (2) and also being the

for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan
St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private
property rights as hereinabove set out.
The foregoing ordinance was adopted on April 13, 2017.
