HomeMy Public PortalAbout14635 FF-18 Villa Dorado - Lackland - Page Sanitary Relief (Adie Rd to Villa Dorado Dr) (10018) ORDINANCE NO. 14635 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as FF-18 Villa Dorado – Lackland – Page Sanitary Relief (Adie Rd to Villa Dorado Dr) (10018) in the City of Maryland Heights, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase &/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the County of St. Louis within the Fee Fee Creek Watershed wherein live and work numerous people; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as FF-18 Villa Dorado – Lackland – Page Sanitary Relief (Adie Rd to Villa Dorado Dr) (10018) as hereinafter set forth, said easements and temporary easements being more particularly described below: Parcel #6 A 10.00 FOOT WIDE EASEMENT across a tract of land being part of Section 27, Township 46 North, Range 5 East as recorded in Deed Book 19201 Page 267 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: Commencing at the southeast corner of said tract of land as recorded in Deed Book 19201 Page 267 of the St. Louis County, Missouri Recorder’s Office, thence along the south line of said tract of land, North 89°41’30” West 407.30 feet to the POINT OF BEGINNING; said point being the centerline of a 10 foot wide easement; thence departing said south line of said tract of land, North 17’21’45” East 267.54 feet to point A; thence continuing North 11°20’48” East a distance of 13.55 feet to the point of termination. Beginning at Point A thence North 88°23’27” West a distance of 36.44 feet to the point of termination. Also two (2) TEMPORARY CONSTRUCTION EASEMENTS for use during the construction of any sewer in the above described permanent sewer easement, said temporary construction easement being more particularly described as follows: A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT Adjacent to the northwest line of the above described 10 foot wide easement being described as follows. Commencing at the southeast corner of said tract of land as recorded in Deed Book 19201 Page 267 of the St. Louis County, Missouri Recorder’s Office, thence along the south line of said tract of land, North 89°41’30” West 412.52 feet to the POINT OF BEGINNING; continuing along the south line North 89°41’30” West a distance of 21.02 feet; thence North 17°21’45” East a distance of 131.34 feet; thence South 59°10’07” East a distance of 3.48 feet; thence North 28°56’03” East a distance of 11.42; thence North 59°22’42” West a distance of 4.37 feet; thence North 29°12’30” East a distance of 29.64 feet; thence North 60°56’24” West a distance of 7.66 feet; thence North 17° 21’45” East a distance of 68.89 feet; thence North 88°23’27” West a distance of 23.41 feet; thence North 01°36’33” East a distance of 51.48 feet; thence South 75°47’20” East a distance of 55.18, thence South 11°20’48” West a distance of 9.58 feet; thence North 88°23’27” West a distance of 32.23 feet; thence South 01°36’33” East a distance of 10.00 feet; thence South 88°23’27” East 29.84 feet; thence South 17°21’45” West a distance of 223.07 feet to the Point of Beginning said point also being on the south line of the above said tract of land. A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT Adjacent to the southeast line of the above described 10 foot wide easement being described as follows. Commencing at the southeast corner of said tract of land as recorded in Deed Book 19201 Page 267 of the St. Louis County, Missouri Recorder’s Office, thence along the south line of said tract of land, North 89°41’30” West 381.15 feet to the Point of Beginning; thence continuing along the south line of said tract of land North 89°41’30” West a distance of 20.92’ to the southeast line of the above described 10 foot easement; thence along said southeast line North 17°21’45” East a distance of 266.27 feet thence; North 11°20’48” East a distance of 13.56 feet to a point being on the common line of the North line of the above said tract of land and on the south right of way line of Page Avenue; thence along said common line South 75°47’20” East a distance of 20.03 feet; thence leaving said common line South 11°20’48” East a distance of 13.61 feet, thence South 17°21’45” East a distance of 135.32 feet; thence South 29°13’01” West a distance of 40.03 feet; thence South 18°37’45” West a distance of 11.34 feet; thence South 01°01’43” West a distance of 30.13 feet; thence South 17°21’45” West a distance of 46.43 feet to the Point of Beginning said point also being on the south line of the above said tract of land. TEMPORARY CONSTRUCTION EASEMENT S will become null and void upon completion of the above described sewer construction. Parcel #8 A 10.00 FOOT WIDE EASEMENT across a tract of land being part of Section 27, Township 46 North, Range 5 East as recorded in Deed Book 15111 Page 571 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: Commencing at the southwest corner of said tract of land as recorded in Deed Book 15111 Page 571 of the St. Louis County, Missouri Recorder’s Office, thence along the south line of said tract of land, South 65°35’44” East a distance of 34.66 feet to the POINT OF BEGINNING; said point being the centerline of a 10 foot wide easement; thence departing said south line of said tract of land, North 29°59’42” West a distance of 12.52 feet; thence North 05°55’45” West a distance of 281.27 feet to point A; thence continuing North 04°50’58” West a distance of 338.76 feet; thence North 69°37’19” West a distance of 31.08 feet to the point of termination said point on the west line of the above said tract of land and on the east right of way line of Welsch Industrial Court. Beginning at Point A thence South 85°13’38” West a distance of 9.38 feet to the point of termination said point on the west line of the above said tract of land and on the east right of way line of Welsch Industrial Court. Also three (3) TEMPORARY CONSTRUCTION EASEMENTS for use during the construction of any sewer in the above described permanent sewer easement, said temporary construction easements being more particularly described as follows: A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #1 lying west of and Adjacent to the west line of the above described 10 foot wide easement being bounded on the north by the above described 10 foot easement, bounded on the west by the west line of the said tract of land and the east right of way line of Welsch Industrial Court bounded on the south by the above described 10 foot easement beginning at point A. A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #2 lying west of and Adjacent to the west line of the above described 10 foot wide easement being bounded on the north by the above described 10 foot easement beginning at point A, bounded on the west by the west line of the said tract of land and the east right of way line of Welsch Industrial Court bounded on the south by the south line of said tract of land and the north right of way line of Lackland 50 foot wide Road. Also a VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT #3 lying east of and Adjacent to the northeast line of the above described 10 foot wide easement, bounded on the north by the west line of said tract of land, bounded on the south by the south line of the above said tract of land and the north right of way line of Lackland 50 foot wide road bounded on the east by a line described as follows Commencing at a point being the southwest corner of said tract of land as recorded in Deed Book 15111 Page 571 of the St. Louis County, Missouri Recorder’s Office, thence along the south line of said tract of land South 65°35’44” East a distance of 77.61 feet to the Point of Beginning; thence North 29°59’42” West a distance of 42.11 feet; thence North 05°36’02” West a distance of 27.82 feet; thence South 84°38’56” West a distance of 10.87’ feet; thence North 05°36’02” West a distance of 234.34 feet; thence North 84°33’07” East a distance of 9.52 feet; thence North 05°55’45” West a distance of 13.52 feet; thence North 04’50’58” West a distance of 354.38 feet; North 69°37’19” West a distance of 59.13 feet; to a point being on the west line of said tract of land and the east right of way line of Welsch Industrial Court. Parcel #9 A 10.00 FOOT WIDE EASEMENT across a tract of land being part of Lot A of Welsch Industrial Park being a subdivision recorded in Plat Book 167 Page 40 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: Commencing at the southeast corner of said Lot A of Welsch Industrial Park being a subdivision recorded in Plat Book 167 Page 40 of the St. Louis County, Missouri Recorder’s Office, thence along the east line of said Lot A North 03°50’54” West a distance of 178.15 feet to the Point of Beginning, said point being the centerline of a 10 Foot Wide Easement; thence along said centerline South 85°13’38” West a distance of 25.91 feet to the point of termination. Also one (1) TEMPORARY CONSTRUCTION EASEMENT for use during the construction of any sewer in the above described permanent sewer easement, said temporary construction easement being more particularly described as follows: A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT lying Adjacent to the above described 10 foot wide easement being described as follows. Commencing at the southeast corner of said Lot A of Welsch Industrial Park being a subdivision recorded in Plat Book 167 Page 40 of the St. Louis County, Missouri Recorder’s Office, thence along the east line of said Lot A North 03°50’54” West a distance of 158.15 feet to the Point of Beginning; thence leaving said east line South 85°13’38” West a distance of 24.70 feet; thence North 05°31’36” West a distance of 6.22 feet; thence South 84°25’56” West a distance of 15.81 feet; thence North 04°46’22” West a distance of 34.00 feet; thence North 85°13’38” East a distance of 41.23 feet to a point on the east line of said Lot A; thence along said east line South 03°50’54” East a distance of 15.00 feet; thence leaving said east line South 85°13’38” West a distance of 25.99 feet; thence South 04°46’22” East a distance of 10.00 feet; then North 85°13’38” East a distance of 25.83 feet to a point on the east line of said Lot A thence along said east line South 03°50’54” East a distance of 15.00 feet to the Point Of Beginning. TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the above described sewer construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing ordinance was adopted on April 13, 2017.
