HomeMy Public PortalAboutOrdinance 3186ORDINANCENO. 3186 AN ORDINANCE GRANTING A CORNER SIDE YARD VARIANCE TO ALLOW A FENCE FOR THE PROPERTY LOCATED AT 24326 W BLAZING STAR COURT IN THE VILLAGE OF PLAINFELD, WILL COUNTY, ILLINOIS WHEREAS, Robert Olaszek has requested a corner side yard variance from the requirements for the R-1 Single Family Zoning; and WHEREAS, the Zoning Ordinance at Section 9-86 sets forth minimum setback requirements for comer side yard fences in the R- I Single Family Districts; and WHEREAS, the Zoning Board ofAppeals have made the following findings based upon the evidence presented to it: A. The variance is in harmony with the general purpose and intent of this chapter. B. Strict enforcement of the chapter would result in practical difficulties or impose exceptional hardships due to special and unusual conditions which are not generally found on other properties in the same zoning district. C. The property can yield a reasonable use if permitted only under the conditions allowed by this chapter. D. The variance, if granted, will not alter the essential character of the neighborhood and will not be a substantial detriment to adjacent property. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS: Section I.The President and Board of Trustees of the Village of Plainfield hereby adopt the findings of the Zoning Board of Appeals as its own and that the petition requesting a comer side yard variance to allow a fence at 24326 W Blazing Star Court to encroach 18 feet beyond the 30 foot comer side yard setback as to the re al estate hereinafter described be granted. Territory Described: Lot 180 in Heritage Meadows Neighborhoods 3 & 4, being a subdivision of part of the Southeast Quarter of Section 28, Township 37 North, Range 9 East of the Third Principal Meridian, according to the Plat thereof Recorded August 6, 2001, as Document No. R2001-102596 in Will County, Illinois. Section 2.There is hereby granted a variance allowing a fence to be located within the corner yard setback designated for fences subject to the following stipulations: 1. Compliance with the recommendations of the Village Engineer. 2. Compliance with the requirements of the Plainfield fire Protection District. 3. That the proposed comer side yard fence incorporate an open design. 4. That the fence be located no closer than 12 feet from the comer property line. PASSED THIS 17 TH DAY OF NOVEMBER 2014.
