HomeMy Public PortalAboutOrdinance 67-250ORDINANCE NO. 67 -250 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING ORDINANCE NO. 6.5 -170 OF THE CITY OF TEMPLE CITY, THE ELECTRICAL, CO.DE, RELAT- ING TO ELECTRICAL INSTALLATIONS, AND AMEND- ING SECTION 8202 RELATIVE TO ELECTRICAL PERMIT FEES, EXEMPTIONS AND REFUNDS. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Ordinance No. 2252 of the County of Los Angeles, entitled "Electrical Code," adopted by Ordinance No. 65-170 on July 20, 1965, is amended by repealing Sections 11, 12, and 13. SECTION 2. Sections 9 and 10 of said County Ordinance No. 2252 are renumbered to Sections 12 and 13, respectively. SECTION 3. Section 6 of said County Ordinance No. 2252 is renumbered to Section 9 and amended to read: "Section 9. Maintenance Electricians. A Certificate of Registration as Maintenance Electrician upon application therefor, may be issued to any person regularly employing one or more elec- tricians for the purpose of installation, alteration, or:mainte- nance of electrical wiring, or equipment on his own premises. The application for such maintenance certificate shall be made in writ- ing by a responsible officer of the firm and shall describe the premises where work is to be done and designate one or more elec- tricians for electrical maintenance supervisor. An annual regis- tration fee shall be paid for each maintenance supervisor as set forth in Section 8 of this ordinance. All such work shall be installed and done in accordance with the provisions of this ordinance and such work shall be subject to permits, fees and inspection by said Chief Electrical Inspector to the same extent as all other similar work for which such inspection is provided. The firm shall keep a •record of all work. performed under the maintenance certificate.showi :ng the nature' and location of the work and such records shall be made- availabi'e to the Chief Electrical Inspector.." SECTION 4. Section 8 of said County Ordinance No. 2252 is renumbered to Section 11 and is amended by changing subsections (a), (b), (c),`(d),'and (e) thereof to subsections (e), (c), (d), (f), and (g), respectively, and adding new subsections (a) and (b) thereofAo read: "Section 11. Inspection. (a) Scope. All new electrical work, and such portions of existing systems as may be affected by new work or any changes, shall be inspected by the Chief Electrical Inspector to insure compliance with all the requirements of this Code. Special inspections may be required on work involving special hazards or conditions and on work requiring extensive, unusual or constant inspection. Special inspections, when necessary, shall be accomplished by the means set forth in the Building Code except that the Special Inspector shall be a qualified person approved and registe -red by, and reporting to, the Chief Electrical Inspector. (b) Advance Notice. It shall be the duty of the person doing the work authorized by the permit to notify the Chief Elec- trical.,Inspector that said work is ready for inspection. Such notification shall be given not less than 24 hours before the work is to be .inspected." -1- 678 Ord. No. 67 -250 cont' d. SECTION 5. Section 5 of said County Ordinance No. 2252 is amended to read: "Section 5. Applications for Electrical Permits. (a) Applicants. The applicant for electrical permits shall be a certified electrician, registered maintenance electri- cian, or their authorized representative. Where a license is required by the State of California, a permit shall not be issued unless the applicant has such a license. In the case of a home- owner such application shall be for a special owner's permit. Application may be made by a firm, partnership, or corpora- tion, any officer or member of which is a certified electrician, in the event that all construction or work is done under the direct personal supervision of such officer or member. (b) Applications. Applications shall be made in writing and shall give the location where such work is to be done, either by street and house number, by lot, block and tract, or similar de- scription that will readily identify and definitely locate the proposed work. A separate application shall be required for each building or structure. EXCEPTION. Applications for single- family dwellings may include all accessory buildings such as garages, sheds, guest houses, and the like that are located on the same lot and erected at the . same time as the main building." SECTION 6. Said County Ordinance No. 2252 is amended by adding new Section 6 to read: "Section 6. Plans. Each application for electrical per- mit shall be accompanied by plans, specifications, diagrams, or calculations as required by the Chief Electrical Inspector. When a plan check or other fees are required by this or any related ordinance or statute, such fees shall be collected at the time the plans are filed. The plan checking fee shall be in addition to permit fees. Plans may be filed by certified electrician, mainten- ance electrician or authorized owner's representative." SECTION 7. Said County Ordinance No. 2252 is amended by adding new Section 7 to read: "Section 7. Permits. (a) Electrical Permits. No alteration or addition shall be made to any existing wiring, nor shall any wiring for the placing or installation of any electric light, power or heating device, or any apparatus which generates, transmits, transforms or utilizes electrici. °ty, operating at a voltage exceeding 25 volts between con - ductors or capable of supplying more than 50 watts, be made without first obtaining a permit therefor from the Chief Electrical Inspec- tor, excepting minor repair work such as repairing flush and snap switches, replacing fuses, changing lamp sockets and receptacles, taping bare joints, repairing drop cords and the like. The application, plans and specifications filed as required by this Section, shall be checked by the Chief Electrical Inspector, and if found to be in conformity with the requirements of this Code and all other laws or ordinances applicable thereto, the Chief Elec- trical Inspector shall, upon receipt of the required fee, issue a permit therefor. Every permit issued shall be valid only for the location described on the application therefor. (b) Annual Electrical Maintenance Permit. In lieu of a separate electrical permit for each installation or alteration an -2- 679 Ord. 67 -250 annual electrical maintenance permit may, upon application therefor, be issued to any person regularly employing one or more registered maintenance electricians for the purpose of installing, altering, and maintaining electrical wiring or equipment on premises owned or occupied by the applicant for such permit. The application shall be made in writing to the Chief Electrical Inspector and shall contain the name . and registration number of each maintenance electrician, and a description of the premises where work is to be done under the annual permit. A fee shall be paid for issuing each Annual Electrical Maintenance Permit as set forth in Section 8 of this ordinance. Within ten (10) days following the end of each calendar month the person to which an Annual Electrical Maintenance Permit has been issued shall transmit a report of all electrical work which has been done during the preceding month and shall pay all fees, except the fee for issuing permits, as set forth 'i in Section 11 of this ordinance. Where no work was done during the preceding, month a permit application shall be so marked, signed by a responsible person and submitted to the Chief Electrical Inspector. (c) Special Owner's Permit. The Chief Electrical Inspec- tor may issue to an individual a special owner's permit authorizing said individual to install, alter, change, or repair electrical equipment in, on, or about a single- family residence of which said individual is owner, and in which he resides or intends to reside, but not elsewhere; provided, that no electrical work authorized under any such special owner's permit shall be done, nor shall the owner holding any such permit allow any such work to be done, except personally by the owner to whom the permit is issued, or by a member of his immediate family; and, if this or any other provision hereof shall be violated by the holder of such special owner's permit, such permit shall be subject to immediate cancellation by the Chief Elec- trical Inspector, and the holder thereof shall be liable to the penalty hereinafter provided for violation of this Code. (d) Expiration of Permit. Every permit issued by the Chief Electrical Inspector under the provisions of this Code shall expire by limitation and become null and void if the building or work authorized by such permit be not commenced within 60 days from the date of such permit, or if the building or work authorized by such permit be suspended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be com- menced, a new permit shall be first obtained so to do. (e) Cancellation of Permit. If no portion of the work or construction covered by a permit issued by the Chief Electrical Inspector under the provision of this Code has been commenced, the person to whom such permit has been issued may deliver such permit to the Chief Electrical Inspector with a request that such permit be cancelled. The Chief Electrical Inspector shall thereupon stamp or write upon the face of such permit the words, "Cancelled at the request of the permittee." Thereupon such permit shall be null and void and of no effect." SECTION 8. County Ordinance No. 2252, adopted by Section 8202 of the Temple City Municipal Code, is amended by adding new Section 8 to read: "8202. Table of Fees. Section 8. Fees. At the time of filing an application therefor, a fee shall be paid to the Chief Electrical Inspector as set forth in this Section. .(a) Electrical Permit Fees. Other Inspections For each extra inspection resulting from defective workmanship or materials, each For inspection of electrical equipment for which no fee is herein set forth and for emergency inspections for the time consumed per hour $ 5.00 10.00 With a minimum charge for 1/2 hour or less 5.00 (b) Plan Checking Fee. A plan checking fee shall be paid at the time of submitting plans as required for all proposed installa- tions where one or more services or feeders have a disconnecting means with a single or combined total rating exceeding 600 amperes or having a capacity of 150 kilovolt- amperes (KVA) Said fee shall be equal 'to one -half (1/2) the required electrical permit fee as set forth in subsection (a) of this Section. (c) Maintenance Electrician Registration Fee. An annual registration fee shall be paid for each Certificate of Registra- tion as Maintenance Electrician. Each annual registration shall expire on June 30 annually, and each such certificate maybe °:r.e newed on or before that date upon payment of the renewal fee. Registration fee, each 15.00 Renewal fee, each 10.00 (d) Annual Permits. A fee of $25 shall be paid for each Annual Electrical Maintenance Permit at the time such permit is issued. The fees for all work done, excluding permit issuing fees, under such annual permit shall be paid at the time of transmitting monthly. reports. Each such annual permit shall expire on June 30 yearly. (e). Penalty Fee. Any person who shall commence any electri- cal work for which a permit is required by this ordinance without first having obtained a permit therefor shall, if subsequently permitted to obtain a permit, pay double the permit fee fixed by this Section for such work provided that this provision shall not apply to emergency work when it shall be proved to the satisfac- tion of the Chief Electrical Inspector that such work was urgently necessary and that it was not practical to obtain a permit therefor before the commencement of work. In all cases, a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such a permit, a double fee as herein provided shall be charged. (.f) Exemptions From Fees. The requirements for fees con- tained in this Code shall not apply when the collection of such fees is legally prohibited by other laws or ordinances. A fee shall not be required for the issuance of a permit to perform work regulated by this Code in a structure designed and used exclusively as an emergency fallout shelter. (g) Refund. In the event that any person shall have obtained a permit and no portion of the work or construction covered by such permit shall have been commenced or such permit shall have been cancelled without any work having been done as provided for in Section 7(d) or Section 7(e), the permittee, upon presentation to the Chief Electrical Inspector of a request there- for in writing on a special form,shall be entitled to a refund in -6- 683 1 1 Ord. No. 67 -250 an amount equal to 80 percent of the fee actually paid for such permit. The Chief Electrical Inspector shall satisfy himself as to the right of such applicant to such refund, and each such re- fund shall be paid as provided by law for the payment of claims against the county." SECTION 9. The City Clerk of the City of Temple City shall certify to the passage and adoption of this Ordinance and to its approval by the Mayor and shall cause the same to be published in the Temple City Times, a newspaper of general circulation, printed, published and circulated in the City of Temple City. 1967.
