HomeMy Public PortalAboutOrdinance 67-251ORDINANCE NO. 67 -251 AN ORDINANCE OF THE CITY OF TEMPLE CITY ENACTING AN INTERIM ZONING ORDINANCE; PURSUANT TO THE PROVISIONS OF SECTION 65858.0E. THE CALIFORNIA GOVERNMENT CODE, RELATING TO SUBSECTION 18 OF PARAGRAPH "A" OF SECTION 9390, AND THE ADDITION OF NEW SUBSECTION 16(a) TO SECTION 9400 AND THE DELETION OF SUBSECTION 40 OF SECTION 9400 OF THE TEMPLE CITY MUNICIPAL CODE, ALL RELATING TO THE ZONE CLASSIFICATION FOR CAR -WASH ESTABLISHMENTS THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. The City Council does hereby find and determine that the Planning Department of this City has heretofore under- taken studies to determine the appropriate zoning for car -wash establishments in order to safeguard against devaluation of neighboring residential properties; that said Planning Depart- ment has heretofore made certain recommendations in connection therewith. SECTION 2. The City Council further finds that the process- ing of such recommendation is contemplated by the Planning Com- mission and the City Council within the next few months, and that to permit construction of new car -wash establishments prior to the consummation of the appropriate hearings thereon would in large measure emasculate the benefits to be derived therefrom and would be contrary to the best interests and general welfare of the residents of this City. SECTION 3. Pending completion of such studies and pursuant to Section 65858 of the Government Code, Subsection 18 of Para- graph "A" of Section 9390 of the Temple City Municipal Code is hereby amended to read as follows: 18. Car Wash. Operations conducted without mechanical apparatus clearly incidental and secondary to another permitted automotive use; in no case as a principal business activity. SECTION 4. Pending completion of said studies, a new sub- section 16(a) is hereby added to Section 9400 of the Temple City Municipal Code, to read as follows: 16(a). Car Wash. Automatic, coin - operated, •mechanical., or by hand, except as set forth in Sub- section 18 of Paragraph "A" of Section 9390. SECTION 5. Pending completion of said studies and pursuant to the provisions of Section 65858 of the Government Code, Sub- section 40 of Section 9400 is hereby suspended. SECTION 6. This Ordinance shall remain in effect until December 19, 1967, and the Building Inspector of this City is directed not to issue any building permit for construction or substantial reconstruction during the term of this Ordinance, except in compliance with Sections 3, 4 and 5 hereof. SECTION 7. This Ordinance shall become immediately effective as an emergency Ordinance pursuant to the provisions of Section 65858 of the Government Code: and for the reasons above stated, and is adopted pursuant to the authority of -1- Ordinance No. 67 -251 Anderson v. Pleasant Hills, 229 CA 2d 79; Metro Realty v. County of El Dorado, 222 CA 2d 508; Hunter v. Adams, 180 CA 2d 511; 44 AG Ops. 14; and Slater v. Los Angeles, 238 CA 2d 864. SECTION 8. This Ordinance shall not affect or prejudice applications pending on the date hereof. SECTION 9. It shall be unlawful for any person to violate the provisions of Sections 3, 4 and 5 hereof. SECTION 10. The City Clerk shall certify and attest to the adoption of this Ordinance and shall cause the same to be pub- lished once in the Temple City Times, a semi - weekly newspaper, published and circulated in the City of Temple City. 1967.
