A RESOLUTION OF THE TOWN OF GULF STREAM
REQUESTING THE CITY OF RIVIERA BEACH TO
WITHDRAW ITS PENDING LAWSUIT AND CEASE
ITS EFFORTS TO BLOCK THE FUNDING OF
RESOURCE RECOVERY IN PALM BEACH COUNTY;
REQUESTING THE CITY OF RIVIERA BEACH TO
LIMIT ITS LEGAL ACTIONS TO THOSE DIRECTLY
RELATED TO THE DISPUTE OVER SITE SELECTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Town of Gulf Stream has
determined that the financing of a Resource Recovery project
for Palm Beach County is in the public interest; and
WHEREAS, the City of Riviera Beach has filed
suite to prevent the bond sale to provide the financing for
resource recovery, which said lawsuit could jeopardize the -
entire project:
WHEREAS, the proposed bond issue for resource
recovery contains no funds for any other purpose such as site
selection or land purchases; and
WHEREAS, if the City of Riviera Beach should be
successful in blocking the financing of resource recovery for
Palm Beach County, the result will be continued landfilling
for an extended time period and possibly the elimination of
Resource Recovery in Palm Beach County as an alternative method
of solid waste disposal.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN OF
GULF STREAM, that:
Section 1. The Town of Gulf Stream hereby
requests the City of Riviera Beach to withdraw its pending
lawsuit and cease it efforts to block the funding of Resource
Recovery in Palm Beach County.
Section 2. The Town of Gulf Stream hereby
requests the City of Riviera Beach to limit its legal actions
to those directly related to the dispute over site selection,
such as environmental permits and zoning.
Section 3. This Resolution take effect immediately
upon its passage.
PASSED AND ADOPTED by the Commission of the
Town of Gulf Stream, Palm Beach County, Florida this 14th
