M., in the Town Hall and was attended by Mayor Dutton, who presided, Councilmen Brown, Strong, Meddin, Lovell, Town Attor- ney Solms, Supt. Reed, Chief McCutchen and Mr. Lang. Councilman Lovell stated that the Town should get straight on the matter of charges for installing water mains, the present Ordinance allows the property owner 60l, all over that he is charged for, die suggested any water main installed in any public street south of Ft. Screven should be installed without charge and made it as a motion which was seconded and passed. The ques- tion of allowing property owners at Estill Station to sink a well was discussed and it was decided that the Water Committee has power to grant permission. Councilman Lovell stated that T. B. McCarroll owes for past due water rent which Mr. McCarroll con- tends some of the charges are too high, Supt. Reed stated that he had checked the meter and ascertained that he was using an average of 133,000 gallons per month, the Mayor stated that it - should be corrected, it was moved, seconded and passed that the - Mayor be authorized and empowered to handle the matter, using his discretion as to the correct amount that is due the Town. Councilman Lovell stated that he had issued instructions that if Mrs. Frank Naylor does not have a meter installed on the property now occupied by Hodges Store at Campbell Avenue and the Auto Road that the water be cut off, he also called attention to three parcels of property owned by R. H. Seay'and two parcels owned by J. G. Miller which have not been connected to the sewer- age system. It was decided that the Mayor will see Mr. Miller relative to his property and Town Attorney Solms will contact Mr. Seay. The Mayor informed Council that the building on Section 1 of Lot 14, Ward 1, in the name of Mike Goldberg should be con - demmed. It was moved, seconded and passed that condemnation proceedings be instituted against the property and the matter be referred to the Town Attorney. It was moved, seconded and passed that bills for the month of March for General Government amounting to $1663.23 be paid and likewise bills for the Water Department, Revenue, amounting to $1705.09 be paid. Chief McCutchen requested permission to employ a man to write parking violations to start work May 1st, last year a man was employed for this work for $160.00 per month, it was asked why one of the policemen couldn't do this, the Chief stated that he was instructed by Councilman Peters to keep a man at the Police Station, it was moved, seconded and passed that the Mayor and Police Committee be authorized and empowered to handle the matter. 182 Chief McCutchen requested that the radio - telephone equip- ment be moved to # 2 Police Station as soon as possible, he also stated that the Air Patrol will have three men down effective April 15th for the season. Supt. Reed called attention to the bad condition of the street in front of the Tybee Terrace cottages and stated that it should be repaired at once as it is dangerous and holds water as it cannot be drained, Thomas & Hutton had recommended that it be corrected. The Town Attorney was instructed to see Mr. J. 0. Bacon of the State Highway Department with a view to having the condition remedied. Councilman Strong reported that the work on the approach to the bridge at 6th Street near the 4 H Camp was progressing nicely, but that the Town should try and get a drag line. Supt. Reed stated that a lack of garbage cans at the homes on different parts of the Island is getting to be a problem, it was decided that when the tax notices were mailed a folder call- ing attention to Ordinances relating to garbage cans would be en- closed. Mr. Reed also stated that some sections of the water main running to the 4 H Camp had rusted out but that he had some pipe with which he could replace bad sections. Councilman Lovell called attention to the bad and danger- ous condition caused by Mr. Perry Solomon, Jr. littering up 2nd Avenue between 2nd & 3rd Streets with old rubbish, trash and etc., Councilman Strong was requested to contact Mr. Solomon and have him correct this condition. Councilman Brown suggested that some effort be made to bring several groups of Baseball Players to the Beach next summer, and acquire an area large enough to build three diamonds, he stat- ed that Mr. Earl Mack is coming to Tybee shortly. The Mayor stat- ed that the matter would be gone into at a later date. Councilman Lovell suggested that the compensation paid the Councilmen for the monthly attendance be increased, it was decided to hold off on this until the next meeting. Mr. W. Leon Friedman requested permission to erect a small sign, 41 x 6', on Lot 111, Ward 1, the owner of the lot granted permission to erect the sign, it was moved, seconded and passed that the request be granted. A petition was presented from Mr. Paul Slocomb requesting the Town to move a parking meter that is placed at the drive in to his property, Section M, Lot 85 -90, Ward 4. Referred to Police Committee. Town Attorney Solms informed Council that Mr. J. W. Simians CC 1 1 1 had protested the sale of a small strip of marshland opposite his Lot, 36, Camp Hammock, Ward 1, to L. A. Bann, Mr. Sirman contends that this is his property. AN ORDINANCE TO PROVIDE FOR TEE TAXATION OF REAL AND PERSONAL PROPERTY IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR COMMENCING MAY 1st, 1954 AND FROM YEAR TO YEAR UNTIL RE- PEALED; AND FOR OTHER PURPOSES. Section 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in Council assembled, and it is hereby ordained by the authority of the same, that the rate of taxation upon real estate and personal property within the limits of the said Town of Savannah Beach, Tybee Island, Georgia, for the fiscal year commencing May 1st, 1953, shall be TWO AND TWENTY -TWO HUNDREDTHS (2.22) PER CENT upon the assessed or returned value of same, the value of real estate improvements to be ascertained from the returns of the Committee on Assessments of said ayor and Councilmen, and the valuation of personal property to be ascertained from the re- turns of the owners thereof, in pursuance of the scheme and plan contained in Sections One, Two, Three and Four of the Ordinance to provide for the assessment of taxable property in the Town of Savannah Beach, Tybee Island, Georgia, and the mode of valuing such property for taxation and to carry into effect the provisions of the Act of the General Assembly of the State of Georgia, approved August 19, 1922, Section 21, passed Council assembled October 13, 1922; and it is further ordained that if any person or persons shall refuse to pay any DOUBLE TAX as- sessed as above provided within thirty (30) days after same shall become due, the Clerk of Council, as ExOfficio Treasurer of said Town, shall issue execution therefor and the further sum of One Dollar (61.00) for costs, and the Chief of Police and Ex- Officio Tax Collector shall proceed with such execution in the same manner as now provided by law in such cases of exe- cution lodged }• ith the Sheriff of Chatham County. Section 2. Every person who shall pay one -half (z) of his taxes on or before the 15th day of May 1953, and the bal- ance of said taxes on or before the 15th day of November 1953, shall be entitled to a deduction of ten (10) per cent on account thereof, and the Clerk of Council and Ex- Officio Treasurer of said Town is hereby authorized to make such deduction upon re- ceipt of tax. The provisions of this Section shall not apply to licenses for doing business in said Town, the rate for such licenses being net. The provisions of this Section shall apply, however, to those persons or companies required by the provisions of Section 92 -5902 of the Code of Georgia to make returns to the Comptroller General of Georgia. Section 3. This ordinance shall continue in effect for each and every fiscal year hereafter unless and until repealed or changed by ordinance. 1811-D Section 4. SECTION 1. Any person, firm or corporation, engaged in or doing business under such license shall also be required to report to the Clerk of Council of Savannah Beach; the name and address of each and every person from whom salvage or 'junk is purchased and said report shall further identify the article purchased as junk or salvage. The said report to the Clerk of Council of this Municipality shall be made within 24 hours after the completion of said trade, purchase, or acquisition of said junk or salvage. SECTION 3. In the event any business or calling not speci- fically mentioned in the above list set forth shall be established in the Town of Savannah Beach, Tybee Island, Georgia, the Mayor and Councilmen reserve the right to establish a license fee for same by ordinance, which fee is to be of equal dignity as the license specifically mentioned in the above Section, provided, however, that such license shall not be more than the sum of Five Hundred (500.00) Dollars. SECTION 4. This ordinance shall be subject to alteration or repeal in whole or in part at any time during the fiscal year beginning May 1, 1953, should it be deemed advisable, and no such amendment or repeal shall be construed to impair the right of Council to assess or levy tax for the whole of such year when ever made. SECTION 5. Any person, firm or corporation owning or oper- ating any riding device, or passenger vehicles for hire, before being issued a license therefor, shall deposit with the Clerk.of Council a policy of insurance against personal injury and property damage, with a receipt showing that the premium thereon has been paid for the length of time covered by the license, in such company and in such amount as may be approved by the Mayor and Councilmen for the benefit of any person or persons who may be killed or injured or sustain damage to property by the reason of operation thereof. SECTION 5 -A. In lieu of such policy of insurance, any person, firm or corporation owning or operating passenger vehicles for hire, before being issued a license therefor, shall deposit with the Clerk of Council a surety bond in the amount of Five Thousand (5,000.00) Dollars for each vehicle operated by said person, firm or corporation signed by surety company acceptable to the Mayor.and Councilmen of Savannah Beach, said bond guarantee- ing the payment of any loss or damage sustained any person or persons by reason of the . operation of such vehicle, the exact form of such bond to be approved by the Mayor and Councilmen of Savannah Beach. SECTION 5 -B. In lieu of such policy of .insurance and /or such surety bond, any person, firm or corporation owning or-oper- ating a passenger vehicle for hire, before being issued a license therefor, shall deposit with the Clerk of Council a real estate bond in the amount of Five Thousand ($5,000.00) Dollars for each vehicle operated by said person, firm.or corporation, signed by an owner of real estate who holds merchantable fee simple title to the same and acceptable to the Mayor and Councilmen of Savannah. _ 1x4 -p Beach, said bond guarantees the payment of any loss or damage sustained by any person or persons by reason Of the operation of such vehicle, the exact form of such bond to be approved by the Mayor and Councilmen of Savannah Beach.. If said real estate bond is approved by the Mayor and Councilmen the applicant for license shall pay the fee for recording of said bond in the Clerk's office of the' Superior Court of Chatham County, Georgia. SECTION 6. The Mayor and Councilmen reserve the right to refuse to issue to any one any licenses for any purposes for reasons sufficient by them. SECTION 7. Any person procuring a license on or after November 1, 1953, shall pay one -half the fee therefor set forth in this ordinance. SECTION 8. Such registrat- ion stamps shall be provided by the Clerk of Council who shall not sell said stamps in quantities of less than 425.00 at any one time, and shall not sell the same to anyone other than a distributor duly licensed and authorized to do business within the corporate lir.its of the 'Town of Savannah Beach, Tybee Island, and said registration stamps shall be in the amount of 41.00, Bach, and shall be affixed before such boards or books are plaw�ed in use. Said registration stamps shall bear, on its face, the words "Town of Savannah Beach, Tybee Island, Regis- tration Stampf1 and the amount thereof. It shall be the duty of any person using such registration stamp to destroy the sate after the merchandise so vended has been sold. No Stamp shali.be used more than one time on any such board or book and the same is not permitted to be transferred from one board or book to another. No such board or book used as a trade stimulator. shall be placed in use within the corporate limits of the Town of Savannah Beach until the same bas been first approved by the Chairman of the Police. Be it further ordained that it shall be unlaw- ful for any person, firm or corporation to sell, use or place in any place of business a trade stimulator that pays out money said boards commonly known as "Money Boards'. Any person, firm or corporation violating any of the provisions of this ordinance shall, upon conviction be- fore the Mayor's Court of said Town, be subject to be fined in the sum of not more than 4100.00 or be imprisoned not more than thirty (30) days, either or both, or any portion of either or both, in the discretion of the Court.
