PRESENT: Chairman James West, Member Ray Hart, Member Gary Elliott, Member John Lott, Member Dee Johnson, Assistant Clerk Heather Marley and City Attorney Andrew Rawlings. ABSENT: None. VISITORS: Scott Kelly. Chairman West welcomed everyone and led with the Pledge of Allegiance. Approval of Minutes: Chairman West entertained a motion. Member Lott moved to approve the minutes for March 11, 2020. Member Hart seconded the motion. All in favor, motion carried. Items of Business: a. Discussion of Creating a Historical District in the City of Iona: Attorney Rawlings explained the City Council's desire to create a Historic District in conjunction with other zones. Member Hart asked whether there is a specific size requirement. Mr. Rawlings said as an overlay, it can be any size and it leaves the zoning intact. Chairman West asked Mr. Rawlings if he recommended requiring building permits in the Historical District that specified any building should have a similar look as the historical buildings that are currently there. Mr. Rawlings responded it might be a good idea to require those details in the Resolution that creates the Historical District to avoid any problems in the future. Member Johnson asked what were the advantages or disadvantages of creating a historical overlay. Mr. Rawlings said the advantage of the overlay would be to preserve the historic nature of areas within the City and the disadvantage of the overlay is that it adds another layer of regulation that has to be enforced consistently. Mr. Rawlings said the other option would be to create another zone that would be a Historic Commercial Zone that would avoid a stacked layer of regulation. Chairman West asked if the City has done any research on other small cities like ours to see if they have a Historical District. Mr. Rawlings stated that he didn't find any cities similar enough to Iona but he did find that larger cities used the overlay or zone change that he suggested for the City of Iona. Member Hart asked if the community requests a specific property be labeled historical or just the property owner and City Council. Mr. Rawlings stated that property owners can ask about their own properties but if citizens want to include other properties other than their own, they would have to present it to the Planning and Zoning Commission. Mr. Rawlings explained that it would be wise to include variances to the Historical District to have the ability to change things over time if necessary. Chairman West thanked Mr. Rawlings for attending the meeting and for answering the Commission's questions. b. Discussion of Iona City Code Title 11, Chapter 6 - Commercial Zone: Chairman West stated this discussion would decide what businesses would be deemed "Not Permitted Uses" instead of being on the Conditional Use Permit section. Mr. Rawlings stated that adult book stores and junk or salvage yards were the two changes the City Council wanted to make. Chairman West stated he would like to go through each section 1 and specify any changes the Commission would suggest the City Council to make. Chairman West asked Mr. Rawlings what would define "manufacturing". Mr. Rawlings stated that if a raw material is made into a useable product and sold, it would be considered manufacturing. Chairman West asked Mr. Rawlings to explain Residential Use directly related to Commercial Use. Mr. Rawlings stated if someone has a business that needs to be attended to frequently, the owner would live on the premises. Member Lott inquired about things that are not listed and how to go about that. Mr. Rawlings stated that any business in question would have to go through the proper channels to make sure it's permitted. Member Hart asked whether communication towers can be banned from an area. Mr. Rawlings said they would have to go through City Council to get it approved. Mr. Rawlings explained the purpose of a Conditional Use Permit is to keep things regulated. Chairman West asked about the height requirements listed and Mr. Rawlings stated that if any business needed to have a building higher than what is required, that they could apply for a Conditional Use Permit instead of applying for a Variance. Member Johnson stated that the height requirement pertains only to the living area, not chimneys or antennas. Members discussed setback requirements for Commercial Properties. Members discussed changing the wording to the buffer restriction and that there needs to be more clarity about water collection and landscaping. Chairman West asked about the protection of waterways and if there needs to be an agreement between the landowner and the canal owner. Mr. Rawlings stated the canal owners have to comply with state law and that the City must communicate with the canal owner. There are currently no Commercial Properties interfering with canals within the City of Iona. Chairman West suggested adding a provision that if a commercial property is using water rights from a canal to irrigate; they should not be required to use City water. c. Discussion of Iona City Code Title 11, Chapter 12 — Off -Street Parking and Loading Facilities: Members discussed changing the parking requirements to be within the same property or contiguous to the building. Chairman West suggested comparing Iona's parking requirements to the Cities of Ammon and Idaho Falls. He also asked what the definition of "parking" is and whether businesses have to have asphalt or gravel. Mr. Rawlings stated it needs to be paved but also has to have landscaping or a place for drainage. Members discussed a need for City approval if the property owner wants to do something different than what is written in the City Code. Members discussed striping in parking stalls and adding a specific size requirement. Members discussed height requirements for landscaping and making sure they don't obstruct views of streets for safety. Member Hart made a motion to adjourn the meeting.
