Gonzalez, Village Manage r),-r � DATE: February 27, 2015 ((�� SUBJECT: Harbour House Association The purpose of this Letter to Council (LTC) is to inform you that the Village's Administration has successfully finalized civil violation number 12-010 with the Harbour House Association. This case was initiated on August 20, 2012 and involved several code violations resulting from the inappropriate sale and unlawful conversion of common areas into habitable living quarters. The Harbour House was confirmed to be in compliance on July 17, 2014; however, the Association had accumulated civil penalties in the amount of $92,500. The Harbour House Association requested mitigation of these fines owed to the Village. The Village's Administration entered into negotiations with the new Harbour House Association President and Management agreeing to reduce the penalties to $42,500 provided that the Association complied with the following conditions: • The payment of the $ 42,500 is to be delivered to the Village by 4pm on March 11, 2015; • The Association agrees to install at its own expense (not less than $20,000), a white galvanized garage type door on the Harbour House loading dock and paint the interior of the loading dock to match the garage door in a manner whose aesthetics are approved by the Village; • The loading dock will be equipped with an insect control device, and a tarp that will shield the garbage containers from the public's view when the loading dock's new garage door is open; • The Association shall pressure clean, pave and repair the interior of the loading dock area, and make improvements to the driveway; driveway apron and trench drain in and around the loading dock area. These conditions must be complied with within 60 days of the issuance of permits or Architectural Review Board approval. Failure to do so will result in the automatic reinstatement of the civil penalties in the amount of $ 92,500.
