May 28, 2013
The Moab City Council held its Regular Meeting on the above date in the
Council Chambers at the Moab City Center, located at 217 East Center
Street, Moab, Utah. Mayor David L. Sakrison called the Pre -Council
Workshop to order at 6:30 PM. In attendance were Councilmembers
Jeffrey Davis, Kirstin Peterson, Kyle Bailey, Doug McElhaney and Gregg
Stucki; Planning Director Jeff Reinhart, City Treasurer Jennie Ross, City
Engineer Rebecca Andrus, Community Development Director David
Olsen, Public Works Director Jeff Foster, Animal Control Sergeant Randy
Zimmerman, Police Chief Mike Navarre, City Manager Donna Metzler
and Deputy City Recorder Danielle Guerrero.
Mayor Sakrison called the Regular City Council Meeting to order at 7:00
PM. Eight (8) members of the audience and media were present.
Councilmember Peterson moved to approve the minutes of March 28,
2013. Councilmember Stucki seconded the motion. The motion carried
5-0 aye.
There were no Citizens to be Heard
A Community Development Department Update was not given.
An Engineering Department Update was not given.
A Planning Department Update was not given.
A Police Department Update was not given.
Under Public Works Department Update, Public Works Director Foster
stated the Rotary Park Project was going well and that the new
bathrooms should be open soon. Public Works Director Foster stated
400 North would have the pavement treated and then restriped with
the new crosswalk.
Mayor Sakrison opened the Public Hearing on proposed Resolution #08-
2013 — A Resolution Adopting the Fiscal Year 2013-2014 Annual Budget
at 7:15 pm.
Mayor Dave Sakrison closed the Public Hearing on proposed Resolution
#09-2013 — A Resolution Adopting the Fiscal Year 2013-2014 Annual
Budget at 7:25 pm.
Councilmember Bailey moved to approve a Conditional Use Permit for
Erin Greeley for a Bed and Breakfast in the R-2 Zone Located at 590
North 500 West. Councilmember McElhaney seconded the motion. The
motion carried 5-0 aye.
Councilmember Stucki moved to approve an Application for the Special
Use of Swanny City Park by Adam Bramwell, d.b.a. Rule the Rocks for a
Skate and BMX Competition on June 5, 2013 with conditions.
Councilmember Peterson seconded the motion. The motion carried 5-0
aye.

License for Adam Bramwell, d.b.a. Rule the Rocks for a Skate and BMX
Competition on June 5, 2013. Councilmember Peterson seconded the
motion. The motion carried 5-0 aye.
Councilmember Bailey moved to approve an Application for Special Use
of the Center Street Ball Park by Travis Packard, d.b.a. Canyonlands
Men's Fast Pitch Tournament on June 14 and 15, 2013 with conditions.
Councilmember McElhaney seconded the motion. The motion carried 5-
0 aye.
Councilmember Stucki moved to approve a Special Event License for
Travis Packard to conduct the Canyonlands Men's Fast Pitch Tournament
on June 14 and 15, 2013 at the Center Street Ball Park. Councilmember
McElhaney seconded the motion. The motion carried 5-0 aye.
Councilmember Peterson moved to approve a Waiver of Fees by the
Canyonlands Men's Fast Pitch Tournament not to exceed $240.00.
Councilmember Stucki seconded the motion. The motion carried 5-0 aye
by a roll -call -vote.
Councilmember Davis moved to approve a Peddler/Solicitor License for
Crystal Laxton, d.b.a. CC Ice Cream to conduct a Mobile, Pre -Packaged
Ice Cream Business. Councilmember McElhaney seconded the motion.
The motion carried 5-0 aye.
Councilmember Peterson moved to approve a Development Agreement
for Raven's Rim Zip Line Adventure Project. Councilmember Stucki
seconded the motion. The motion carried 5-0 aye.
Councilmember Stucki moved to approve Proposed Ordinance #2013-05
— An Ordinance Approving a Zone Change from C-3 to C-2 at 263 South
100 East and Amending the Official Zoning Map of the City of Moab.
Councilmember Davis seconded the motion. The motion carried 5-0 aye.
Councilmember Bailey moved to approve a request to send Proposed
Ordinance #2013-06 — An Ordinance Amending the City of Moab
Classified Hourly Pay Rate Schedule and Exempt and Elected Officials
Salary to Public Hearing. Councilmember McElhaney seconded the
motion. The motion carried 5-0 aye.
Councilmember Bailey moved to approve a request to send Proposed

Under Administrative Report, City Manager Metzler asked the City
Council to look at the photos for the new website that was sent to
them by email. City Manager Metzler stated that City Staff is working
on the Vendor Ordinance and progress is being made.

A Report on City/County Cooperation was not given.
Under Mayor and Council Reports, Councilmember Davis requested a
discussion be added to the next City Council Agenda to discuss allowing
dogs in Swanny Park.
Councilmember Davis moved to approve the bills against the City of
Moab in the amount of $166,563.56. Councilmember Bailey seconded
the motion. The motion carried 5-0 aye by a roll -call -vote.
Councilmember Stucki moved to adjourn the Regular City Council
Meeting. Councilmember McElhaney seconded the motion. Mayor
Sakrison adjourned the Regular Council Meeting at 7:25 PM.

Budget
Fiscal Impact: The budget sets the fiscal policy for the entire City for the entire
fiscal year.

Background/Summary: At the end of each fiscal year, the City Council
examines the city budget to ensure that all funds, departments and line items fall
within the budgeted amount. The budget is then amended to provide for a
balanced budget. For the current year, only a few adjustments will be needed.
These adjustments are detailed on the attached spreadsheet. Proposed
amendments are presented to the public for public input, and then adopted by
the City Council in the form of a resolution, which is also attached.
Options: The City Council may approve, approve with conditions, postpone, or
vote not to approve the resolution.
Staff Recommendation: Staff recommends that the City Council approve the
resolution as presented.
Recommended Motion: "I move to approve Resolution #09-2013."

Background/Summary: The City adopts a new compensation chart annually to
accommodate the Cost of Living Adjustment (COLA) for city wages. The COLA
increase this year was initially estimated at 2%, based on the Consumer Price
Index for last year and was reduced to 1 % to reduce the overall City Budget. The
9% increase in the City's health care premium necessitated this. The wages
proposed in this Ordinance reflect the 1 % COLA increase.
Options: Council can approve, table, or deny the proposed ordinance.
Staff Recommendation: Staff recommends approving the proposed
ordinance.
Recommended Motion: I move to approve Proposed Ordinance #2013-06

AN ORDINANCE AMENDING THE CITY OF MOAB CLASSIFIED HOURLY
PAY RATE SCHEDULE AND EXEMPT AND ELECTED OFFICIALS SALARY
WHEREAS, the Moab City Personnel Policies and Procedures Manual allows that pay
ranges may be adjusted periodically to accommodate increases in the cost of living; and
WHEREAS, the Moab City Personnel, Policies and Procedures Manual calls for using
standard state and national measures to determine cost of living adjustments; and
WHEREAS, the Utah Bureau of Labor Statistics showed that the Cost of Living Increase
for the State of Utah from 2011-2012 was greater than 1 %; and
WHEREAS, the 2013/2014 Fiscal Year Budget Shows a 1 % Cost of Living Increase for
all employees covered by the Pay Rate Schedule; and
WHEREAS, the proposed "City of Moab Classified Hourly Pay Rate Schedule" is
attached to this resolution as Attachment A, respectively; and
WHEREAS, Moab Municipal Code Section 2.44.010 states that all salaries of the
elective and appointive officers of the City and the other employees of the City shall be
fixed by motion or resolution of the City Council as in accordance with existing law.
NOW, THEREFORE, WE, THE GOVERNING BODY OF THE CITY OF MOAB
RESOLVE TO ADOPT The City of Moab Classified Hourly Pay Rate Schedule
(Attachment A) and Exempt and Elected Official Salaries (Attachment B) as referred
herein effective July 1, 2013.

1. Phantom will provide liability insurance coverage in the aggregate amount of $10,000,000.00, will name Landlord as an "Additional
insured," and will, prior to occupancy, deliver a certificate to Landlord evidencing such insurance covering the erection, maintenance
and operation of the fireworks sales venue; addition*, Phantom will hold the Landlord harmless from any liability in connection with

retum the premises to its original condition.
3. Phantom shall obtain and pay for all necessary permits and licenses required by law; shall post any debris and performance bonds
required by local authority; and shall adhere to all laws and regulations.
4_ if the safe of consumer tireworics shall be prohibited by public authority, the prepaid lease rent will be refunded, and this lease
agreement shall automatically become nu0 and void. • If the public authority Craving Jurisdiction over the lewd premises limits or
restricts the sale of fireworks In any way, then this lease agreement is subject to revision.
S. If Phantom Is unable to secure a group to operate on the property and the property is not utilized, the prepaid rent will be refunded,
and this lease agreement shall automatically become null and void for that year. In the event the property is not utilized in a given year,
Phantom shall have the option to use the property for the following year under the same terms and conditions by giving notice by March
1, of the next year. If the property is sold or otherwise Insoaessible due to construction or the like, then this lease Is subject to revision.
If this lease should become nuD and void under this provision or paragraph 4 of this agreement, then prepaid rents shalt be refunded to
Phantom within ten (ten) business days of written cancellation. (Landlord's Valets).
5. Landlord agrees that if a refund of prepaid rent is due and owing to Phantom under the provisions of this agreement, that Phantom's
acceptance of less than the full amount of any prepayment shall not be deemed'an accord and satisfaction or compromise of such
payment unless Phantom specifically consents in writing to payment of such lesser fund, regardless of Landlord's characterization as
'full payment," "accord and satisfaction,' or other similar characterization on the payment instrument
7. In any action or proceeding to enforce, interpret Or declare rights under this agreement, the prevailing party shall be entitled to its
reasonable attorney fees, costs associated with suit and litigation expenses_
9. Rent shall be payable by June 1st of each lease year.
9. This agreement commends as of the date indicated on the signature below.
10. Phantom is hereby given an option to renew this Lease for five (5) one (1) year periods beginning in the year 2013 Murder the
same terms and conditions as stated above. Phantom must notify Landlord of its intent to exerdse option by September 1 of the last
lease year reflected in this Lease.
11. Each individual signing this Lease Agreement expressly represents and warrants that they are authorized by the entity for which
they sigh, to legally bind and c OMMit that entity to the terms set forth herein. All notices required or allowed under this Agreement shall

PRECAUTIONS
WATER SUPPLY — Have a ready supply of
water or a fire extinguisher. A connected hose
is the best precaution, but buckets of water or
fire extinguishers will do. An adult should be
designated as the fireman, whose job is to
watch the path of the fireworks and follow the
remnants down to the ground to make sure no
fires are started.

watered down prior to any device being
ignited.

TYPE OF SHOOTING SITE — The shoot-
ing site should ideally be concrete, asphalt or
dirt — a surface that will not burn. The fireworks
should be kept away from wooded or grassy
areas that would be susceptible to fire. Be
sure to clean up all combustible grass, dry
leaves and brush from the shooting area.
ADULT SUPERVISION NECESSARY —
Adults must be present at all times to ensure
that the safety precautions are met.

precautions when using consumer fireworks.

CELEBRATE SAFELY -
and remember...
• Never let children handle, play with or light any fireworks.
• Do not use alcohol with fireworks.
• Follow your local and state laws regarding the possession and use of fireworks.
Do not use illegal explosives; do not alter any firework device; do not make your
own fireworks.
• Use fireworks on a hard, flat and level surface.
• Use in a clear, open area. Keep the audience a safe distance away from the shooting
site. Do not light fireworks where there is dry grass or brush that could catch fire or
near any flammable items. Never shoot fireworks in metal or glass containers.
• Keep clear of the fireworks. Never put your head or any part of your body over the
top of any fireworks product. Never look into a tube to check on the firework item.
Never hold a lighted firework in your hand.
• Always light fireworks products with a punk, Phantom pyro-torch, flare or extended
butane lighting device. Use a flashlight at night so you can see the fuse. Never use
a lantern or other flame -producing device near fireworks for illumination. Light the
fireworks product and get away quickly.
• Light only one firework item at time.
• Don't use malfunctioning items. Never attempt to re -light, alter or fix any "dud"
firework item.
• Have a fire extinguisher, water supply, hose or bucket of water nearby. Be cautious
of lighting any fireworks during strong wind conditions. Light fireworks with
prevailing wind blowing away from the spectators.
• Use care in handling fireworks. Do not carry fireworks in your pocket. Never
smoke when handling fireworks.
• Never use the fireworks as weapons. Never aim, point or throw any fireworks at
another person.
• Store fireworks in a cool, dry place and dispose of fireworks properly.
• Use fireworks outdoors. Never use fireworks indoors.

• You may now discharge State Approved Fireworks beginning on July
1st and ending on July 7th and beginning on July 21st and ending on July
27th between the hours of 11am and 11pm, except that on July 4th and
July 24th the hours are 11am to Midnight. Contact your local
authorities for specific regulations in your area.
• Aerial devices, also known as multiple tube", "repeater", or "cake"
fireworks often look like miniature professional displays and can
travel high into the air, as much as 150 feet.
• These fireworks need sufficient space from trees, carports,
structures, power lines or other high or low obstacles. Aerial or
"cake" fireworks need at least a 30 foot clearance around on the
ground and at least 150 foot clearance in the air.
• Aerial fireworks are designed to travel up to 150 feet into the air and
then explode.
• Aerial fireworks shall be placed on a hard level surface outdoors, in
a clear and open area prior to ignition.
• Anyone under the age of 16 shall not handle or operate aerial
fireworks.
• Ignition of aerial fireworks shall be a minimum of 30 feet from any
structure or vertical obstruction.
• Aerial fireworks shall not be ignited within 150 feet of the point of
sale.
• Please read and obey all safe handling instructions before using
aerial fireworks.
Still not allowed: firecrackers, M-80, cherry bombs, bottle rockets.

In reviewing your moved -on structure application this morning, it was noted that your start date was listed as June 25,
2013. Please be aware that your start date cannot occur until you've received City Council approval, obtained your
required inspections, and submitted your final paperwork to the City Treasurer's Office. The City Council will not be
reviewing your application until the evening of June 25, 2013 so your start date must occur after this date.
Also, I noticed that a storage container has been placed on the Walker Drug property. It is my understanding that the
storage container is associated with your moved -on structure permit application. This storage container must be
removed immediately and cannot return until you have approval by the City Council for a moved -on structure permit.
Once the City Council has reviewed and approved your application, the structures can be placed on the property but
they must be placed where they are indicated on the site plan.
