Check our website for updates at: www.moabcity.org Page 8 of 67 MOAB CITY COUNCIL REGULAR MEETING May 28, 2013 The Moab City Council held its Regular Meeting on the above date in the Council Chambers at the Moab City Center, located at 217 East Center Street, Moab, Utah. Mayor David L. Sakrison called the Pre -Council Workshop to order at 6:30 PM. In attendance were Councilmembers Jeffrey Davis, Kirstin Peterson, Kyle Bailey, Doug McElhaney and Gregg Stucki; Planning Director Jeff Reinhart, City Treasurer Jennie Ross, City Engineer Rebecca Andrus, Community Development Director David Olsen, Public Works Director Jeff Foster, Animal Control Sergeant Randy Zimmerman, Police Chief Mike Navarre, City Manager Donna Metzler and Deputy City Recorder Danielle Guerrero. Mayor Sakrison called the Regular City Council Meeting to order at 7:00 PM. Eight (8) members of the audience and media were present. Councilmember Peterson moved to approve the minutes of March 28, 2013. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. There were no Citizens to be Heard A Community Development Department Update was not given. An Engineering Department Update was not given. A Planning Department Update was not given. A Police Department Update was not given. Under Public Works Department Update, Public Works Director Foster stated the Rotary Park Project was going well and that the new bathrooms should be open soon. Public Works Director Foster stated 400 North would have the pavement treated and then restriped with the new crosswalk. Mayor Sakrison opened the Public Hearing on proposed Resolution #08- 2013 — A Resolution Adopting the Fiscal Year 2013-2014 Annual Budget at 7:15 pm. Mayor Dave Sakrison closed the Public Hearing on proposed Resolution #09-2013 — A Resolution Adopting the Fiscal Year 2013-2014 Annual Budget at 7:25 pm. Councilmember Bailey moved to approve a Conditional Use Permit for Erin Greeley for a Bed and Breakfast in the R-2 Zone Located at 590 North 500 West. Councilmember McElhaney seconded the motion. The motion carried 5-0 aye. Councilmember Stucki moved to approve an Application for the Special Use of Swanny City Park by Adam Bramwell, d.b.a. City Manager Metzler stated that City Staff is working on the Vendor Ordinance and progress is being made. Councilmember Davis moved to approve the bills against the City of Moab in the amount of $166,563.56. Councilmember Bailey seconded the motion. The motion carried 5-0 aye by a roll -call -vote. [. Staff Presenter(s): Donna Metzler Department: Administration Applicant: Not applicable Background/Summary: At the end of each fiscal year, the City Council examines the city budget to ensure that all funds, departments and line items fall within the budgeted amount. The budget is then amended to provide for a balanced budget. For the current year, only a few adjustments will be needed. These adjustments are detailed on the attached spreadsheet. Proposed amendments are presented to the public for public input, and then adopted by the City Council in the form of a resolution, which is also attached. Options: The City Council may approve, approve with conditions, postpone, or vote not to approve the resolution. Staff Recommendation: Staff recommends that the City Council approve the resolution as presented. Recommended Motion: "I move to approve Resolution #09-2013." The COLA increase this year was initially estimated at 2%, based on the Consumer Price Index for last year and was reduced to 1 % to reduce the overall City Budget. The 9% increase in the City's health care premium necessitated this. The wages proposed in this Ordinance reflect the 1 % COLA increase. Options: Council can approve, table, or deny the proposed ordinance. Staff Recommendation: Staff recommends approving the proposed ordinance. Attachment(s): proposed ordinance #2013-06 Page 16 of 67 ORDINANCE NO.2013-06 AN ORDINANCE AMENDING THE CITY OF MOAB CLASSIFIED HOURLY PAY RATE SCHEDULE AND EXEMPT AND ELECTED OFFICIALS SALARY WHEREAS, the Moab City Personnel Policies and Procedures Manual allows that pay ranges may be adjusted periodically to accommodate increases in the cost of living; and WHEREAS, the Moab City Personnel, Policies and Procedures Manual calls for using standard state and national measures to determine cost of living adjustments; and WHEREAS, the Utah Bureau of Labor Statistics showed that the Cost of Living Increase for the State of Utah from 2011-2012 was greater than 1 %; and WHEREAS, the 2013/2014 Fiscal Year Budget Shows a 1 % Cost of Living Increase for all employees covered by the Pay Rate Schedule; and WHEREAS, the proposed "City of Moab Classified Hourly Pay Rate Schedule" is attached to this resolution as Attachment A, respectively; and WHEREAS, Moab Municipal Code Section 2.44.010 states that all salaries of the elective and appointive officers of the City and the other employees of the City shall be fixed by motion or resolution of the City Council as in accordance with existing law. ' / AGENDA SUMMARY MOAB CITY COUNCIL MEETING June 25, 2013 / Agenda Item #: 5-g Title: Approval of a Dedication of Improvements Agreement with the Cottonwoods Homeowners' Association Fiscal Impact: There will be costs associated with taking over the system covered by the dedication agreement, as discussed below. There will also be ongoing annual maintenance costs. These costs could range from zero to several hundred dollars, depending on the maintenance issues encountered. However, these additional costs are far lower than constructing a separate sewer line to serve the area, which is the cost that the city budgeted for in the current Lyear. The City will save approximately $200,000 to $300,000 by taking over this system instead of constructing a new sewer main. There have been two recent development proposals for which the existing sewer system would have been insufficiently sized. One of the developments is the Willows affordable housing project. The City considered a long-term solution of constructing a new sewer main that would not only serve the new developments, but would provide for future growth in the area, should it occur. Upon examination of the costs of building such a system, and the logistical problems and time associated with getting necessary easements and designing the sewer main, staff began to look at other options. After obtaining support from the Cottonwoods Homeowners' Association to analyze the issue, the City enlisted the consulting expertise of Forsgren Engineering to look at the suitability of connecting the new developments to the lift station and sewer line installed as part of the Cottonwoods at Williams Way development. The capacity of the system, expandability, maintenance requirements, and other factors were considered. It was determined that with some upgrades, the sewer main and lift station could service the new developments as well as the Cottonwoods development. The consultants estimate that connecting to the Cottonwood System, along with the necessary upgrades, will cost approximately $20,000 to $50,000. Since the budget for the Williams Way Sewer Line was originally estimated at around $250,000, this option represented a considerable savings to the City. So, the City approached the Homeowners' Association and negotiated an agreement providing for the City 1 Page 51 of 67 to take over maintenance and ownership. The Homeowners' Association has approved the agreement. If the City Council approves the agreement, city staff will proceed with working with the Association to finalize all necessary easements. Attachment(s): Dedication Agreement Page 52 of 67 Main Sewer Line and Sewer Lift Station and Appurtenances Dedication of Improvements at The Cottonwoods at Williams Way This Dedication of Improvements is made and entered into this day of , 2013, by and between The Cottonwoods at Williams Way Homeowners' Association ("Grantor") and the City of Moab, a Utah municipal corporation ("Grantee.") RECITALS WHEREAS, Grantor constructed a sewer line ("Williams Way Main Sewer Line") and a sewer lift station ("Williams Way Sewer Lift Station") with all appurtenances in 2004, as part of The Cottonwoods at Williams Way development project; and WHEREAS, the Williams Way Main Sewer Line and Sewer Lift Station were installed to meet the sewer needs of the units in the Cottonwoods at Williams Way development; and WHEREAS, Grantor owned and operated said lift station and sewer system from 2004 until the date of this agreement; and WHEREAS, Grantor has performed preventive and emergency maintenance on the lift station and sewer line since 2004 and apportioned the cost thereof to the members of The Cottonwoods at Williams Way Homeowner's Association; and WHEREAS, Grantee has identified the area to the south and east of the Williams Way Sewer Lift Station that will be developed in the future, which area is not currently served by the City of Moab sewer system, and which cannot drain by gravity to the existing sewer system; and WHEREAS, Grantee has determined through engineering studies that it is feasible for future development to the south and east of the Williams Way Sewer Lift Station to be served by the Williams Way Sewer Lift Station; and WHEREAS, Grantee has determined that minor improvements should be made to the Williams Way Sewer Lift Station in order to limit future maintenance and other problems with the system, and to accommodate future connections to the system. In recognition of the foregoing, the parties agree as follows: Page 53 of 67 AGREEMENT Dedication of the Williams Way Main Sewer Line and Williams Way Sewer Lift Station and Appurtenances 1. Contingent upon execution of all necessary easements from property owners in The Cottonwoods at Williams Way Homeowners' Association, Grantor does hereby dedicate to Grantee all of Grantor's rights, title and interest in the Williams Way Sewer Lift Station and Williams Way Main Sewer line including the following appurtenances: a. Lift station (packaged unit; manufacturer: Barnes), fiberglass wetwell tank, two submersible grinder pumps, check and isolation valves, piping, slide rail system and float switches b. Overflow tank c. Control panel mounted on adjacent building d. Emergency generator system e. Main sewer line that runs along Williams Way; no service laterals are included in this dedication 2. Grantee acknowledges and agrees that Grantee has conducted all necessary tests and inspections of the above items and is satisfied with and knowledgeable about the condition of said items. 3. Immediately after execution of this dedication and all necessary easements, Grantee shall take over all operation and maintenance of the Williams Way Sewer Lift Station and Williams Way Main Sewer Line. Maintenance shall include all normal maintenance provided to similar improvements and equipment in the existing City of Moab Sewer System. The lift station will be maintained according to the manufacturer guidelines and standard practices for similar systems. This will amount to approximately $29,000 in additional revenue into the Water and Sewer Enterprise Fund Staff Presenter(s): Donna Metzler Department: Administration/Water and Sewer Enterprise Applicant: Not applicable Background/Summary: The City of Moab has not increased sewer rates since 1995. The City is currently planning for an upgrade to its wastewater treatment plant, which will require the City to obtain a state loan. In order to have the funds to make an annual payment on a state loan, and to qualify for such a loan, the City's sewer rate must be within a range of affordability. That is, if the rate is too low, the state considers the local contribution to the cost of the project to be insufficient. The City of Moab currently has one of the lowest sewer rates in the state. Keeping this rate low was a conscious decision by the City Council; the City Council actually lowered sewer rates in 1999 by about 20% to the current levels. We now need to incrementally raise these rates to pay for the needed upgrades and to qualify for state funding in the form of a loan. Options: The City Council may approve, approve with conditions, postpone, or vote not to approve the resolution.
