HomeMy Public PortalAboutOrdinance 68-271ORDINANCE NO. 68 -271 AN ORDINANCE OF THE CITY OF TEMPLE CITY ENACT- ING AN INTERIM ZONING ORDINANCE PURSUANT'TO PROVISIONS OF SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE RELATING TO A ZONING CLASSIFI- CATION FOR EXTRACTION OF NATURAL RESOURCES THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. The City Council does hereby find and determine that the zoning ordinance of this City does not presently provide for a classification relating to the extraction of natural resources, except Section 9202 (33) as to quarries; that it is appropriate to classify natural resources as a permitted or conditional use in appropriate zones; that the Planning Department has undertaken in good faith studies to determine the appropriate zone classification and locational criteria for uses relating to natural resources in order to prescribe necessary conditions to safeguard against the devaluation of neighboring properties and protection against un- warranted noise, dust and confusion. SECTION 2. The City Council further finds that the recommenda- tions of the Planning Commission on such matters should be forthcoming within the next few months, and that to permit initiation of quarry uses or extraction of oil, gas or minerals prior to the consummation of such studies would in large measure emasculate the benefits to be derived from such study, and would be contrary to the best interests and general welfare of the residents of this City. SECTION 3. Pending completion of such studies and the recommenda- tions of the Planning Commission with respect thereto, and pursuant to the provisions of Section 65858 of the Government Code, Section 9202 (33) of the Temple City Municipal Code is hereby amended to read as follows: Sec. 9202 (33). Natural Resources: Including surface and sub - surface excavation, extraction, drilling, slant drilling, production, processing, coring, testing, and removal of oil, gas, minerals, rock, dirt or other products. SECTION 4. Any and all provisions of the Temple City Municipal Code relating to natural resources and zone classifications therefor, inconsistent with the provisions of Section 3, are hereby suspended for the term of this Ordinance. SECTION 5. This Ordinance shall remain in effect for a period of 90 days, and the Planning Director of this City is directed not to issue any use permit inconsistent with the provisions hereof during the term hereof. SECTION 6. This Ordinance shall become immediately effective pursuant to. Section 65858 of the Government Code and for the reasons above stated, and is adopted pursuant to the authority of Anderson v. Pleasant Hills, 229 CA 2d 79; Metro Realty v. Co. of El Dorado, 222 CA 2d 508; Hunter v. Adams, 180 CA 2d 511; 44 AG Ops 14; Slater v. Los Angeles, 238 CA 2d 864; and West Coast Adv. v. San Francisco, 256 ACA 454. SECTION 7. The City Clerk of the City of Temple City shall certify to the passage and adoption of this Ordinance and to its approv- al by the Mayor and shall cause the same to be published in the Temple City Times, a newspaper of general circulation, printed, published and circulated in the City of Temple City. 1 Ordinance No. 68 -271 Page 2 PASSED, APPROVED AND ADOPTED this 18th day of June, 1968.
