Check our website for updates at: www.moabcity.org Page 8 of 67 MOAB CITY COUNCIL REGULAR MEETING May 14, 2013 The Moab City Council held its Regular Meeting on the above date in the Council Chambers at the Moab City Center, located at 217 East Center Street, Moab, Utah. Mayor David L. Sakrison called the Pre -Council Workshop to order at 6:30 PM. In attendance were Councilmembers Jeffrey Davis, Kirstin Peterson, Kyle Bailey, Doug McElhaney and Gregg Stucki; Planning Director Jeff Reinhart, City Engineer Rebecca Andrus, City Treasurer Jennie Ross, Community Development Director David Olsen, Public Works Director Jeff Foster, Police Chief Mike Navarre, City Manager Donna Metzler and City Recorder/Assistant City Manager Rachel Stenta. Mayor Sakrison called the Regular City Council Meeting to order at 7:00 PM and led the pledge of allegiance. Nineteen (19) members of the audience and media were present. Councilmember Peterson moved to approve the Special Meeting Minutes of February 7 & 8, April 16, April 30 and May 7, 2013 and the Regular Meeting Minutes of March 12 and 26, 2013 as corrected. Councilmember McElhaney seconded the motion. The motion carried 5-0 aye. Under Citizens to Be Heard, Joe Kingsley gave a report on behalf of the Moab Rotary Club and an overview of Rotary Projects including the April Action Car Show. Under Community Development Department Update, Community Development Director Olsen stated that he had been working on the Millcreek Revival and that the City had earned Silver Level Bicycle Friendly Community Status. Under Engineering Department Update, City Engineer Andrus stated that she had been working on an intensive grant and answering questions regarding UDOT's upcoming project. Under Planning Department Update, Planning Director Reinhart gave an overview of the next Planning Commission Agenda. Under Police Department Update, Police Chief Navarre gave an overview of the Fallen Peace Officer Trail Dedication. Under Public Works Department Update, Public Works Director Foster stated that the Rotary Park project was proceeding and that the Questar project was underway and had caused some disruption for some people but that the City was gaining a lot of water and sewer GIS information from the project. Councilmember Peterson inquired about the cross walk on 400 East and 200 South. Public Works Director Foster stated that he would look into the matter and finalize where striping should be for a crosswalk. The Mayor presented Eli Boaro with the Mayor's Student Citizenship of the Month Award for April 2013. Planning Director Reinhart gave an overview of the application. Joe Kingsley stated that he was a realtor representing the sale of the property and that the neighbors had approached him and expressed that the property would go back to being a nice bed and breakfast. Mayor Sakrison closed the public hearing at 7:35 PM. Councilmember Bailey moved to approve Proposed Resolution #06-2013 — A Resolution by the Moab City Council to Adopt the City of Moab Tentative Budget for Fiscal Year 2013-2014 and Setting a Public Hearing for Review of the Final Budget on May 28, 2013 at 7:15 PM. Councilmember Davis seconded the motion. The motion carried 5-0 aye. Councilmember Stucki moved to approve an Application for the Special Use of Swanny City Park by Theresa King, d.b.a. Moab Arts Festival on May 27 to 26, 2013 with the conditions listed in the staff recommendation. Councilmember McElhaney seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve a Special Business Event License for Moab Arts Festival to Conduct an Arts Festival on May 24 and 26, 2013 with the conditions listed in the staff recommendation. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Davis moved to approve a Request by Tanya Relitz (Delta Chi) for an Amplified Music Event at Old City Park on May 24, 2013. Councilmember McElhaney seconded the motion. The motion carried 5-0. Councilmember Stucki moved to approve a Request by LJ Kennedy for an Amplified Music Event at Old City Park on May 31, 2013 with all music ending by 9:00 PM. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve a Moved -on Structure Permit for Kim Kirks, d.b.a. CK Desert Ice LLC, Located at 391 South Main Street from May 15 to September 30, 2013. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve the Utah Access Program (MAP-21) Grant Application for the Lions Park Scenic Byways Trail Hub (Phase II). Councilmember Peterson seconded the motion. Under Mayor and Council Reports, Councilmember Stucki stated that he had attended a Solid Waste District Meeting and that the recycling center had located a contractor in Salt Lake City to accept glass. Councilmember McElhaney stated that the Housing Authority had hired Bob Muir as their new director. Councilmember Peterson stated that she had attended a Health Care District Meeting and had received a presentation from an Assisted Living Facility. Councilmember Davis moved to approve the bills against the City of Moab in the amount of $844,114.75. Councilmember Peterson seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Stucki moved to approve Proposed Resolution #08-2013 — A Resolution Adopting the Fiscal Year 2013-2014 Annual Budget. Councilmember Peterson seconded the motion. Councilmember Davis moved to approve a Moved -on Structure Permit for Moab First Assembly Church to Conduct a Fireworks Stand Located at 500 South Main Street from July 1 -4, 2013 with the condition that city provided fire restriction information be handed out to the public at the structure. You will recall that this is a CDBG-funded project that will provide 10 apartments for individuals with very low incomes, who are disabled by severe and persistent mental illness. You will attached find a project description, along with a letter and other application materials for this request. Moab City Code allows for affordable housing projects to make requests for impact fee waivers, as follows: The city may elect to waive impact fees, in whole or in part, for development activities with broad based charitable and public purposes, including the construction of affordable and low income housing by nonprofit and for -profit entities, as follows: 1. Application must be made in writing to the city council prior to connection to city services and shall provide the following: a. A description of the project and its purpose, together with the applicant's nonprofit tax identification number (if applicable), and a statement of the reasons why waiver of fees is appropriate and in the public interest; b. For affordable housing projects, proof that the project will meet affordable housing cost criteria, as established from time to time by city housing studies; and c. The fee amount requested to be waived and such other relevant information as may be requested by the council. 2. The council shall hear the application and rule upon the requested fee waiver. It may grant the waiver, in whole or in part, provided that the requirements of subsection D of this section are met and provided that there is available another source of public funds to account for the deficiency in the impact fund account as a result of the waiver. This number represents $28,190 for sewer impact fees and $5,528 for water impact fees. FCCBH intends to build a multi -family apartment complex (2-2 bedroom units and 8 - 1 bedroom apartments) housing facility adjacent to and on the site of the Willows, a permanent supported housing complex for homeless/at risk of homeless individuals. The initial funding request to build the facility totaled $538,100 all of which has been awarded through grants or low interest loans. However, the contractor bids came in at considerably more than expected. Even selecting the low bid still left us with a significant shortfall. We have been working on several creative strategies in order to come to a workable number. One such strategy includes obtaining impact fee waivers for water and sewer. Four Corners LC built the Ridgeview Apartments, a 6 apartment complex that opened October 1, 1994. There are 4 one bedroom and 2 two bedroom units. Interact has managed these apartments for the last 15 years. During that time there have been virtually no vacancies. Interact has also managed the Willows Permanent Supported Housing since 2003. The proposed one and two bedroom apartments will serve individuals with very low income (below the LIHTC 50% level) who are disabled by severe and persistent mental illness. Some also have dual diagnoses including chronic substance abuse or chronic physical illness. These disabilities can lead to long-term or episodic homelessness as those affected cycle repeatedly through the streets, shelters, housing, jails or hospitals. These apartments will be targeted for adults who have little to no other housing options. Four Corners will provide intensive case management services, outreach, independent living skills, health related services, and encourage a substance -free home environment to ensure a more stable and productive life. In addition, Four Corners will subsidize rents for the apartments so that they will be 30% of the tenant's income up to the LIHTC fair market rent. The outcome will be 6 permanent and 6 transitional housing beds for low income disabled persons. A large majority of our chronically homeless population, unable to work consistently, receives Disability and/or Supplemental Security Income. Those not receiving disability typically live on General Assistance, less than half of disability income. Most these individuals fall into the extremely low-income category, below 30 percent of median income. Persons with mental illness are often eliminated from consideration for subsidized housing due to poor credit, poor rental history, and/or a criminal history related to their mental illnesses. This is a significant gap in housing services. Residents will come from Grand, Carbon and Emery Counties. They may be living on the streets, in doubled up or substandard housing, or in temporary housing situations. There is no transitional facility in the area that meets the needs of this category individual. Four Corners does operate 2 permanent housing projects currently: the Willows in Moab, an 8 bed facility and The Friendship Center in Price a 10 unit facility. The closest transitional housing facility is 120 miles in Grand Junction, Colorado. Affordable housing is a scarce commodity in our community. Ten new housing units (12 beds) will help bridge the gap for this very needy population. This is the only non-residential property on the south side of 100 North that is zoned R-3. The USDA Forest Service yard and storage facilities are located on this property as well as the District Ranger's headquarters. C-2 zoning will provide a buffer or transition from the central business core of C- 3 and allows a variety of uses including multi -family housing. Also, the move will address the setbacks for the newly constructed Robber's Roost nightly rental development. The structure is 9 feet from the finished wall to the property line. The code requirement is 10 feet in the C-3 from residential zones with landscaping provided. There is an area of the wall that juts into the setback further that reaches within 4'7" of the property line. This area is about 9 feet in length and is located roughly in the center of the structure. This projection serves as a utility chase for gas and electric to all of the units. After this rectangular extension of the structure, the wall of the main living area of the building returns to be in line with the northwest portion of the building. The adjacent properties are commercially zoned with C-3 to the south and west and C-2 to the east. Some of the surrounding uses consist of nightly rentals at Robber's Roost, a surveyor's office, the post office, a retail store, and a hair salon. The Planning Commission held a public hearing on July 27, 2013 to review the amendment to the zoning map. In a 3-0 vote, the commission voted to recommend that Council approve the change. The narrative below addresses the review criteria in MMC Section 17.04.050. No one was in attendance to speak against or for the map amendment. The supporting letter from Mr. Keogh is included as an attachment to this memo. Specific criteria for zoning changes are found in the language of Code Chapter 17.04.040, Zoning Map Amendments. The criteria must be applied by the Planning Commission and Council in deciding requests for zone changes. In Chapter 17.04.050, Map Amendment Policy Declaration, the Code includes three elements to be used in the review of zone change applications. Zoning map amendments shall be approved if it is established that one or more of the following standards apply to the subject real property: 1. Was the existing zone for the property adopted in error? The R-3 Zoning applied to this property is something of a mystery. The historic and existing use on the property is not residential, and the applied zoning does not serve as a transition from the commercial uses of the C-3 to the R-3 residential uses. This lone peninsula of R-3 is nearly surrounded by commercial zoning with C-3 on the south and west and C-2 on the east. This situation in other places in the community has been the cause of ongoing complaints about commercial uses from adjacent residences. 3 2. Has there been a change of character in the area including, but not limited to: the installation of public facilities or new utilities; other approved zone changes; new growth trends; deterioration of existing development; or the need for development transitions? With the construction of Robber's Roost, the trend is continually more toward commercial development on the surrounding commercially zoned properties. With the ongoing interest to maintain residential uses in this area some transitional buffering between the comm. and residential zones should be provided. 3. Is there a need for the proposed zoning within the area or community? A specific need for the change is difficult to establish. However, it is not logical to have this small "tab" of R-3 sticking in between 2 commercial zones. 4. Is the proposed zoning classification compatible with the surrounding area or uses; will there be adverse impacts; and/or can any adverse impacts be mitigated? The proposed zone classification is compatible with the surrounding zones as well as the new development to the south and existing uses on adjacent properties. 5. Will benefits be derived by the community or area by granting the proposed zoning? Page 54 of 67 Council Memo PL-13-070 Zoning Amendment of Forest Service Property R-3 to C-2 July 23, 2013 The benefits of the zone change are that a more consistent zoning pattern will emerge with the change. A transitional buffer between the C-3 and the R-3 will be extended and the uses on adjacent properties will be similar. 4 6. Are adequate facilities available to serve development for the type and scope of development suggested by the proposed zoning classification? If utilities are not available, can they be reasonably extended? Adequate facilities already exist on the property for the existing use as well as future uses. 7. Does the application conform with the provisions of the Moab General Plan, the Land Use Code, and applicable agreements with affected governmental entities? The rezoning request satisfies the applicable standards of the General Plan, as noted above, and the C-2 is an adjacent zone. Decisions to rezone must be based on the General Plan as well as the Land Use Code. The Plan states, "All ordinance changes, rezoning, or improvement programs should be in conformance with the expressed policies and maps of the General Plan." It also goes on to say "...that all new zone changes [must] conform with the General Plan" and that they be done in a manner "necessary to protect the health, safety, and welfare of the community and work to preserve the natural environment and character of a small-town community." A rezone of this property is logical when viewing the types of commercial uses on the surrounding properties. As noted above, the zoning map amendment would create a chain of C-2 transition to acts as a buffer between the R-3 and the C-3. This conforms to one of the General Plan vision elements to "Separate and buffer conflicting land uses, especially where commercial abuts residential". The mixed use C-2 zone is a natural zone for this application. Unfortunately I won't be able to attend that hearing but please accept the following as my public comment for same. A quick glance at the zoning map demonstrates that this property is a reasonable and probably many years late candidate for rezoning to commercial. Staff has recommended a change to C2 but I believe it would be much more consistent to change this parcel to C3. Reviewing the map you see that the subject property is common with existing C3 on both the west and south boundaries. In fact the other 75% of this block is C3. This still leaves plenty of C2 zoning (courthouse, city hall and library to name a few) to the east to act as the buffer between core commercial and the residential properties. You have been provided the criteria and justification for approving this zone change but left out of that rationale was the real reason for the zone change. In fact, it's a housekeeping effort that is being addressed, coincidently, just before certificate of occupancy is granted next door. The nicely done and soon to be completed Robbers Roost was approved with a 4 ft. rear setback where city code requires it to have a 10 ft. rear setback (17.09.400). This item in addition to at least five other code violations, are part of the City approved site plan. Granting the zone change cures the setback issue created by this city planning error. In summary, though I support the zone change to commercial, I have concerns about zone changes occurring just to fix city originated zoning violations on adjacent properties. Reactive or fix -it zoning falls far short of the target. I have doubts of the city championing an application like this from the private sector. It sets dangerous precedent and certainly violates the intent of Section 17.04, zoning amendments. Sincerely, Timothy M. This will amount to approximately $8,600 in additional annual revenue into the Water and Sewer Enterprise Fund. The City charges a monthly fee to the Agency, based on the number and type of sewer connections within the Agency boundary, to cover costs associated with providing this service. The City of Moab has not increased sewer rates since 1995. The City is currently planning for an upgrade to its wastewater treatment plant, which will require the City to obtain a state loan. The City recently raised its residential and commercial rates in order to augment the revenues needed to pay for the upgrade costs. We now need to increase the fees charged to Grand Water in order to make sure all of our system revenues are consistent. Grand Water has already been notified of this change and has agreed to implement the increase once it has been approved by the City Council. The rate structure would go into effect on September 1. This resolution does not appear to have been established by resolution in the past, but it is appropriate to do so now. Options: The City Council may approve, approve with conditions, postpone, or vote not to approve the resolution. Attachment(s): Resolution #12-2013 Page 65 of 67 RESOLUTION # 12-2013 A RESOLUTION ADOPTING CHANGES IN THE CITY OF MOAB SEWER RATE STRUCTURE WHEREAS, the City of Moab has an agreement with Spanish Valley Water and Sewer Improvement District (District) that provides for the treatment of sewage at the City - owned Wastewater Treatment Plan for all Spanish Valley Water and Sewer Improvement District customers; and WHEREAS, said agreement provides that the City will charge the District on a per- connection/hook-up basis for sewer customers within the District, to pay for costs associated with the treatment of sewage received from District customers; and WHEREAS, the Grand Water and Sewer Service Agency was created in 1998, and assumed the administrative and other responsibilities of the District; and WHEREAS, the City, in communication and cooperation with the Agency, has been planning for upgrades to the existing Wastewater Treatment Plant; and WHEREAS, in order to pay for the costs associated with upgrading the Wastewater Treatment Plant, the City will need to increase sewer rates for all sewer users; and WHEREAS, the City of Moab recently increased its residential and commercial sewer rates for all City of Moab sewer customers; and WHEREAS, rates charged to the Grand Water and Sewer Service Agency for connections to the sewer system should be increased accordingly. NOW, THEREFORE BE IT RESOLVED that the Moab City Council adopts following rate structure for sewer connections for customers within the Grand Water and Sewer Service Agency, effective September 1, 2013.
