HomeMy Public PortalAbout003-1997 - Stricken - Vacation - Alley from N "G" - "H" at 10th StIC I C 7 ORDINANCE 3-1997 A SPECIAL ORDINANCE VACATING THE ALLEY EXTENDING FROM NORTH LOTH STREET 221.6 FEET TO THE WEST LINE OF LOT 419 SARAH SANDER'S ADDITION IN THE RECTANGULAR BLOCK BOUNDED BY NORTH G STREET AND NORTH H STREET. Whereas Matt L. Nepote and Steven Porter have petitioned Common Council of Richmond, Indiana, requesting the vacation of the alley commencing from North loth Street on the east then running 221.6 feet west to the west line of Lot #41, Sarah Sander's Addition in the rectangular block bounded on the south by North G Street and on the north by North H Street, the same being Vacation Petition No. 1-1997, and Whereas none of the four owners of all land abutting the above described public wa have joined in said petition requesting vacation, and y Whereas the abutting land owners who did not join in said petition have been notifi by the City Clerk as required by statute, and ed Whereas said Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition February 3, 1997, after publishing legal notice thereof at least 10 days in advance of said hear ng as required by statute, Whereas the Richmond Advisory Plan Commission, pursuant to Richmond Co de after publishing legal notice thereof at least 155.04(b), conducted a public hearing on said petition January 28,id 1997, hearings as required by ordinance, and 10 days in advance of said Whereas it is desirable to vacate said public way, NOW, THEREFORE, be it ordained by the Common Council of the Cityof Richmond, Indiana, that subject to the preservation of easements for existing utilities, the u described below is hereby vacated and the abutting chmond, ownership of the land heretofore dedicated as a public way as indicated below, property public owners shall acquire : way w, to wit: the alley commencing from North 10th Street on the east, then running 221.6 feet west to the west line of Lot #41, Sarah Sander's Addition in the rectangular block bounded on the south by North G Street and on the north by North H Street, which alley is more particularly described on Exhibit A attached hereto, with Bernard L. Shipp acquiring a strip equal to one-half of the width of said vacated alley abutting the south side of Auditor's Map Nos. 46-32-240-301.000-29 and 46- 32-240-302.000-29; and John W. Whalen, Jr. acquiring a strip equal to one-half the width of said vacated alley abutting the north side of Auditor's Map No. 46-32- 430-319.000-29 and 46-32-240-321.010-29; and Jack Edelman acquiring a strip equal to one-half the width of said vacated alley abutting the north side of Auditor's Map No. 46-32-430-322.000-29; and the State of Indiana acquiring a stripequal to one-half the width of said vacated alley abutting the north side of Auditor's a No. 46-32-430-323.005-29.
