Options: Depends on CDBG funding requests. Grand County is also applying for CDBG funds to improve Courthouse or County ADA facilities. Staff Recommendation: Apply for CDBG funds for HASU to replace many Virginian Apartment HVAC units and to re -roof several apartments. Recommended Motion: Approve the HASU request as presented in their attached letter. Other: To be included with the minutes: Mayor Sakrison opened a public hearing on Solicitation of Potential Projects for Community Development Block Grant (CDBG) Small Cities Program for Program Year 2014 at 7:_ PM. David Olsen, the Moab Community Development Director explained that the grant money must be spent on projects benefiting primarily low and moderate income persons. He further explained, the South Eastern Association of Local Governments in which Moab City is a member is expected to receive approximately $250,000 in this new program year. Moab City would potentially be competing with four other counties for that funding. All eligible activities that can be accomplished under this program are indentified in the CDBG Application Policies and Procedures Manual and interested persons can review it at any time. High priority projects include low to moderate income housing, food banks, water projects and sewer projects. No activity will displace low to moderate income individuals. Community Development Director David Olsen listed several CDBG grant Page 9 of 73 Agenda projects that the City has administered: Cinema Court infrastructure, reroofing and replacing HVAC units at the Virginian Apartments, replacing the existing 10" diameter water transmission line, Center Street Ballpark bleachers, fencing and lighting , installing the East Center Street median and sidewalks, building the Moonstone Gallery mini park, improving the Virginian Apartments, tuck pointing mortar and landscaping Star Hall, building Sun Court, developing the Mill Creek Flood Control and Parkway Project, buying property for the Seekhaven Family Crisis Shelter, providing financial assistance for the Grand County Housing Authority Affordable Housing Project, installing Rotary Park playground equipment and paths, installing the 400 East tree medians and paying for surveying and City digital mapping. The City provided copies of its project priority list. Parts of the project list, housing plan and general plan are included in the regional "Consolidated Plan." The list and plans show which projects the City has identified as being needed in the community. The Mayor asked that anyone with questions, comments or suggestion during the hearing please identify themselves by name before they speak. In connection with that goal, you are probably aware that each year we hold our annual fundraiser, Puttin' on the Ritz, to secure addition operational funds necessary to continue offering high quality support to local survivors. This year's event will take place on February 15, 2014 at the Grand Center. The new location makes it necessary to obtain the appropriate licensing permits to hold this event. Since the fees attached to these permits pose a significant obstacle to our ability to maximize fundraising efforts, I respectfully request that these fees be waived. I appreciate your support and your sensitivity to the issues we face. Please let me know if I can be of further assistance in providing any other information that will help in making this recommendation. Community Development Director David Olsen listed several CDBG grant Page 42 of 73 Agenda projects that the City has administered: Cinema Court infrastructure, reroofing and replacing HVAC units at the Virginian Apartments, replacing the existing 10" diameter water transmission line, Center Street Ballpark bleachers, fencing and lighting , installing the East Center Street median and sidewalks, building the Moonstone Gallery mini park, improving the Virginian Apartments, tuck pointing mortar and landscaping Star Hall, building Sun Court, developing the Mill Creek Flood Control and Parkway Project, buying property for the Seekhaven Family Crisis Shelter, providing financial assistance for the Grand County Housing Authority Affordable Housing Project, installing Rotary Park playground equipment and paths, installing the 400 East tree medians and paying for surveying and City digital mapping. Specifies those built improvements that are dedicated to the city for the development, 2. Certifies that the improvements have been completed to the city's satisfaction, 3. Certifies that all charges for labor, materials, and/or services have been paid in full, 4. Certifies that no liens have been attached against the property or the improvements, 5. Fiscal Impact: N/A Staff Presenter(s): Jeff Reinhart, City Planner Department: Planning and Zoning Applicant: Kajur Kulp, developer, Represented by Christina R. Sloan Summary: Staff has been working with the applicant Kajur Kulp, to remedy an issue of a sewer easement and abandoned line that runs through the property described above. The easement effectively bisects the lot so that any development would be hindered. 1 Public Works and Engineering Staff have been very involved in determining if the line is still active. A camera review of the pipe revealed a connection that proved to extend to 44 W. 200 N., the location of Frankie D's Bar and Grill. The sewer line does not follow the easement exactly and in some places is beyond the described parameters of the easement. Because AJB Holdings, LLC is owned by Anthony Basso and not the applicant, it was necessary for Mr. Kulp to obtain relinquishment of the easement and the existing sewer line from the property owner. A copy of the relinquishment is provided in your packet along with a legal description. The applicant is proposing to construct Park View Lodge, a ten -unit nightly lodging development on the site. While an application has been submitted, staff has not forwarded it to the Planning Commission for review because proposed structures are shown on the easement and sewer line alignment. The relinquishment of the easement and abandoned sewer line by the Council will allow the project to proceed with engineering of the project and other site considerations. Options: 1. Approve the relinquishment of the sanitary sewer easement and the abandoned line; Page 55 of 73 Agenda 2. Deny approval of the relinquishment; 3. Table the request if more information is required. Staff Recommendation: Staff recommends approval of the relinquishment of the abandoned sanitary sewer line and easements. These are not being used and the affected property owned by Mr. Basso has other means of attachment to the sanitary sewer system. Recommended Motion: I move to approve the request to relinquish the sewer easements and sewer line and direct the mayor to sign the Relinquishment of Sewer Easements and Sewer Line document. Attachment(s): o Signed copy of a letter from Anthony James Basso relinquishing all rights to the sewer easement and sewer line from his property o Window from state website indicating that Anthony James Basso is the registered and manager of the AJB Holdings, LLC; o Drawing based on the described easements and the alignment of the sewer line o Relinquishment of Sewer Easements and Sewer Line for the mayor's signature and recording by the applicant. p:\planning department\2013\correspondence \p1-13-102 cc 100 w sewer easement.docx Page 56 of 73 Agenda AJB HOLDINGS, LLC 6 E. IVIAIN STREET P.O. Box 111 PRICE, UTAH 84501 December 5, 2013 Jeff Reinhart Senior Planner City of Moab 125 E. Center Street Moab, Utah 84532 Re. Relinquishment of Rights in Sewer Line Dear Mr. Reinhart, AJB Holdings, LLC ("AJB Holdings") owns property known as 44 W. 200 N. (Parcel Nos. 01- 0001-0073 and 01-0001-0072) in Moab, Utah, on which Frankie D's Bar & Grill is located. The adjacent property owner to the west, Entrada Dogs, Inc., has submitted a development application affecting its Parcel Nos. 01-0001-0218 and 01-0001-0216. There is an old recorded sewer easement that crosses the adjacent property, in which a sewer line was apparently never built. This easement was recorded in Book 4-D at Page 362 in 1940 in the real property records of Grand County. There is also an old sewer line that crosses the adjacent property in a different location, for which there is no recorded easement. The approximate locations of the sewer line and sewer easement are shown on the attached map. The sewer line is not currently operational, and Frankie D's connects into the City sewer system in a different location. AJB Holdings is supportive of this property being developed. To this end, please accept this letter as AJB Holdings' consent to quit, vacate, and relinquish any rights it may have in the sewer line and easement described above. Accordingly, AJB Holdings acknowledges that it hereby waives and releases any claim it has to future use of the adjacent property known as Parcel Nos. 01-0001-0218 and 01-0001-0216 for sewer access or disposal. Further, AJB Holdings hereby releases the City of Moab from any liability for formally quitting, vacating, and relinquishing any rights the City may have in the sewer easements located on Parcel Nos. 01-0001-0218 and 01-0001-0216, via a recorded Relinquishment of Easements, or similar document, in the real property records of Grand County, Utah. AJB Holdings also acknowledges that it hereby waives and releases any claim it has, known or unknown, against the City of Moab regarding the future use of the adjacent property known as Parcel Nos. 01-0001- 0218 and 01-0001-0216 for sewer access or disposal.
