M. in the Council Room and was attended by Alex Meddin, Acting Mayor, who presided, Councilmen Peters, Hosti, Brown, Lovell, Strong, Town Attorney Solms, Supt. Reed, Lt. Durden, Mgr. Lang, Robert F. Powers and Judge D. S. Atkinson. Chairman Meddin notified Council of the death of Mayor Edward A. Dutton on Sunday, May 23, 195+, he mentioned the many accomplishments of Mayor Dutton during his tenure of of- fice. He then asked for nominations to fill the unexpired term of Mayor Dutton. Councilman Hosti nominated Councilman John L. Strong for Mayor to fill the unexpired term of Mayor Edward A. Dutton. Councilman Brown seconded and the motion passed unanimously. Council then recessed. Chairman Meddin called the meeting to order. Councilman Strong tendered his resignation as Council- man, which was accepted by the Board. Judge Atkinson administered the following oath: GEORGIA 'CHATHAM COUNTY I, JOHN L. STRONG, do solemnly swear that I will faithfully and honestly perform the duties of Mayor of the Town of Savannah Beach, Tybee Island, to the best of my skill and ability, without favor or affection, so help me God. STRONG, a citizen of the State of Georgia and of the United States and being Mayor of Savannah Beach, Tybee Island, Georgia, &nd'tl e'Treci iient7of public funds for serviees: rendered as such employee, do hereby solemnly swear and affirm that I will support the Constitution of the United States and the Constitution of the State of Georgia, and that I am not a member of the Communist Party and that I have no sympathy for the doctrines of Communism and will not lend my aid, my support, my advice, my counsel nor my influence to the Communist Party or to the teachings of Communism. /s/ John L. Atkinson Judge, Superior ourt, of Georgia Mayor Strong took the chair and expressed his thanks to the Board for the honor given him, he stated that he in- tended to conduct the affairs of the Town in a business like manner and would give the people good government with the help and support of the Board. Councilman Peters nominated Robert F. Powers as Council- man to succeed to the unexpired term of John L. Strong, resign - ed, Councilman Hosti seconded and the motion passed unamiously. C. of Georgia Mrs. Elise Furse protested against the charges made against her for water rent she contending that she was charged $50.00, gross, for 1954 water service and as she only had 14 fixtures the charge should have been $40.00, gross. Mr. Lang checked on this and stated that she was correct. It was moved, seconded and passed that Mrs. Furse be given a fefund of $9.00, net on her bill for 1954. Supt. Reed stated that the old C. R. R. road bed in the vicinity of Byers Street needs to be repaired, it was moved, seconded and passed that the street be repaired at a cost of not over $300.00. Mrs. Bascom Horton petitioned for a refund of $5.00, claiming that she had overpaid this amount on her last years water bill. Mr. Solms will check on this matter to determine whether she is entitled to a refund. It was moved, seconded and passed that bills for the month of May for General Government amounting to $4,572.OFD, for the Water Department, $1,451.43 and bills for the Groin and Seawall Account, $124.13, be paid. Councilman Hosti stated that the estimated cost of laying a water line for William W. Sprague and E. C. Bull would cost from $1580.00 to $1330.00. The Mayor will confer 29 with Councilman Hosti relative to this matter. Councilman Brown stated that there are some uncollected licenses. Mayor Strong stated that June 30th would be the dead- line for collecting the delinquent licenses. Town Attorney Soims called attention to the unsafe condi- tion of the building on the property of Mike Goldberg, stating that Mr. Goldberg had been notified previously to remove this hazard but nothing has been done to date, it was moved, seconded and passed that the Town Clerk forward a letter by registered mail to Mr. Goldberg, notifying him that if the building is not torn down and the area cleaned that the Town will do it and bill him for all posts. Mr. Soims called attention the pending contract.with the Dual Parking Meter Company regarding the purchase of twenty - five (25) additional parking meters, he stated that the Town wanted a guarantee for a full year of use of the meters, whereas Dual put it on a two calendar year basis, he stated that Mayor Dutton approved it on the two oalendar year basis, Mr. Solms stated that this was not the same contract as was the original contract with them and asked what should be done about this matter, should we order twenty -five (25) meters and try out under a six month trial period, that is, part of this season and all of next. Mr. Solms asked what was to be done as to the Duncan Park- ing Meter Company. A Committee consisting of the Mayor, Town At- torney Solms and Chief McCutchen were appointed to handle the matter. It was moved, seconded and passed that Alva Jones be per- mitted to sell beer, seafood and rent boats at 61 Chatham Avenue. A petition from E. C. Bobo was read pertaining to putting up an information booth on the attomobile road across from Hodges Grocery Store and also to put up several signs at different loca- tions, there was some protest against the booth, it was moved, seconded and passed that the signs be permitted but that the re- quest to put up the booth be denied. It was moved, seconded and passed that the Harley- Davidson Motorcycle, used by the Police Department be sold for $300.00. Mr. Harry G. Butler requested the Town to repair the holes in the wooden bulk head in front of his property on Venetian Ter- race, contending that they are dangerous and especially so for children, he requested permission to do the work at his own ex- pense if the Town could not do it. It was moved, seconded and passed that as the Town could not undertake the work at this time that Mr. Butler be authorized to have it done. 30 Mr. A. Finocchiaro reported that the storm sewer that runs along 12th Street in front of his property, some parts of it has caved in and should be repaired at once. Referred to Councilman Hosti. The minutes of the meeting held on May 12th were read and adopted. It was moved, seconded and passed that the E and W Laundry' be refunded $4o.00, the difference in the Cost of a 10 meter that sold for $90.00 and the 5/8" meter, which was installed at their request and which sold for $50.00, they having paid $90.00. Mayor Strong stated that he intended serving the remaind- er of the month of June and also up to July 4th without compen- sation, he would have his salary as Mayor started as of July 5, 1954. It was moved, seconded and passed that the request of the Mayor be granted. 1 30 -A It was moved, seconded and passed that the following Resolution be adopted, A RESOLUTION WHEREAS, the Honorable Edward A. Dutton, Mayor of Savannah Beach, Tybee Island, Georgia departed this life•on Sunday, May 23, 1954; and, WHEREAS, he was appointed Town Attorney of Savannah Beach, Tybee Island, Georgia on May 6, 1938, and to the additional duty and trust of Recorder of the Municipality on May 12, 1959, which offices he held and served faithfully until May 20, 1944, when he was elected by Council of Savannah Beach, Tybee Island, Georgia, to serve as Mayor for the unexpired term of the Honorable Rowland R. Jones, Upon election to the office of Mayor, he resigned as Town Attorney but continuously served from that day as Mayor and Recorder until his untimely death; and, WHEREAS, many outstanding and truly valuable accomplishments became a reality during his tenure of office, among which are the folowing: (a) The initiation of action on July 12, 1945, for a new"Public School of Savannah Beach, Tybee Island, Georgia, by the granting of five acres of land to the Board of Education of Savannah and Chatham County for the purpose of providing space upon which to erect a new school; and, although the fulfillment of this ideal has not yet been accomplished, it is now becoming a reality in that plans for said school have been drawn and approved by the architects and its erection passed upon by the Board of Education. (b) The lands formerly known as Fort Screven Reservation, located on the Northern -most part of Tybee Island were acquired on December 6, 1945, from the United States Government for the sum of $200,000.00. (c) On January 10, 1946, under the leadership of Edward A. Dutton, the Municipality deeded 5.8 acres of land to the 4 -H Club of Chatham County, Georgia for a Camp site. (d) Subsequently on January 29, 1946, the pro- perty known as Fort Screven Reservation was sold to the Fort Screven Development Company for the sum of $230,1,01. 00, which increased the size and area of the Municipality, as well as providing a handsome profit to the Town Trea- sury. (e) Thereafter on February 7, 1946, the install- ation of the Water Works of Fort Screven were sold to the Tybee Water Works, Inc. at a sum of $21,000.00. The elec- trical facilities, which were also reserved from the sale of the Fort Screven properties, were sold to the Savannah Electric and Power Company (f) On March 7, 1946, the Municipality deeded to the American Legion Post No. 154 of Savannah Beach, the property which is now occupied by the Post. (g) On January 9, 1947, the area bounded on the . North by Fourth Street, on the East by Butler Avenue, on the South ,by Fifth Street and on the West by Jones Avenue was dedicated a park and playground and given the name, "Memorial Park" in the honor of all those men and women of thw Town who served in defense of their dountry in the recent globial conflict, now known as World War II. (h) During the earlier months of 1947, the new Police and Aid Station was erectdd, at the Strand and Six- teenth street with a view to better law inforcement, to- gether with a greater protection and aid tb the gitikane and visitors of the beach. (i) During the year of 1947, the greatest under- taking in the history of this Island Community in street improvement and paving was made possible through the is- suance of paving; .bonds of approximately $90,,000.00 in value, which contributed to the growth and development of the Municipality. (j) On June 17, 1948, the Municipality acquired certain building later to be referred to as the shops and storage houses for the Public Works Department and in which were kept the increasing number of supplies, machines and vehicles owned by the Municipality. (k) In 1949, a concrete sea wall was erected from Tilton Avenue to First Street at a cost of approx- imately $20W0.00 and has served satisfactorily and well in the protection of the property and public streets in that vicinity. ,. (1) On February 24, 1950, an effort to eliminate the difficulty in the parking lots which always handi- capped and confined the Police Department to the two large parking areas and to facilitate the over- all park- ing plan, packing meters were installed to conform with the modern -day trend in this problem. (m) The greatest revenue source which this Muni - cipality had ever accomplished was by the pruchase of the Tybee Water Works System from the Tybee Water Works, Inc. on November 9, 1950. This was one of the largest under- takings by the Municipality in its History and required the issuance of $165,000.00 in revenue certificates re- quired in the purchase of this system and the further ex- tention thereof. WHEREAS, the passing of our departed Friend and Esteemed Mayor is an exemplification of those virtues--of friendship, charity and - -trust which shall always shine as a result of his acc- omplishments and significant work for mankind and the citizens of his Community. The practice of these virtues is that which makes life worth living. Through the observance of his achievements we will always remember and cherish his inppiration and leadership. WHEREAS, his characteristics, which were emphasized by his tenacity to fight against a wrong were only - equaled by his courage and fortitude to defend that which is right; and, WHEREAS, our beloved departed Mayor, who was ever inbued with the true American way of Life and inspired with the patriotism and fundamental principles of the forefathers of our Nation; and, WHEREAS, he was devoted to his duties and trust of his office which he faithfully and conscientously displayed towards his Comm- unity, Savannah Beach, Tybee Island, Georgia, its citizens and visitors. • NOW,, THE WORE BE IT RESOLVED by the Councimen of Savannah Beach, ' Tybee island, . Georgia that in the death of Mayor Edward A. Dutton, that the Councilmen, employees-of the Municipality, the citizens and friends of Savannah Beach, Tybee Island, have lost their most true, faithful, obedient and trustworthy friend and ser- vant and that the sympathy of'the Councilmen, employees, citizens and friends of Savannah Beach, Tybee Island, Georgia, be extended to his family in this their time of great sorrow and bereavement. BE IT FURTHER RESOLVED that a copy of this resolution be sent to the family of our beloved and departed Mayor. BE IT FURTHER RESOLVED that a copy of this resolution be spread upon the Minutes of this meeting. 1 30 -D It was moved, seconded and passed that the following Ordinance be adopted. AN ORDINANCE AN ORDINANCE TO PROVIDE FOR REGISTRATION WITH THE SOLICITOR GENERAL OF THE EASTERN JUDICIAL CIRCUIT OF GEORGIA BY TBE HOLDER OF ANY ALCOHOLIC OR MALT BEVERAGE LICENSE► AND EMPLOYEES OF SAID HOLDER; TO PROVIDE FOR NOTIFICATION TO SOLICITOR GENERAL WITHIN FIVE DAYS OF THE TERMINATION OF SERVICES OF SUCH EMPLOYEES; TO PROVIDE A PENALTY FOR TBE VIOLATION OF THIS ORDINANCE; AND FOR OTHER PURPOSES. BE IT ORDAINED -by the authority of the Mayor nd Council- men of Savannah Beach, Tybee Island, and it is hereby ordained by authority of the same as follows: Section 1. From and after the first day of August, 1954, it shall be-unlawful for any person or the holder of any whole- sale liquor,'beer, or wine 'license or the holder of any retail liquor, beer, or wine license to operate thereunder any place of business without-having a registration card signed'by the Solicitor General of the Eastern Judicial Circuit of Georgia. Section 2. From and after the first day of August, 1954, it shall be unlawful for the holder of any alcoholic or malt beverage license as aforesaid in Section 1 to permit himself or any other person or persons to work or to serve in or about his place of bus- iness unless said person has a registration card issued by the Soli - citor General of the Eastern Judicial Circuit of Georgia, setting forth therein the name of the employer and location of place of em- ployment. Section 3. It shall be unlawful for the holder of any al- coholio beverage license set forth in Section 1 to fail to notify the Solicitor General or his representatives within five days after the termination of the services of any of his or her employees working in any place where alcoholic or malt beverages are served. Section 4. That any person violating the provisions of this ordinance, upon conviction thereof, shall be subject to be fined not to exceed $100.00 and imprisoned not to exceed 30 days, either or both. Section 5. That all ordinances or parts of ordinances con= flicting with the provisions of this ordinance - - -are hereby repealed. 30 -E It was moved, seconded and passed that the follow- ing Resolution be adopted. A RESOLUTION WHEREAS, Judge and Mrs. Arthur W. Solomon have always been life long friends of the officials and citizens of Savannah Beach, Tybee Island, Georgia; and,- WHEREAS, Mrs. Arthur W. Solomon was fatally injured and died on June 4, 1954, as a result of a tragic automobile accident near Twin City, Georgia. NOW,THEREFORE, BE IT RESOLVED, by the Mayor and council- men of Savannah Beach, Tybee Island, Georgia, in council assem- bled, that in the death of Mrs. Arthur W. Solomon we' of, Savannah Beach, Tybee Island, Georgia have lost a very dear friend and the wife of one of our beloved ,dounty Commissioners; and, that the sympathy of the Mayor, Councilmen and citizens of Savannah Beach, Tybee Island, Georgia, be extended to the family of Mrs. Arthur W. Solomon; and, BE IT FURTHER RESOLVED that a copy of this resolution b e spread upon the minutes of Council-and a copy thereof sent' to the family of our departed friend. 30 -F 30 -F It was moved, seconded and passed that the follow - ing Ordinance be adopted. . AN ORDINANCE TO AMEND THE ORDINANCE PROVIDING FOR THE RATE OF LICENSES FOR DOING BUSINESS IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR ENDING APRIL 30, 1955: FIXING PENALTIES FOR THE VIOLATION: AND FOR OTHER PURPOSES. SECTION 1. Be it ordained by the Mayor and Council- men of the town of Savannah Beach, Tybee Island, Georgia, in council assembled, and it is hereby ordained by the authority of the same that the ordinance providing the licenses for doing business for the fiscal year ending April 30, 1955, be amended as follows: (a) Any person, firm or corporation doing a general building contracting business, not including electrical work or plumbing... (b) Any person, firm or corporation soliciting, selling, and deliverying beer to stores, stands, etc. wholesale only (c) Any person, firm or corporation operating a theatre for the purpose of showing movies, including the right to sell popcorn, soft drinks, and other items. $50.00 25.00 25.00 SECTION 2. That any person violating the provisions of . this ordinance, upon conviction thereof, shall be subjected to be fined not to exceed $100.00 and imprisoned not to exceed 30 days, either or both. SECTION 3. That all ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed.
