The City of Moab will hold a Special City Council Meeting on Thursday, December 19, 2013 at 9:30
AM. The purpose of this meeting will be:
1. Approval of a Class III Beer License for Tina Irvine, d.b.a. Maverik Inc, #341 Located at 985
South Highway 191
2. Approval of a Class III Beer License for Tina Irvine, d.b.a. Maverik Inc #238 Located at 435
North Main Street
The meeting will be held in the Administrative Conference Room at the Moab City Center at 217 East
Center Street, Moab, Utah.

Applicant: Tina Irvine, d.b.a Maverik Inc.
Background/Summary: Class III Beer Licenses entitle the licensee to sell Beer
on the premises licensed in the original containers, for consumption off premises.
A state of Utah license is not required for Class III licenses. The previous
licenses for Maverik #238 was approved on April 27, 1999 and for #341 on
March 9, 2004. The former license holder retired this last year which precipitated
the need for a new license. A preliminary background check was completed
successfully and a full background check is underway.
Options: Approve, deny or table.
Staff Recommendation: Staff recommends conditional approval of both
licenses pending the results of the full background investigation.
Recommended Motion: I move to approve a Class III Beer License for Tina
Irvine, d.b.a. Maverik Inc, #341 Located at 985 South Highway 191 and Maverik
Inc #238 Located at 435 North Main Street with the condition that a successful
background check be completed within 90 days.

Control Act and the Ordinances of the City.
Retail License shall entitle the Licensee to sell Beer in the original containers, on the premises

of the City, and shall be issued solely to Restaurants, Cafes and other establishments whose
primary purpose is the dispensing of food.
Same conditions as Class I and Class II Beer Licenses.

Submit completed application and attachments to the City Treasurer for processing.
The applicant represents that they possess all the qualifications of a licensee as set forth
in Section 32, Chapter 4 of the Utah Code Annotated 1953 and that they will faithfully
comply with and have faithfully complied with the Utah Liquor Control Act.
This application is submifted to the City of Moab as an inducement for the issuance of a
retailer's business beer license in accordance with Section 32, Chapter 4 of the Utah
Code Annotated 1953. The undersigned applicant hereby agrees and promises that if
such beer license is granted, the applicant will faithfully comply with all provisions of the
Utah Liquor Control Act and regulations of the Utah Liquor control Commission adopted
pursuant thereto, and the ordinances of the City of Moab, and in particular that they will
faithfully comply with Section 32, Chapter 6 of the Utah Code Annotated 1953 relating to
reporting and payment of excise tax, and with regulation 4 relating to advertising,
regulation 4-A relating to labeling and advertising, and regulation 5 relating to unfair

Re: Class III beer license
A Class III business license is submitted for Maverik Inc. # 238 and Maverik Inc. # 341 stores. Applicants
name is Tina Irvine for both stores. A preliminary background was conducted for this person, no
derogatory history is found for this person. A full background check is requested through the Bureau of
Criminal Investigation including fingerprint card by applicant. The outcome of this search will take
several weeks.
I recommend that these class III licenses be approved.
