HomeMy Public PortalAbout2019.003 (01-15-19) RESOLUTION NO. 2019.003 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE AWARD OF CONTRACT TO WATERWORKS TECHNOLOGY FOR THE INTERIM MANAGEMENT OF THE WATER AND SEWER OPERATIONS IN AN AMOUNT NOT TO EXCEED $400,904 PER YEAR FOR A ONE YEAR TERM SUBJECT TO A ONE-YEAR EXTENSION; AUTHORIZING THE CITY MANAGER TO APPROVE ADDITIONAL SERVICES OR EMERGENCY SERVICES NOT TO EXCEED 25 PERCENT OF THE CONTRACT PRICE; APPROVING AN AWARD OF CONTRACT TO SAFNA ENGINEERING & CONSULTING TO PROVIDE ON CALL ENGINEERING, PROJECT MANAGEMENT AND CONSTRUCTION MANAGEMENT SERVICES ON CAPITAL IMPROVEMENT PROJECTS RELATING TO THE WATER AND SEWER SYSTEM INFRASTRUCTURE FOR A COST NOT TO EXCEED $350,000 PER YEAR FOR A ONE YEAR TERM SUBJECT TO A ONE-YEAR EXTENSION; APPROVING WATERWORKS TECHNOLOGY TO WORK ON CAPITAL IMPROVEMENT PROJECTS ON AN CALL BASIS TO AVOID ONE CONSULTANT WORKING ON ALL PHASES OF A CAPITAL IMPROVEMENT PROJECT FOR A COST NOT TO EXCEED 25 PERCENT OF THE CONTRACT PRICE WITH WATERWORKS TECHNOLOGY, INC. AND AUTHORIZING THE APPROPRIATION OF $100,000 FROM THE WATER FUND AND $50,000 FROM THE SEWER FUND WHEREAS, all suppliers of domestic water to the public are subject to regulations adopted by the U.S. Environmental Protection Agency as well as under the California Safe Drinking Water Act; and WHEREAS, the City's Sewer System Management Plan calls for the City's sanitary sewer collection system facilities are properly operated, maintained and managed to reduce frequency and severity of sanitary sewer overflows (SSO) and their potential impacts on public health, safety, and on the environment; and WHEREAS, Section 64413.7 of the California Code of Regulations requires for each distribution system to designate at least one Chief Operator and one Shift Operator 22 CCR§ 64413.7; and WHEREAS, the Public Works Department lost two key positions, one the Utility Services Manager serving as the Chief Operator and the Lead Water Service Worker serving as Shift Operator, in Water and Sewer Divisions due to retirements; and WHEREAS, on December 20, 2016, the City Council approved a contract with Waterworks Technology to provide management services for water and sewer division with certified personnel that meets the State Water Resources Control Board Distribution System Staff Certification Requirements; and WHEREAS, on December 19, 2017, the City Council approved to amend the Agreement with Waterworks Technology, thereby extending the term of the agreement; and WHEREAS, on December 13, 2018 staff issued a Request for Proposal to request proposals from qualified firms to manage the City of Lynwood's water system and sanitary sewer collection system; to provide services to support the City's Capital Improvement Projects relating to the water and sewer system infrastructure in the area of construction management, project management, inspection, and design services; to oversee the cross connection program; and to provide certified water or sewer service workers in the event of emergency or if in- house staffing needs support; and WHEREAS, staff received proposals from Waterworks Technology, Inc. and SAFNA Engineering & Consulting; and WHEREAS, staff is proposing to scale back from the use of a single consultant to deliver all phases of project delivery to establish control and independent review; and WHEREAS, upon review of the proposals and interview of the firms, staff recommends to award a contract to Waterworks Technology but to also award a contract to SAFNA Engineering Consulting on Capital Improvement Projects on an on call basis to avoid the use of a single consultant to deliver all phases of project delivery. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. That the City Council authorizes the Mayor to approve a contract with Waterworks Technology attached hereto as Exhibit A in a form approved by the City Attorney to manage the City's water and sanitary sewer collection system, to oversee the cross connection program and to provide certified water or sewer service workers in the event of an emergency or if in- house staffing needs support in an amount not to exceed $400,904 per year subject to an extension by the City Manager month to month not to exceed one year and authorizing the City Manager to approve up to 25 percent for additional or emergency work. . Section 2. That the City Council authorizes Waterworks Technology to provide support on Capital Improvement Projects on an on call basis but shall not exceed 25 percent of the contract price per year. 2 Section 3. That the City Council authorizes the Mayor to approve a contract with SAFNA Engineering and Consulting attached hereto as Exhibit B in a form approved by the City Attorney to provide services on an on call basis to support the City's Capital Improvement Projects relating to the water and sewer system infrastructure in the area of construction management, project management, inspection, and design services in an amount not to exceed $350,000 per year subject to an extension by the City Manager month to month not to exceed one year and to authorize the City Manager to approve up to 25 percent of the contract price for additional services. Section 4. That the City Manager is authorized to approve task orders without having to go back to the City Council with Waterworks Technology, Inc. and SAFNA Engineering and Consulting as long as the compensation limit is not exceeded. Section 5. This resolution shall take effect immediately upon its adoption. Section 7.
