A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACCEPTING
THE STREET REHABILITATION AND WATER MAIN UPGRADE FOR BIRCH
STREET, FIR STREET, LUGO AVENUE, AND PLATT AVENUE (CIP NO. 4011.67.054)
AS COMPLETE; AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION
WITH THE LOS ANGELES COUNTY RECORDER'S OFFICE AND THE RELEASE OF
THE 5% RETENTION 35 DAYS AFTER THE RECORDATION; AND AUTHORIZING
THE REDUCTION IN THE PROJECT BUDGET AND A CHANGE IN BUDGET
ALLOCATION
WHEREAS, on May 15, 2018, the City awarded a contract to Sully-Miller
Contracting Company in the amount of $1,189,000 for the construction of the Street
Rehabilitation and Water Main Upgrade for Birch Street, Fir Street, Lugo Avenue, and
Platt Avenue Project No.4011.67.054 ("Project"); and
WHEREAS, the construction of the Project, which started on June 25, 2018, was
completed on November 20, 2018; and
WHEREAS, the Fiscal Year 19 ("FY19") approved Project budget was funded with
CDBG Fund ($389,000), Measure R Fund ($528,503), Water Fund ($952,200) and
Measure M Fund ($101,610); and
WHEREAS, the final construction cost of$1,639,460.14 includes eight (8) contract
change orders in the amount of$450,460.14 for additional work and for final reconciliation
of quantities; and
WHEREAS, water related improvements cost was far less than anticipated and
there was an expanded scope of the street improvement with the inclusion of Thorson
Avenue; and
WHEREAS, a modified funding allocation is needed to reflect the true cost of water
improvements and street improvements; and
WHEREAS, Public Works staff conducted the final inspection on November 28,
2018 and found that all work was completed in accordance with the Project plans and
specifications.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. That the City Council of the City of Lynwood accepts the Street
Rehabilitation and Water Main Upgrade for Birch Street, Fir Street, Lugo Avenue, and
Platt Avenue Project (CIP No.4011.67.054) as complete in accordance with contract
documents and authorizes the Director of Public Works or his designee to process the
recordation of the Notice of Completion.
Section 2. The City Council approves the following additional appropriation for
the Project:

Section 4. This resolution shall go into effect immediately upon its adoption.

NOTICE HEREBY IS GIVEN that the work required pursuant to an agreement dated
May 15, 2018 between the CITY OF LYNWOOD, a municipal corporation, whose address is
11330 Bullis Road, Lynwood, California, as Owner, and Sully-Miller Contracting Company
whose address is 135 S. State College Blvd. Suite 400, Brea, CA 92821 as Contractor, which is
described as follows:
Birch St.,Fir St., Platt Ave., and Lugo Ave.

All work was completed and accepted on December 18, 2018.
