ORDINANCE NO. 69 -285
AN ORDINANCE OF THE CITY OF TEMPLE CITY
ADDING SUBSECTIONS (3)A AND (3) B TO
SECTION 9275 OF THE TEMPLE CITY CODE
RELATING TO NONCONFORMING RESIDENTIAL
STRUCTURES.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN:
SECTION 1. New Subsections (3)A and (3) B, reading as fol lows, are
hereby added to Section 9275 of the Temple City Code:
(3)A. R-1 and R -2. Structural Changes.
(i) Whenever a second .dwelling .unit exists .on an
R -1 lot at least 7200 square feet in area, the
Planning Director shall determine that one of
the dwelling units is the principal residential
dwelling and such dwelling unit shall not there-
after be deemed nonconforming to the extent it
was constructed in conformity zoning regu-
lations in effect at time of construction. The
second dwelling shall be considered a secondary
use and shall be deemed nonconforming. Any per-
son dissatisfied with the Planning Director's
decision, may ask for a review by the Planning
Commission with respect thereto. The decision
of the Planning Commission may be appealed to
the City Council whose decision shall be final.
(ii) A nonconforming residential structure on an R -1
or R -2 lot shall be permitted to construct
accessory off- street parking structures (garages),
provided that the proposed addition otherwise
complies with existing zoning regulations applic-
able to R -1 and R -2 zones, and further provided
that no previous conversion has been made of an
existing garage into living quarters or into a
habitable portion of the residential dwelling unit,
unless such conversion was constructed with a per-
mit or subsequently brought up to code.
(3) B. R -3 and R -4 Additional Units
Single- family dwellings in Zones R -3 and R -4 shall
be permitted to construct additional dwelling units,
attached or detached, provided that the proposed addi-
tions otherwise comply with all the existing zoning
regulations applicable to the zone in which it is
located.
SECTION 2. The City Clerk of the City of Temple City shall certify
to the passage and adoption of this Ordinance and to its approval by the
Mayor and shall cause the same to be published in the Temple City Times,
a newspaper of general circulation, printed, published and circulated in
the City of Temple City.
