HomeMy Public PortalAbout01-24-2013THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, JANUARY 24, 2013 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 5:00 P.M., Thursday, January 24, 2013, in the Council Chambers at the Municipal Building, 50 North 5th Street, Richmond, Indiana. In attendance were Board Members Vicki Robinson, Dian Lawson and Tony Foster. Also attending were Assistant City Attorney Kim Vessels, Director of Public Works and Engineering, Electrical Inspector Tom Cannon, Building Inspector Bruce Osterling, Seth Hardin from Premier Maintenance Solutions, LLC, Ralph Bane from RP &L and Ron Moore. The following business was conducted: CALL TO ORDER Ms. Robinson called the meeting to order and noted for the minutes that all board members and legal counsel were present APPROVAL OF MINUTES Mr. Foster moved to approve the January 17, 2013 minutes with a second by Ms. Lawson. The motion was unanimously passed. CLAIMS FOR PAYMENT The claims for payment for January 24, 2013 are in the amount of $363,047.87. Included are as follows: • $48,351.43 =Harvest Land for gasoline • $86,926.09 = HLFB for payments for Guaranteed Energy Savings Program • $57,598.83 = Richmond Sanitary District for disposal fees for MGP Clean Up Ms. Lawson moved to approve with a second by Mr. Foster. The motion was unanimously passed. CONTRACTS A. Contract No. 15 -2013 a Lease Agreement with the Richmond City Employees Federal Credit Union was tabled until someone could present the contract to the board and give the Law Department time to correct some errors in the contract. Mr. Foster moved to table with a second by Ms. Lawson. The motion was unanimously passed. . Change Order No. 1 to INDOT Contract No. T- 34678, the Traffic Sign and Post Replacement Project is just for an extension of 30 days. This will move the completion date from December 31, 2012 to January 31, 2013. There were some additional signs and post included in the project. Mr. Foster moved to approve with a second by Ms. Lawson. The motion was unanimously passed. BID OPENING A. Bids were opened for the demolition of 518 South 13t11 Street. Those bids are as follows: 1. Cox Excavating Plus - $4,850.00 2. Pro Lawn Care - $5,500.00 3. Rinehart's Lawn Care - $8,950.00 4. KAF Enterprises - $5,950.00 5. Reynolds Service Tech - $8,000.00 6. Butler Excavating - $12,000.00 7. Mike Delucio and Son - $5,800.00 Ms Robinson told the board that these bids would be taken under advisement. Mr. Foster explained to the board that because of the timing of the grant for the completion of this project it will be necessary to award the bid and the contract at the same meeting even though that isn't the normal procedure. HEARING This hearing is an appeal by the Petitioner Seth Hardin, Premier Maintenance Solutions, LLC verses the City concerning a fine issued in connection with electrical installation conducted at 427 South 23rd Street. Ms. Robinson called the hearing to order and noted for the minutes that two (2) board members and legal counsel were present. She went on to explain how the hearing was to be conducted. Ms. Vessels explained that this hearing was being legally held by Indiana Law and explained the Board had up to 90 days to present their "Finding of Facts" at a future public meeting. Mr. Hardin as the Petitioner gave his opening statement stating that he felt that the fine should not have been issued to him because he contracted out the electrical work to an Electrical Contractor who he felt should have been responsible to obtain the necessary licenses and permits necessary to do the work. He had no witnesses but submitted documents to the Board for their review. Mr. Cannon the City's Electrical Inspector was the Respondent for the City of Richmond, explained to the board what transpired that lead up to the fine being issued to both the Contractor and the Electrical Contractor. He submitted documents to the Board showing the City Ordinances that talk about obtaining City Licenses and Permits. There are copies of the documents and a recording on file of these proceedings. ADJOURNMENT There being no further business, on a motion duly made, seconded and passed unanimously.
