HomeMy Public PortalAbout002-1994 - REZONING - 410 SOUTH D STREETA SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 410 SOUTH D STREET WHEREAS the zoning map designates 410 South D Street as R-3 One to Eight Family Residence District, and WHEREAS it is desirable to change the zoning designation to R-3 One to Eight Family Residence Special Use District to accommodate the establishment of a professional office, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation at 410 South D Street, Richmond, Indiana, be and is hereby changed to R-3 One to Eight Family Residence Special Use District to accommodate the establishment of a professional office pursuant to Section 22.012 and in accordance with the provisions of Article 48 of the Zoning Ordinance. The Special Use District does not stand by itself but shall be Combined with an existing zoning district.. The following is the Petitioner's response demonsrating the, manner in which the requested Special Use rezoning complies with said standards: 1. The establishment, maintenance, or operation of the Special Use will not be,detrimental to or endager the public health, safety, morals, convenience, or general welfare for the following reasons: The proposed office use will have only 1 or 2 employees, with visits by usually 1 business client, so it therefore is quiet, and will have no negative health, safety or moral effects. -1- 2. The Special Use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood for the following reasons: with the exception of entry/exit by clients(usually only 2 or 3 Per da and occasional loading/unloading of supplies (hand carried serve in office supplies). 3. The establishment of the special Use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the ditrict for the following reasonsi Use as this type of office actually continues and strengthens the orderly improvement and "gentrification" of this older area into economically viable uses and the attendant need to maintain an attractive business environment. 4. The remainder of the first floor is occupied by an area now used as a kitchen and stairs to both the basement and second floor, which will remain unoccupied. It is necessary to change the zoning to R-3 One to Eight Family Residence Special Use District to accommodate the buyer's proposed use. The ordinance should be referred to Plan Commission for pubic hearing at its meeting on January 25, 1994. The ordinance should be back to Council for second reading on February 7,1994. Hill, owners; Gayle W. Gardner, agent; requesting a Special Use for a Professional Office on property located at 410 South "D" Street. Six notices were sent to surrounding property owners, no comments were returned to this office. One property owner, Mrs. Gertrude Ward, did appear to support the request. Planning Staff recommended approval of the request because our Comprehensive Plan calls for this area to be a Special Development Area. In recognition of the fact that a mix of commercial and residential land use was important historically to the development of this area, it is the intent of the Master Plan to promote this commercial -residential land use mix for the purpose of preventing the physical deterioriation of structures and neighborhoods. It is intended to apply predominantly to the structures in the near downtown area, such as the property in question. The Commission voted 10 in favor, none opposed to recommend the passage of Ordinance No. 2-1994.
