A GENERAL ORDINANCE AMENDING THE ZONING ORDINANCE, BEING
CHAPTER 154 OF THE RICHMOND CODE
WHEREAS it is desirable to elaborate upon the definition in Article 20.031 of Chapter
154 of the Richmond Code, and
WHEREAS Article 30.003 of Chapter 154 of the Richmond Code enumerates 68
different uses as retail and service uses in the C-1 Limited Commercial
District, and
WHEREAS it is desirable to add "Automotive parts supplier provided that no service,
repair or installation shall occur on the premises" and "Automotive
upholstery shop , to this list, and
WHEREAS it is desirable to strike the fourth sentence of Article 43.05 of Chapter 154 of
the Richmond Code,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
as follows:
A. Article 20.031 of Chapter 154 of the Richmond Code be amended to read as
follows, to wit:
20.031 Residential: The keeping of not more than two (2) roomers or boarders by a
resident family in the principal structure. Said roomers or boarders may be housed
in a single room with shared facilities or the structure may be modified to provide an
apartment unit as described in the City of Richmond Housing Code, providing for separate
facilities and separate metering.
B . Article 30.003 of Chapter 154 of the Richmond Code be amended by inserting the
following immediately following Article 30.003(4), to wit:
(4.1) Automotive parts supplier provided that no service, repair or installation shall occur
on the premises.
(4.2) Automotive upholstery shop.
C. The fourth sentence of Article 43.05, "Neon lighting and tubing may be used on
permitted signs, but it is not permitted to outline buildings or structures, or ornamental
features by use of exposed neon tubing, strings of lights, or otherwise" be stricken.

The above referenced ordinance is an amendment of the text in three places which has been
recommended by the Plan Department Staff.
The expansion of the retail and service uses from 68 to 70 seems appropriate. The clarification of
keeping boarders by a resident family is needed at 20.031. The elimination of the prohibition against
using neon tubing as an architectural feature is a recognition of new building techniques.
The ordinance should be referred to Plan Commission for public hearing at its meeting on February 23,
1994.
The ordinance should be back to Council for second reading on March 7, 1994.

Dear Mr. Parker:
Please advise the members of Common Council that the Richmond Planning
Commission conducted a public hearing 2-23-94 on the request of the Planning
Commission to amend the Zoning Ordinance to, in effect, classify the following uses
and assigning them a zoning classification.
Article 30.003, which has 58 separate uses be amended to include: Automotive Parts
Supplier provided that no service, repair or installation shall occur on the premises.
The Planning Commission voted 8-0 to recommend approval of this request.
Automotive Upholstery Shop new use was also voted on 7-1 to recommend
approval of this request.
Strike the fourth sentence of Article 43.05 of the Zoning Ordinance which prohibits
the use of neon tubing to outline structures. The Planning Commission voted 8-0
to recommend approval of this request.
Finally, part four of this ordinance would amend Article 20.031 of the Zoning
Ordinance allowing for separate metering and separate facilities within the R-1
single family structure for roomers and boarders. The Plan Commission voted 8-0
to recommend approval of this request.

Dear Mr. Parker:
Please advise the Common Council that the Richmond Planning Commission
voted 8 to 0 with one abstinence to recommend denial of this request. The Plan
Commission staff, Midge Bond, owner of the adjacent apartments, and James
Fitzgerald, manager of the West Side Splash Club, shared a common concern for
mixing automobile traffic with children, biking, and walking to the Splash Club.
The site plan for the credit union provided for future growth doubling the size of
the structure and adding a significant number of parking spaces.
It was further suggested but not determined that this would be spot zoning in the
middle of a residential area and not a continuation of other retail zoning.

The above referenced ordinance is a re -zoning of property owned by Lucille Toschlog, Clarence Toschlog,
Florence Toschlog and Ethel Toschlog which they wish to convey to the Wayne Teachers Federal
Credit Union for the construction of an office building and parking facility.
The current zoning is R-4 Multi -Family Residence District. It is necessary to change the zoning to C-2
Commercial District to accommodate the proposed use.
The ordinance should be referred to Plan Commission for public hearing at its meeting on February 23,
1994.
The ordinance should be back to Council for second reading on March 7,1994.
