HomeMy Public PortalAbout022-1994 - APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF RICHORDINANCE NO. 22-1994 AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION OF REAL ESTATE WHEREAS the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose, and WHEREAS the acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the following donation be gratefully accepted and hereby acknowledged with the heart -felt gratitude of the citizens of Richmond, to wit: the Richmond Hotel Limited Partnership, an Ohio limited partnership, "Donor", transfers to Richmond, Indiana, a municipal corporation, "Donee", lots number 33 and 34 and 35 feet off - the entire north side of lot number 32 in C.W. Starr's Eighth Addition to the City of Richmond, Indiana, as recorded in Plat Book 1, page 227 of Wayne County Plat Records and 135 feet off the north end of Official Map Tract No. 461 of the City of Richmond, Indiana. As consideration for this conveyance, Donee shall demolish the existing one story building on subject real estate; back fill and (grade the area; maintain lawn, shrubbery and trees in the area, and construct a wall on the north side of Donor's hotel structure which is exposed as a result of said demolition, which wall shall be compatible with the remainder of said hotel structure. Donor shall be consulted with regard to any development or disposition of said real estate but this understanding shall not diminish or condition the passage of full fee simple title to Donee. MILLIGAN City Attorney Representatives of the owner and operator of the Leland Hotel have met five times over the past six months with city administration officials and representatives of the Wayne County Commissioners, Main Street Richmond -Wayne County, the Urban Enterprise Association, the Redevelopment Commission, and the Wayne County Economic Development Corporation. The subject of these meetings has been the land immediately north of the Hotel structure which is occupied by a one story retail and office building. The land is bounded on the west by South 9th Street, on the north by the Bullerdick Furniture Store parking lot, and on the east by an alley. The Leland proposes to donate this land to the City in exchange for the City's commitment to demolish the existing one story building on subject real estate; back fill and grade the area; maintain lawn, shrubbery and trees in the area; construct a wall on the north side of the hotel structure which is exposed as a result of said demolition, and consult with the Leland with regard to future development or disposition of the land. The referenced ordinance has been prepared to enable the City to accept this donation subject to the above stated conditions. The demolitions and construction work would begin in April and be completed on or about July 1,1994. Appropriations in the 1994 budget are sufficient to fund this work which will be awarded by the Board of Works upon the receipt of competitive bids pursuant to the formal contract procedures set forth it) Section 41.11 of the Richmond Code.
