AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO
RECEIVE A DONATION FROM RICHMOND CENTER, LLC
WHEREAS the City of Richmond, Indiana, has the option
of accepting or rejecting donations for a
specific purpose, and
WHEREAS the acceptance of a donation for a specific
purpose constitutes the appropriation of such
property for the intended purpose,
NOW, THEREFORE, be it ordained by the Common Council of the City
of Richmond, Indiana, that a donation of personal property of the
value of One Hundred Twelve Thousand Five Hundred Dollars
($112,500.00), as more specifically set forth in the Grant of Gift
attached hereto and made a part hereof, is hereby gratefully
accepted as the generous gift of Richmond Center, LLC, and is
hereby acknowledged with the gratitude of the citizens of
Richmond. The Grant of Gift as attached is in proper form and the
Board of Public Works and Safety is requested to accept said Grant
on behalf of the City of Richmond, Indiana.
Passed and adopted this 4th day of April 1994 by the Common
Council of the City of Richmond, Indiana.

This ordinance authorizes the Board of Public Works and Safety to accept the donation of an assembly
conveyor system from Richmond Center, LLC, managed by the Elder Family Partners of Richmond.
The system was installed by the Deutz Company for the manufacture and assembly of diesel engines but
has never seen extensive use. Elder Family Partners and their associates in Richmond Center, LLC
(Limited Liability Company) purchased the building and removed the conveyor system_
This donation to the City gives us an attractive asset to use in our economic development efforts to
locate new jobs. There will be no cost to the City in accepting this donation.
Ben Ross, President of the Wayne County Economic Development Corporation will attend your April
4th meeting to answer any questions you may have.
This ordinance can be adopted in a single meeting with motions to suspend the rules.

GRANT OF GIFT
THIS GRANT OF GIFT is made this day of April, 1994 by
Richmond Center, LLC, an Indiana limited liability company
(herein referred to as "DONOR") to the City of Richmond, Indiana
(herein referred to as "DONEE"), as follows:
WHEREAS, Donor is the owner of certain personal property,
being a chain driven motor assembly conveyor, more particularly
described as follows:
600 feet of chain driven motor assembly conveyor uses a
Rexnard 160 chain to tow motor platforms (18" wide x 22"
long) in a continuous loop (over and under). Platforms ride
on 4--4" trolley wheels that ride on 3" x 4" angle iron. The
drive is a reliance VST Vari-Drive, Size T200, 5 H.P., 1423
Max. RPM, 178 Min. RPM, 460V, 3 Phase, 60 Cycle with a Louis -
Allis Linea -Gear Reducer, Model 7P05/414, 735 YSL frame, 70:6
ratio, 1750 RPM IN, 25 RPM out, 17.9 H.P.
(herein .referred to as the "PERSONAL PROPERTY") and, whereas, Donor
desires to make a gift to Donee of the personal property as a
charitable contribution, such being of the fair market value of
One Hundred Twelve Thousand Five Hundred Dollars ($112,500.00),
and Donee is willing to accept same upon such basis.
NOW, THEREFORE, Donor hereby gives, grants and conveys the
personal property to Donee completely and absolutely in its "as
is" condition, for Donee's uses and benefits. This gift is made
by Donor pursuant to its legal authority to do so and the persons
executing this gift below are duly authorized.

ACCEPTANCE
THE CITY OF RICHMOND, INDIANA, herein referred to as Donee,
by its Board of Public Works and Safety, hereby accepts the above
described personal property as a gift from Richmond Center, LLC,
as Donor, completely and absolutely and in its "as is" condition,
for the uses and benefits of Donee. Further, Donee acknowledges
that the fair market value of the personal property is the sum of
One Hundred Twelve Thousand Five Hundred Dollars ($112,500.00),
thereby constituting the value of the gift being made herein.
Duly accepted by the City of Richmond, Indiana, by its Board
of Public Works and Safety at its regularly scheduled meeting,
upon resolution unanimously adopted.
