HomeMy Public PortalAbout030-1994 - REZONING - 1200 SOUTH 18TH STREETORDINANCE NO. 30-1994 A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 1200 SOUTH I8TH STREET AND APPROVING A FINAL DEVELOPMENT PLAN WHEREAS the zoning map designates that portion of the northeast quarter of section 9, township 13 north, range 1 west in the City of Richmond which comprises both sides of the 1200 block of South 18th Street as C-2 Commercial Special Use District with a Planned Unit Development preliminarily approved, and WHEREAS it is desirable to use and develop 3.405 acres of said area as a residential unit development project and to use and develop 1.086 acres of said area as an integrated commercial center, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, as follows: A. That pursuant to Article 45 of the Zoning Ordinance the real estate described in attached Exhibit A containing 3.405 acres be and is hereby designated a Residential Development - nn-Project�subjecrto xll-of-tire-condi�i-onsan(I-regriirements-set forth in-said-amcl B . The zoning designation of the real estate described in attached Exhibit A is hereby changed to R-4 Multi -Family Residence District; C . That pursuant to Article 45 of the Zoning Ordinance the real estate described in attached Exhibit B containing 1.086 acres be and is hereby designated an Integrated Commercial Center subject to all of the conditions and requirements set forth in said article; D. The zoning designation of the real estate described in Attached Exhibit B is hereby changed to C-2 Commercial District; E. That the proponents of the Residential Development Unit Project and Integrated Commercial Center shall start construction on or before one year from the date hereof and complete the project and center within a reasonable time, and F . The final development plan attached hereto and marked Exhibit C incorporates the recommendations of the Advisory Plan Commission and is hereby approved as required by Article 45.06 of th� Zoning Ordinance. MILLIGAN City Attorney This ordinance under Article 45 of the Zoning Ordinance requires a land owner to file a preliminary plan for a Residential Unit Development Project or an Integrated Commercial Center. This petition involves proposals by First Richmond Corporation to develop a tract of 3.405 acres as a Residential Unit Development Project on the west side of South 18th Street and a tract of 1.086 acres as an Integrated Commercial Center on the east side of South 18th Street. The tract west of South 18th is a portion of the real estate described in Exhibit A of Ordinance No. 32-1994. The tract east of South 18th is a portion of the real estate described in Exhibit B of Ordinance No. 32-1994. Both projects are in the 1200 block of South 18th Street which lies immediately south of South L Street. Forty-eight apartments are proposed for the Residential Unit Development Project and a corporate office building containing 5800 square feet is proposed for the Integrated Commercial Center. The real estate is currently zoned C-2 Commercial Special Use District with a Planned Unit Development preliminarily approved. The 3.405 acre tract must be rezoned R-4 Multi -Family Residence District to accommodate the Residential Unit Development Project. The 1.086 acre tract must be rezoned C-2 Commercial District to remove the Special Use and Planned Unit Development previously authorized. The C-2 Commercial District will accommodate the Integrated Commercial Center. This ordinance should be referred to the Plan Commission for a public hearing and recommendation. Milligan City Attorney RICHMOND ADVISORY PLAN COMMISSION RICHMOND, INDIANA April 27, 1994 Mr. Larry Parker, President Richmond Common Council Richmond, IN 47374 RE: Ordinance No. 30-1994 ear -Mr. Parker: Please advise the members of Common Council that the Richmond Advisory Plan Commission conducted a public hearing, Tuesday, April 26, 1994, on the petition of First Richmond Corporation, owner; Rick Freeman, agent; requesting an amendment to a Planned Unit Development to rezone 3.405 acres to R-4 Multi - Family Residential District for a Residential Unit Project on the west side of the 1200 block of South 18th Street, and to rezone 1.086 acres to C-2 Commercial District for an Integrated Commercial Center on the east side of the 1200 block of South 18th Street, Richmond, Indiana Notices were delivered to five surrounding property owners, no comments were returned to this office. Planning Staff recommended approval of the request because our Comprehensive Plan calls for high -density residential development in this area and cmmmercial development has already been approved for the front portion of this property. The recommendation for approval was subject to the following conditions: 1) Site plan to be made a part of the ordinance; 2) Developers agree to landscape the project in accordance with the Visual Enhancement Ordinance; and 3) All sewer and drainage plans be approved by appropriate city officials before permits are issued.
