HomeMy Public PortalAbout038-1994 - REZONING - 3363 EAST MAIN STREETORDINANCE NO. 38-1994 A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 3363 EAST MAIN STREET WHEREAS the zoning map designates the property at 3363 East Main Street as R-3 One to Eight Family Residence District, and WHEREAS it is desirable to change the zoning designation to R-3 One to Eight Family Residence Special Use District to accommodate the installation of an administrative business office not dependent upon over-the-counter sales, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation at 3363 East Main Street, being Auditor's Map No. 46-34-440-302,000 -29, Richmond, Indiana, be and is hereby changed to R-3 One to Eight Family Residence Special Use District to accommodate the installation of a mortgage brokerage business pursuant to Article is attached as Exhibit A. The Special Use District doaa not stand by itself but shall be combined with an ` existing zoning district. The Special Uses that may be allowed within the Special Use District are specifically enumerated in each zoning district classification. The Richmond City Plan Commission meets on the fourth Tuesday of each month -at 7:30 P.M. in the City Council Chambers. SPECIAL USE STANDARDS Article 48 of the Zoning Ordinance setsforth certain standards to be used as guidelines by the Plan Commission in considering Special Use District rezoning Petitions. The following is the Petitioner's response demonsrating the manner in which the requested Special Use rezoning complies with said standards: 1. The establishment, maintenance, or operation of the Special Use will not be detrimental to or endager the public health, safety, morals, convenience, or general welfare for the following reasons: The establislznent of a mortgage broker office will not dramatically increase the flow of traffic Jn s area. A mortgage broker provides a financial service, is not a retail or wholesale distributor, and therefore the business is comparable with businesses an adjacent and nearby lots already in operation. -1- 2. The Special Use will not be injurious to the usp and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish aid impair property values within the neighborhood for the following reasons; As properties are located to the North. East and West of the property in question, already have operating businesses, and the normal business hours will be from approximately 9:00 a.m, to 6:00 p.m.; the special use 71-1, in o way, be injurious to the use and enjoyment of other property owners in the vicinity. 3. The establishment of the Special Use will not impede the normal and orderly development and improvement of the .surrounding property for uses permitted in the ditrict for the following reasons: see answers to question given above; presently, a single family structure wi iWrovenents are present at the site, and the applicant intends to retain the buildings with the present exterior form and esign, with the exception ot the addition ot signage. Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion in the public streets for the following reasons; As the increase ' in traffice would be minimal, the applicant contends that the turn lane already existing will be adequate, to minimize traffic congestion in the area. SPECIAL USE NARRATIVE: The Special Use established by ordinance of the Common Council within the Special Use District shall be limited to that specific Special Use and shall not be altered, converted, modified or substituted in any way without an amendment to said Special Use being granted in accordance with Article 62 of the Zoning ordinance. The following narrative is the Petitioner's detailed description of the Special Use being r e qu e s t e d : The o=3--±9ant requests Special Use zoning in ordertn a mortgage/brokerage company - the primary function being to originate and process real estate mortgage loan applications, at the 3361-East &jm Street location. As an originator of mortgage loans, the company will not provide the loan servicing. Given this situation, it is anticipated that the traffic generated by this business wi a minima esen y, a company emp oys two persons, and it is anticipated that at some point, within the next year, two clerical positions would be added. -2- C. SPECIAL USE NARRATIVE (continued): D. SITE PLAN The Site Plan submitted is to be drawn on unlined paper at an engineering scale, with a north arrow and shall show the following: 1. Please advise the members of Common Council that the Richmond Advisory Plan Commission conducted a public hearing, Tuesday, May 24, 1994, on the petition of William L. and Barbara L. Rogers, owners; Scott Wesler and Stephen Hunyadi, agents; requesting a Special Use for Professional Office/Mortgage Brokerage on the property located at 3363 East Main Street, Richmond, Indiana Notices were delivered to four surrounding property owners with one comment, in favor of the request, returned to this office. Planning Staff recommended approval of the request. Our Comprehensive Plan calls for commercial retail and service development along this portion of East Main Street and several special use developments have already been approved for this arera. The recommendation for approval was subject to the following condition: site plan to be made a part of the ordinance. The Commission voted 10 in favor, none opposed to recommend the passage of Ordinance No. 38-1994. MILLIGAN City Attorney This ordinance changes the zoning of a single family residence located at 3363 East Main Street from R-3 One -to -Eight Family Residence District to R-3 One -to -Eight Family Residence Special Use District to permit the installation of an administrative business office not dependent upon over-the- counter sales under Article 22.012 of the Zoning Code. The mortgage brokerage business is described on page 2 at item C of the attached petition. The petition also addresses the traffic situation and general affect upon surrounding property. The ordinance should be referred to Plan Commission for public hearing at its meeting on May 24,1994. The ordinance should be back to Council for second reading on June 6,1994.
