HomeMy Public PortalAboutOrdinance 69-293ORDINANCE NO. 69'-293 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY ZONING REGULATIONS WITH REGARD TO HOUSEHOLD PETS THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. That Subparagraph 9 of Section 9117 (H) of the Temple City Municipal Code is hereby repealed. SECTION 2. That Subparagraph .2 (b) of. Section 9331 of the Temple City Municipal Code is hereby amended to read as follows: (b) Animals. Notwithstanding any other provisions of this code, no person shall maintain, or permit the maintenance of, any fowl or animal on any parcel of property or lot classified in the R -1 zone, except as follows: (1) Not to exceed three household pets, over three months of age; household pet shall mean any domesticated animal commonly maintained in residence with man, but not including any animal which is capable of, and inclined to, inflict harm or discomfort to or upon any person or persons; and (2) Not more than two rabbits or chickens (excluding roosters) or ducks over three months of age; and (3) Aviaries for pigeons, song or decorative birds, provided the following conditions are met: a) not more than 12 adult birds are so maintained; and b) that the purpose of the maintenance of such aviary is primarily for hobby . purposes and not for commercial exploitation; and c) that the structures housing such aviaries shall not be located within ten feet of any side or rear lot line upon the lot where located, unless separated from adjoining property by ,a solid wall or fence at least 1" thick; nor shall the same be located in front of any residential structure; nor within 35 feet of any main building; nor shall the same be higher than any yard wall located within ten feet thereof; and d) that any person may apply to the City Council for a special permit for aviaries contain - ing more than. 12 birds, provided that such applicant pays a fee for inspections in the amount set by the City Council by separate motion, and provided further that the applicant may show to the satisfaction of the City Council that such aviary will be maintained without damage or nuisance to neighboring properties;and e) that all existing nonconforming structures erected for the housing of birds shall comply with new regulations and standards on or before January 1, 1971.. Ordinance No. 69-293 (4) That, except as otherwise provided, compliance shall be had with the provisions of this Section within a period of 60 days from and after the effective date hereof; and (5) Nothing contained in this •subparagraph shall prevent the keeping of animals or fowl by ,a tax-supported el emosynary or public educational institution, which are utilized as a part of such institution's curriculum; and (6) All the regulations herein shall be subject to the general nuisance ordinances of the City and it shall be unlaw- ful for any person to maintain any animal which constitutes a public nuisance. SECTION 3. That Subparagraph 2 (b) of Section 9350 of the Temple City Municipal Code is hereby amended to read as follows: (b) Animals. Notwithstanding any other provisions of this Code, no person shall maintain, or permit the maintenance of any fowl or animal on any parcel of property or lot classified in the R -2 zone, except as follows: (1) Not to exceed two household pets over three months of age per unit; household pet shall mean any domesticated animal commonly maintained in residence with man, but not including any animal which is capable of and inclined to, inflict harm or discomfort to or upon any person; and (2) Not more than two rabbits or chickens (excluding roosters) or ducks over three months of age; and (3) Except as otherwise provided, compliance shall be had with the provisions of this Section within a period of 60 days from and after the effective date hereof; and (4) Nothing contained in this subparagraph shall pre- vent the keeping of animals or fowl by a tax - supported eleemosynary or public educational institution, which are utilized as a part of such institution's curriculum; and (5) All the regulations herein shall be subject to the general nuisance ordinances of the City, and it shall be unlawful for any person to maintain any animal which constitutes a public nuisance. SECTION 4. That Subparagraph 2(b) of Section 9360 of the Temple City Municipal Code is hereby amended to read as follows: (b) Animals. Notwithstanding any other provisions of this Code, no person shall maintain, or permit the maintenance of, any fowl or animal on any parcel of property or lot classified in the R -3 zone, except as follows: (1) Not to exceed one household pet over three months of age per household unit; household pet shall mean any domesticated animal commonly maintained in residence with man, but not including any animal which is capable of, and inclined to, inflict harm or discomfort to or upon any per - son; and (2) Not more than two rabbits or chickens (excluding roosters) or ducks over three months of age; and -2- Ordinance No. 69 -293 (3) Except as otherwise provided, compliance shall be had with the provisions of this Section.: within a period of 60 days from and after the effective date hereof; and (4) Nothing contained in this subparagraph shall prevent the keeping of animals or fowl by•a tax - supported eleemosynary or public educational institution, which are utilized as a part of such institution's curriculum; and ( 5 ) A 1 1. the regulations herein shall be subject to the general nuisance ordinances of the City and it shall be un- lawful for any person to maintain any animal which constitutes a public nuisance. SECTION 5. The City Clerk of the City of Temple City shall certify to the passage and adoption of this Ordinance and to its approval by the Mayor and shall cause the same to be published in the Temple City Times, a newspaper of general circulation, printed, published and circulated in the City of Temple City.
