HomeMy Public PortalAbout02/15/00 CCM19 MEDINA CITY COUNCIL MEETING MINUTES OF FEBRUARY 15, 2000 The City Council of Medina, Minnesota met in regular session on February 15, 2000 at 7:30 p.m. in the City Hall Chambers. Mayor John Ferris presided. Members present: Ferris, Zietlow, Hamilton, Johnson, and Smith. Members absent: None. Also present: Police Chief Ed Belland, Attorney Ron Batty, Public Works Director Jim Dillman, City Engineer Glenn Cook, Planning & Zoning Administrator Loren Kohnen, and City Clerk - Treasurer Paul Robinson. 1. Additions to the Agenda A. Ed Belland asked to have the executive session regarding the police matter removed. Moved by Jim Johnson, seconded by Phil Zietlow, to approve the agenda as amended. Motion passed unanimously. 2. Minutes from the February 1, 2000 City Council Meeting Carolyn Smith said that she realized that a lot was said and that this was an excerpt from that meeting, however, she would like to add to the minutes "that she said it was difficult to say absolutely no growth when we already know that at least 100 or so units could be added to the rural residential area under our existing ordinances". Moved by Carolyn Smith, seconded by Jim Johnson, to approve the minutes of February 1, 2000 as amended. Motion passed. Phil Zietlow abstained (he was not present at the meeting). 3. Comments from Residents in Attendance on Items Not on the Agenda There were none. 4. Park Commission Comments There were none. 6. Planning Commission Comments Loren Kohnen said there was no meeting in February, but there will be a meeting in March. There will be one item on the agenda, a variance for a property on Lake Ardmore. 7. Ordinance 313 Rezoning Certain Property from Rural Residential to Agricultural Preserves Loren Kohnen said, as most of you know, this is the property east of the Baker Golf Course that used to owned by the Gangelhoff's. He said this property needs to be rezoned to agricultural preservation in order to allow the property to be placed into the agricultural preserves program. Moved by Carolyn Smith, seconded by Jim Johnson, to approve Ordinance 313. Motion passed unanimously. Medina City Council Meeting Minutes February 15, 2000 20 8. Resolution 00-03 Adopting the Map of Land Eligible for Designation as Agricultural Preserves Moved by John Hamilton, seconded by Phil Zietlow, to approve Resolution 00-03 adopting the map as presented. Motion passed unanimously. 9. Approval of Ordinance 314 Amending Section 720 of the City Code Loren Kohnen said since the Council adopted section 720 some new sections were added to the Minnesota State Rules 7080. He said this modified ordinance would add those new sections except for the section dealing with warrantied systems. Loren Kohnen went through a number of the other changes in the ordinance. There were some issues with definitions, such as the definition of a standard system which now includes both mound and trench systems. There was some question about the section that was titled "other systems". Loren Kohnen explained that some systems, like multi -flow systems are included in the other category. Loren Kohnen said that an 18% slope would be the maximum allowed for a trench system. Phil Zietlow asked if a septic system would be allowed on a steeper slope if it was tiered. Loren Kohnen said that would not work since in some spots you would be taking some soils down to mottled area. Paul Robinson mentioned that there was a typo in section 720.03 Subd. 1. He said it should be warrantied instead of warranted. He asked Loren Kohnen if the 7080.0450 was titled "Warrantied Systems". Loren Kohnen said yes it was. Phil Zietlow asked about researching new systems and how that was done. Loren Kohnen said that the PCA has a number of septic systems around Lake Washington that they are continually monitoring. There are all types of systems around that lake and hopefully in another five or ten years after these test systems have been proven, they will be added to the list of standard septic systems. Phil Zietlow asked if the City was creating a number of unbuildable lots by adopting this ordinance. Loren Kohnen said there are some people on Buckskin that will not have a buildable lot. Loren Kohnen said it would be possible for the owners of those lots to ask for a variance to these standards. Kohnen said there are a number of small lots that may not meet these requirements. However, the City approved them 25 years ago and helped to create this hardship. It probably can go through a variance process. He recommended that it not be an administrative variance but rather a variance approved by the City Council. Phil Zietlow cited an example of where a lot on the north side of CR 24 had a limited amount of good soils for a septic site so the City limited the number of bedrooms they could have to two. Carolyn Smith asked where the definitions of a failing system were located and other definitions. Ron Batty said that this was an ordinance that was adopting a large portion of the Minnesota State Rules 7080. He said the definitions are included in the state rules. Medina City Council Meeting Minutes February 15, 2000 21 Carolyn Smith thought that the definitions of failing systems and standard systems were somewhat confusing and thought they should be defined in the City's ordinance in addition to the PCA's ordinance. She thought it may add some clarity. There was some discussion about this. Ron Batty said it is hard to know where to stop adding definitions especially when you are referencing another document. The consensus for now was to have the copy of the 7080 rules available at City Hall. Loren Kohnen said that the City does have 7080 rules here so that if there was some confusion, people could reference the rules. Carolyn Smith asked to have a link on the City's web site to the PCA so people could look up these ordinances and also have a link in the ordinance itself. Moved by Jim Johnson, seconded by Phil Zietlow, to approve Ordinance 314 amending section 720 of the City Code. Motion passed unanimously. 10. Resolution 00-04 Authorizing Publication of Ordinance 314 by Title and Summary Moved by Jim Johnson, seconded by Carolyn Smith, to approve Resolution 00-04 authorizing publication of Ordinance 314 by title and summary. Motion passed unanimously. 11. Metropolitan Council Comprehensive Plan Information Request Paul Robinson said that the City received the first information request back from the Metropolitan Council. He said he has been working on parts of it over the past week and recently gave Jim Dillman the copy as well as Loren Kohnen. Robinson said that he took the letter and created a task sheet to monitor who is doing what to respond to the information request. Robinson said he would review the request and identify some of the areas where there may be policy considerations. Robinson said under the sanitary sewer area, there was some technical information that would need to be provided regarding the City's inflow/infiltration program. He said that the next item was a request to provide sewer flow calculations between the 2020 and 2040 MUSA area. Robinson said that based on the discussion that the City Council recently had on this issue, that may or may not be necessary. So at this time, he was not going to provide the Metropolitan Council with those calculations. In the near future the City Council will need to set up a public hearing to address this issue. John Hamilton said that the 2040 line has not been changed yet. Under the environmental section, there was a request for the most recent individual sewage treatment system (ISTS) ordinance. Robinson said that issue was on tonight's agenda. He said in addition they want the City to have an ISTS management program in place. Robinson said that the City's previous ordinance referenced such a management program. He said this is no longer a part of the ordinance. Medina City Council Meeting Minutes February 15, 2000 22 Loren Kohnen talked about adopting a separate maintenance ordinance and referenced a copy of the City of Dayton's ordinance. Phil Zietlow asked if this would require each person to have a manhole cover. He said he understood that this requirement would cost around $2,000. Loren Kohnen said that it could cost less than that, and that there may be some other options. Phil Zietlow said that he does not want to force people to spend money. Loren Kohnen said that inspections could be done by any pumper. A maintenance ordinance would require a system to be pumped every three years, as well as a visual inspection to see that the system is still operating. Kohnen said that one of the benefits of a program like this is that if they have participated and are up to date with their inspections, they would be able to sell their house without replacing their septic system, even if they have a so-called failing system. He said he would bring back an ordinance for the Council to consider at the next City Council meeting. Robinson said there were some issues about NURP ponds. Jim Dillman said that these are currently referenced in our engineering standards. Robinson said if we do not currently have ordinances that reference NURP ponds and other storm water management practices the City can pass a resolution stating that the City will modify ordinances within 120 days of the approval of the Comprehensive Plan. Robinson recommended, at a minimum, the Council should pass this resolution and decide whether or not the ordinances currently in effect apply. Robinson said there were a number of comments about the City's water projections in the water supply plan. He said he would update the population projections so that new supply projections could be made. In addition the Metropolitan Council had a number of comments about the City's 1996 water supply plan. Evidentially, there was a review done in 1996 and they would like some additional information based on comments from the 1996 review. The City Council was wondering why they were following up on so late on this particular issue. Robinson went through some of the land use issues. He said in order to use an undesignated (flexible) MUSA the City would have to fulfill a number of additional conditions. He said that one of the more controversial conditions would be the negotiated densities. Robinson said the last time he created the units per acre calculations, the City was around 1.96 units per acre. However, now that the PUD ordinances are further along, Robinson said he could place more land into permanent open space making the calculation 2.26 units per acre. Robinson said recently, the City of Minnetrista's comprehensive plan was approved with 2.2 units per acre. Robinson said that the City is getting close. In the end, however, this probably Medina City Council Meeting Minutes February 15, 2000 23 would require a face to face meeting. Robinson explained that he was able to answer a number of questions once he was able to clarify the City's position. The next issue was on land use. Robinson said that he was working on worksheet B. Basically, this worksheet asks for more detail on residential and employment densities. Robinson said the Metropolitan Council would like to have a discussion about the Council's growth policy, versus the City's growth policy. They would like a more detailed explanation for why the City's policy is different than the Council's. Robinson said that he would respond with the issues raised in the Comprehensive Plan. The most important ones included the Metropolitan Council's 1992 mandate of 1 unit per 10 acre density (64 units per 640 acres). This caused a large portion of the rural residential area to be developed at that overall density. This, and the significant amount of wetlands and hydric soils in the Rural Residential area, make future urbanization difficult. There was some discussion about the missing aviation section. Robinson said that he would use the language as given to him by the Metropolitan Council. The last issue concerned housing. Robinson said they would like more detailed information on housing. Robinson said he wanted to check with the City Council on his proposed strategy. He said that added information would focus on life cycle housing, in particular senior citizen housing, such as a senior citizen housing in the Uptown Hamel area. He said all of the policies and goals would be focused towards that type of housing issue. He believed that this would satisfy the Metropolitan Council and would also agree with the City Council's goals. 12. Approval of Amendment to Bill Thibault's Contract Moved by Jim Johnson, seconded by Carolyn Smith, to amend Bill Thibault's contract. Motion passed unanimously. 13. Approval of Road Bids Moved by Jim Johnson, seconded by John Hamilton, to approve the bids. Motion passed unanimously. 14. Tire Deflators Ed Belland said last year he looked into purchasing tire deflators. At that time he could have received a grant but he did not apply because he did not see the need. However, he said recently they were in a high-speed chase where tire deflators were used to stop a car. He said they worked very effectively. He said the tire deflators that they are looking at are eight -inch wide mats with replaceable spikes. He said that Steve Lundell offered to donate half of the purchase cost. He said they had looked at a number of different alternatives. This particular mat works best. Phil Zietlow mentioned that it was really neat of Steve Lundell to donate money for this purpose. Moved by Carolyn Smith, seconded by Jim Johnson, to approve the purchase of tire deflators. Motion passed. Medina City Council Meeting Minutes February 15, 2000 24 15. Evidence Storage Lockers Ed Belland said they need a better system for storing evidence. Currently, all of the officers have access to the storage area. Belland said because of this, there may be cases where all of the officers, who have access to the evidence, may need to testify. This would not be very efficient. As an alternative, he was requesting approval to have lockers made where each officer would have access to their own locker. Each officers would store all evidence seized, in their own locker. This would significantly limit access to the evidence. Moved by Carolyn Smith, seconded by Jim Johnson, to approve the purchase of the storage lockers. Motion passed unanimously. 16. Approval for the Administrator -Clerk -Treasurer to Attend the League of Minnesota Cities and Minnesota City Manager's Association Conferences Moved by Jim Johnson, seconded Phil Zietlow, to approve attendance at these conferences. Motion passed unanimously. 17. Change the July 4, 2000 Meeting Date Moved by Jim Johnson, seconded by Phil Zietlow, to move the July 4`h meeting date to July 5th. Motion passed unanimously. 18. Pay the Bills Moved by Jim Johnson, seconded by John Hamilton, to approve the bills, order check numbers 20692-20746 for $202, 887.75, and payroll check numbers 16467-16482 for $16, 820.15. Motion passed unanimously. 19. Adjournment Moved by Jim Johnson, seconded by Carolyn Smith, to adjourn the meeting at 8:20 p.m. Motion passed unanimously.
