A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 430 KINSEY
STREET
WHEREAS the zoning map designates the property at 430 Kinsey Street as R-3 One to
Eight Family Residence District, and
WHEREAS it is desirable to change the zoning designation to R-3 One to Eight Family
Residence Special Use District to accommodate the installation of an
administrative business office not dependent upon over-the-counter sales,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation at 430 Kinsey Street, being Auditor's Map No. 46-32-330-416.000
-29, Richmond, Indiana, be and is hereby changed to R-3 One to Eight Family Residence Special
Use District to accommodate the installation of a debt collection business pursuant to Article
22:012 and in accordance with the provisions of Article 48 of the Zoning Code. The site plan is
attached as Exhibit A.
The conditions stipulated in connection herewith are as follows:

Please advise members of Common Council that the Richmond Advisory Planning
Commission conducted a public hearing, Tuesday, June 28, 1994, on the petition of
James M. Backmeyer and Claudia J. Backmeyer owners; requesting a" Special Use"
in the R-3 One to Eight Family Residence District for an administrative business
office on the property located at 430 Kinsey Street.
Notices were delivered to 12 surrounding property owners, one (1) in opposition,
was returned to this office.
Planning Staff recommended approval of the request. Our Comprehensive Plan
shows this area to be a multi family district. This request will allow a commercial
use to locate in a residence. The residence has shown that it can no longer maintain
it's integrity as a residential structure. In a predominently duplex and single family
neighborhood this structure housed seven (7) students in the main house and three
(3) in the garage as it continued to deteriorate and blight the neighborhood.
The Commission voted 9 in favor, none opposed to recommend, to Council, the
passage of Ordinance No. 45, 1994 and that the site plan be made a part of the
Ordinance and marked exhibit "A".

This ordinance is a re -zoning of a residential property at 430 Kinsey Street consisting of lots 302, 303,
304 and 305 in the Haynes Addition. The property is owned by James and Claudia Backmeyer who
propose to sell it to Kathryn G. Hooper who operates Wayne County Collections at 230 South 3rd
Street. She plans to move the business to this location.
The current zoning is R-3 One to Eight Family Residence District. The owners are requesting a change to
R-3 One to Eight Family Residence Special Use District.
The ordinance should be referred to Plan Commission for public hearing at its meeting on June 28,1994.
The ordinance should be back to Council for second reading on July 5, 1994.
