A' GENERAL ORDINANCE REVISING AND UPDATING THE RICHMOND CODE AS
OF AUGUST 1, 1994
WHEREAS the "Revised Code of Ordinances for the City of Richmond, Indiana", was
adopted December 2, 1991, being Ordinance No. 6-1990, and
WHEREAS Ordinance No. 1-1992 changed the name of said compilation to the
"Richmond Code", and
WHEREAS it is necessary to revise and update from time to time, the compilation of all
ordinances, resolutions, declarations and motions heretofore enacted by the
Common Council of Richmond, Indiana, which have the effect of general
ordinances,
NOW, THEREFORE, be it ordained by the Common Council of Richmond, Indiana, that the
attached publication entitled "Richmond Code, Revised 1994" is hereby adopted as the official
compilation and re -statement of all general ordinances in effect as of August 1, 1994.
Be it further ordained that the attached publication incorporates revisions of text for the purpose of
clarity and understanding only and does not purport to amend, impose or repeal any penalties

and effect notwithstanding this compilation and restatement.
Be it furiher ordained that the attached publication may be amended, supplemented or repealed in
part, from time to time, by simply referring to the Code, chapter or section and not referring to the
original ordinance, resolution, declaration or motion that enacted such provision.
Be it further ordained that the general terms, phrases, and expressions in the attached publication
shall be liberally construed so as to carry out the intent and meaning of the original ordinances,
resolutions, declarations or motions and all actions amendatory thereof
Be it finally ordained the attached "Richmond Code, Revised 1994" shall take effect at 12 o'clock
noon on the day after its passage by Common Council and after its approval by the Mayor of
Richmond, Indiana.

Second Reading Amendment to Ordinance 54-1994
That 31.07 of 54-1994 be amended to read as follows:
31.07 PARKS AND REQRFATION NON -REVERTING FUNDS
(a) There is hereby created under Indiana Code 36-10-3-20 a special non -
reverting capital fund for the purpose of acquiring land or making specific capital
improvements. All proceeds from the sale of Parks and Recreation Department property
and equipment plus special user fees as established by the Parks and Recreation Board
shall be deposited into this capital fund. Money so deposited may not be withdrawn
except for the purposes for which the fund was created. Common Council may include in
said Board's annual budget appropriations for such specific purposes as requested by
said Board. (Ord. 103-1993)

reverting operating fund for park purposes from which expenditures may be made by
appropriation by the Parks and Recreation Board. All receipts from program
participation, event admissions, concessions, rentals, sales of merchandise and food,
user fees from golf and reservoir operations, and revenue generated by park operations
except swimming pool user fees, rentals of open-air shelter facilities throughout the
park system, and rental fees from enclosed facilities at Mary Scott Park, the Senior
Center, Springwood Park, the Resevoir, and Glen Miller Park, shall be deposited into
said special non -reverting operating fund. The receipts excepted in the preceding
sentence shall be deposited into the Park and Recreation Fund. (Ord. 103-1993)
That there is added to section 31.04 of 54-1994:
( i ) The City Clerk is authorized and directed to act as the manager of the Off-street
Parking Fund. (Res. 4-1984; Ord. 54-1994)
That 30.07(f)(2)(A) of 54-1994 be amended to read as follows:

(A) Reid Hospital and Health Care Services Board of Trustees
That the words "Department of Planning, Permits and Inspections" in 150.16(a) of 54-1994
be replaced with "City Enforcement Authority."

That section 154.13.16 of Ordinance 54-1994 be amended to read as follows:
154.13.16 'BUSINESS ENTERPRISE" - The use of land or a structure for manufacturing,
processing wholesale or resale of products. Also, the provision of services to
customers and/or clients. This definition is not intended to include sales
permitted under Chapter 125 of this Code. (Ord. 56-1983; Ord. 54-1994)

125.01 GARAGE, YARD AND PORCH ,SALES
A garage, yard or porch sale operated by the owner or tenant of a property in a residential
district, independent of any other business enterprise, shall be permitted. However, such
garage sale shall be limited to a period of one to four consecutive days five times per year. (Ord.

125.02 AUTO SALES
The offering for sale of no more than five motor vehicles per year from a residential property
shall be permitted. (Ord. 54-1994) Penalty, 125.99
125.99 PENALTY
The penalty for exceeding the restrictions of this chapter shall be twenty-five dollars ($25)
for each day of violation. (Ord. 54-1994)
That section 31.52)(2) of Ordinance 54-1994 be _amended to read as follows:
(2) Four members of the Commission shall constitute a quorum for the
transaction of business, provided that an action for discipline, dismissal, or
demotion shall require the affirmative vote of not less than five members of the
Commission. (Ord. 3187-1977; Ord. 54-1994)

The above ordinance is being introduced on first reading August 1,1994, with the suggestion that it be
considered on second reading August 15,1994.
During the two week period between said Council meetings, all members will have an opportunity to
peruse the new publication and prepare questions and comments.
Alan Harzman, a summer employee in our office, who will be returning to Vanderbilt University for his
sophomore year in September, will present the compilation and rearrangement and answer your
questions on August 15th. The general public may also comment at that time.
Jan Hibner and I will also be present on August 15th to assist in the presentation and discussion.
