REGULAR MEETING
January 24, 2006
The Moab City Council held their Regular Meeting on the above date in
the Council Chambers of Moab City Offices, located at 217 East Center
Street, Moab, Utah. Mayor Sakrison called the Pre -Council Workshop
to order at 6:00 PM for a Discussion Regarding the Animal Shelter
Proj ect.
Mayor Sakrison called the Regular City Council Meeting to order at 7:00
PM and Councilmember Gregg Stucki led in the Pledge of Allegiance.
Also in attendance were Councilmembers Kyle Bailey, Rob Sweeten and
Jeffrey Davis; City Manager Donna Metzler, City Recorder/Assistant
City Manager Rachel Ellison, Planning and Community Development
Director David Olsen, City Engineer Dan Stenta, City Planner Robert
Hugie and Police Chief Mike Navarre. Ten (10) members of the
audience and media were present.
Councilmember Davis moved to approve the Council Meeting Minutes
of September 27 and October 11, 2005. Councilmember Sweeten
seconded the motion. The motion carried 5-0 aye.
Under Citizens to be Heard, Bruce Hucko stated that he applauded the
Planning Commission's decision to extent the comment period for the
proposed Mountain View Subdivision, and he requested that the City
expand notification procedures of new subdivisions. Mr. Hucko
requested that the Council consider the needs of those directly affected
by this proposed subdivision. Mr. Hucko then stated that the Moab Arts
Council had received a technical assistance grant to conduct meetings
throughout the community.
Gladys Gary stated that she is against the proposed subdivisions in
Mountain View and that she had taken out an advertisement in the
newspaper stating why.
Craig Anderson stated that he is opposed to extending the block length
to over 1,000 feet and that he thinks the existing streets should be
extended instead. Mr. Anderson is concerned about access to the public
lands as well as the danger of working around the pipeline. Mr.
Anderson stated that according the Williams Pipeline that no engineering
exists and that he feels the City's notification process did not work.
Ralph Santos stated that the notification for the Mountain View
subdivision may have met the law, but that it failed to let the neighbors
know what was going on. Mr. Santos stated that he is against the project
and that he feels that it is a bad idea for pipeline and power line access.
Under Planning Department Update, Planning and Community
Development Director Olsen stated that he was ready to submit the
floodplain map revision to the Federal Emergency Management Agency
(FEMA).
A Public Works Department Update was not given.
A Police Department Update was not given.
Mayor Sakrison presented Cory Farnsworth with the Mayor's Student
Citizenship of the Month Award for Helen M. Knight Intermediate
School for January 2006.

Russell Olsen and Clyde Black of Larsen and Peterson and Associates
presented the fiscal year 2004-2005 annual audit of the City of Moab.
Discussion followed.
Mayor Sakrison opened a Public Hearing on Proposed Ordinance #2006-
01 — An Ordinance Amending Section Various Sections of Chapters 1,
2, 16 and 17 of the Moab Municipal Code Relating to Land Use as
Required by State of Utah's 2005 Land Use and Development Act 10-
9a-101 through 10-9a-803 at 7:47 PM.
No public comment was given.
Mayor Sakrison closed the public hearing at 7:48 PM.
Councilmember Sweeten moved to accept a Petition for Annexation for
42.61 acres by Billie Ellis, Moab 21 LLC, and Located at Approximately
400 North South of Apple Lane. Councilmember Stucki seconded the
motion. The motion carried 4-1 aye with Councilmember Bailey voting
nay.
Councilmember Sweeten moved to approve a Request by Tom Lacy for
Modification of Property or Subdivision Lot Lines for Properties located
at 422 and 440 East 100 North. Councilmember Brewer seconded the
motion. The motion carried 5-0 aye.
Councilmember Sweeten moved to approve a Request by Jim
Limpscomb, Prime Capital Corporation, for an Extension of Time to
June 1, 2006 in Which to Construct the Required Public Improvements
for the Moab Commercial Center Subdivision Located at 125 West 200
South. Councilmember Stucki seconded the motion. The motion
carried 5-0 aye.
Councilmember Sweeten moved to approve submission of a Letter of
Map Revision to the Federal Emergency Management Agency (FEMA)
to revise the Mill Creek/Moab Floodplain. Councilmember Stucki
seconded the motion. The motion carried 5-0 aye.
Councilmember Sweeten moved to table the Acceptance of the Fiscal Year
2004-2005 Annual Audit. Councilmember Bailey seconded the motion. The
motion carried 5-0 aye.
Councilmember Stucki moved to Send Proposed Resolution #01-2006 - A
Resolution to amend the 2002 Moab City General Plan, Proposed Roads Map
to Public Hearing. Councilmember Sweeten seconded the motion. The
motion carried 5-0 aye.
Councilmember Brewer moved to Send Proposed Ordinance #2006-02 — An
Ordinance Amending the Moab City land Use Code, Planned Unit
Development , Section 17.66.050 to allow all weather, non -paved driveways
and parking areas, approved by the Public Works Director, that service
Planned Unit Developments with 3 or less dwellings units per acre to Public
Hearing. Councilmember Stucki seconded the motion. The motion carried 5-0
aye.
Councilmember Stucki moved to Send Proposed Ordinance #2006-03 - An
Ordinance Amending Title 17.24, the C-3 Commercial Zone, to Allow Ground
Floor, Multi -Residential, Owner or Renter Occupied Dwelling Units of up to
Eight (8) Per Acre with a Potential Bonus of Ten (10) Additional Dwelling
Units Where 15% of the Bonus Units are Designated as Low to Moderate
Income Housing and where the Developer May Construct Said Units on or
Off -Site, or Contribute to the City Affordable Housing Fund the Cost to
Construct Said 15% of the Affordable Housing Bonus Requirement to Public

hearing. Councilmember Davis seconded the motion. The motion carried 5-0
aye.
Under Reading of Correspondence, Mayor Sakrison stated that he had
received a thank you letter from the Moab Golf Course regarding the
lease amendment. Mayor Sakrison then stated that he had received a
letter from Sue Phillips regarding the Mountain View Subdivision and
that the City had received a grant for $1,500 for tree plantings. Mayor
Sakrison stated that the Trails Mix committee had requested a meeting
with the City, that the fire management plan was available for review at
the Bureau of Land Management (BLM) office and that he had received
a letter from Mr. and Mrs. Carl Jochims congratulating the City on
receiving the Business of the Year Award from the Moab Area Chamber
of Commerce and stating that leash laws need to be followed for
animals.
Under Administrative Reports, City Manager Metzler stated that she
would be receiving a legal opinion from City Attorney McAnany
regarding the affordable housing ordinance and that the annual visioning
workshop had been scheduled for February 9 and 10, 2006. City
Manager Metzler also stated that there would be a Special Council
Workshop on January 31, 2006.
A Goal Update was not given.
Mayor and Council Reports were not given.
Councilmember Stucki moved to pay the bills against the City of Moab
in the amount of $164,012.65. Councilmember Bailey seconded the
motion. The motion carried 5-0 aye by a roll -call -vote.
Mayor Sakrison adjourned the Regular Council Meeting at 8:40 PM.
