HomeMy Public PortalAbout073-1994 - REZONING - 1801 CHESTER BOULEVARDORDINANCE NO. 73-1994 (2nd Reading Amendment) A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 1801 CHESTER BOULEVARD WHEREAS the zoning map designates the property at 1801 Chester Boulevard as R-2 One Family Residence District, and WHEREAS it is desirable to change the zoning designation to R-3 One to Eight Family Residence Special Use District to accommodate the installation of an administrative and business office, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation at 1801 Chester Boulevard, being Auditor's Map No. 46-28-110- 116.000-29, Richmond, Indiana, be and is hereby changed to R-3 One to Eight Family Residence pursuant to Section 1-4.21..U1.U2 (a) (1) and in accordance with the pri and 154.48 of the Zoning Code. The site plan is attached as Exhibit A. The Special Use District does not stand by itself but shall be combined with an existing zoning district. The Special Uses that may be allowed within the Special Use District are specifically enumerated in each zoning district classification. The Richmond City Plan Commission meets on the fourth Tuesday of each month at 7.30 P.M. in the City Council Chambers. The Petition for Rezoning to the Special Use District consists of the following items: A. General Information B. Special Use Standards D. Site Plan All Petitions must be filed complete, in duplicate, by the last Tuesday of each month in order to be placed on the next month's agenda. SPECIALUSE 5_TANDARDS: Article 48 of the Zoning Ordinance sets forth certain standards to be used as guidelinBs by the Plan Commission in considering Special Use District rezoning Petitions. The following is the Petitioner's response demonstrating the manner in which the requested Special Use rezoning complies with said standards: 1. The establishment, maintenance, or operation of the Special Use will not be detrimental to or endanger the public health, safety, morals, convenience, or general welfare for the following reasons: Activity of a professional office will be inside and self -contained — except for any vehicular traffic.�� 2. The Special Use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood for the following reasons: Professional office will be primarily operative in daytime hours only and a substantial part of activity most likely be off -site. 3. The establishment of the Special Use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district for the following reasons: Parcels to the north are presently engaged in permitted uses in R-3 classification and this Special Use will not ede but provide for the continued orderly growth of permitted uses in R-3 classification. 4. Adequate utilities, access roads, drainage, buffering and other necessary facilities will be provided for the following reasons: All utilities are available and in place to the existing structure on the parcel. Parcel is adjacent to U.S. Highway 27. Drainage is to be in accord with attached plan. 5. Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion in the public streets for the following reasons: Existing curb cut will be enhanced to provide driveway to rear of structure to provide parking in accord with ordinance. Ingress and egress will be as designed on attached plat. C. SPECIAL USE NARRATIVE: The Special Use established by Ordinance of the Common Council within the Special Use District shall be limited to that specific Special Use and shall not be altered, converted, modified or substituted in any way without an amendment to said Special Use being granted in accordance with Article 62 of the Zoning Ordinance. The following narrative is the Petitioner's detailed description of the Special Use being requested: Petitioner desires to provide a building and ancillaa facilities to conduct a professional office, insurance agency, on the premises. Minimum renovation will be made to the exterior of the existing structure. However, sufficient paint and alteration will bepro- vided to create an attractive structure. Interior of the existing structure will be altered to provide space for offices of insurance agent and clerical personnel. Insurancepolicies and allied services will be the 2MLuct sold by the occupant of the Special Use remises. Marketing of insurance roducts-will occur primrily off -site and thepro- fessional office provide a base for service to clients as regard coverages and perfecting claims. Please entertain a motion for suspension of rules so the ordinance can be referred to Plan Commission. It has already been advertised for public hearing before the Plan Commission, September 27,1994. This ordinance is a re -zoning of a residential property at 1801 Chester Boulevard from R-2 One Family Residence District to R-3 One to Eight Family Residence Special Use District to permit installation of a professional office in the existing structure. The property is owned by Irvin and Mary Conder who reside at 1662 N.W. L Street. The ordinance should be back to Council on second reading, October 3,1994. Conder and Mary A. Conder, owners; Robert L. O'Maley, agent; requesting a rezoning from R-2 One -Family Residence District to R-3 Special Use District on the property located at 1801 Chester Boulevard, Richmond, Indiana Notices were delivered to seven surrounding property owners, no comments were returned to this office. Planning Staff recommended approval of the request subject to the site plan being made a part of the ordinance. Our Comprehensive Plan Map shows this area to be the southern terminus of a Special Development Area. The future development of Chester Boulevard not only should be, but will be commercial. Such development cannot be kept on hold awaiting needed improvements to the transportation network, therefore the City must take the initiative and plan for proper development and let the improvements follow as the need and INDOT funding programs allow. The Commission voted 8 in favor, none opposed to recommend the passage of Ordinance No. 73-1994 with the site plan attached as Exhibit W.
