Home My Public Portal About085-1994 - SPECIAL ORDINANCE EXPRESSING A PREFERENCE CONCERNINGORDINANCE NO. 85-1994 A SPECIAL ORDINANCE EXPRESSING A PREFERENCE CONCERNING THE SUPPLIER OF ELECTRIC UTILITY SERVICE TO AN AREA RECENTLY ANNEXED TO THE CITY OF RICHMOND WHEREAS, Richmond, Indiana (City) has annexed certain real estate commonly known as the "Northwest Annexation Area," which is more particularly described in Ordinance No. 34-1994 adopted June 6, 1994, and WHEREAS, on August 31, 1994 the City filed a petition with the Indiana Utility Regulatory Commission seeking, pursuant to Indiana Code 8-1-2r3 6� ),_t_o_have the_.portion_of-Ahe_KorAhv -est Annexation a9xea_which- is not currently in the assigned service area of the City's municipally owned electric utility incorporated into such assigned service area, and WHEREAS, one of the factors set forth in Indiana Code 8-1-2.3-6(1) that the Commission must consider before granting the City's petition is the preference of local governmental officials regarding which electricity supplier serves the annexed area, and WHEREAS, the incorporation of the Northwest Annexation Area into the assigned service area of the City's municipally -owned electric utility will be beneficial to the City's municipally -owned electric utility and the ratepayers of its municipally -owned electric utility, and WHEREAS, incorporation of the Northwest Annexation Area into the assigned service area of the City's municipally -owned electric utility is consistent with the policy that the governmental and proprietary services offered by the City and available in an area annexed into the City be substantially equivalent in standard and scope to the services offered by the City in other areas having the same topography, patterns of land use and population density, NOW THEREFORE, BE IT ORDAINED, that the Common Council of the City of Richmond, Indiana, hereby states its preference that the Northwest Annexation Area be incorporated into and made a part of the assigned service area of the City's municipally -owned electric utility and requests the Indiana Utility Regulatory Commission to consider this preference as evidence at the hearing on the City's petition seeking such relief.
