HomeMy Public PortalAbout086-1994 - GENERAL ORDINANCE AMENDING SECTIONS 74.29 AND 74.30ORDINANCE NO. 86-1994 A GENERAL ORDINANCE AMENDING SECTIONS 74.29 AND 74.30 OF THE RICHMOND CODE PERTAINING TO HANDICAPPED PARKING SPACES AND FIRE LANES WHEREAS, Handicapped Parking Spaces and Fire Lanes are in place on both publicly and privately owned streets and parking lots, and WHEREAS, clarifications and uniform sanctions for enforcement are desirable, NOW THEREFORE, be it ordained �y the Common Council ofi the Gay Qf Richmond, Indiana, that Section 74.29 of the Richmond Code be amended to read as follows: (a) The Board of Public Works and Safety may reserve parking spaces on City owned parking lots or City streets for the exclusive use of physically handicapped persons in accordance with Indiana Code 5-16-9. (b) The Board of Public Works and Safety may reserve parking spaces on City streets in residential areas for the exclusive use of a designated physically handicapped person in accordance with Indiana Code 5-16-9. (c) The owners or operators of privately owned parking lots within the City may reserve parking spaces for the exclusive use of physically handicapped persons in accordance with Indiana Code 5-16-9. (d) [replace the letter (b) in the current text of the section.] (e) [replace the letter (c) in the current text of the section.] (f) Designation of parking space for the exclusive use of handicapped persons shall not exempt the spaces nor the vehicles parked in such spaces from any other applicable traffic or parking laws, ordinances and regulations unless so determined by the Board of Public Works and Safety. The owners of a vehicle parked in violation of this section shall be subject to a fine of $50.00 payable in the office of the City Clerk. Be It Further Ordained that Section 74.30 of the Richmond Code be amended to read as follows: (a) It shall be unlawful to park an unauthorized vehicle in any marked fire lane within the City regardless of whether it is located on private or public property. (b) "Unauthorized vehicle" shall mean emergency, fire or police vehicles. MILLIGAN City Attorney This ordinance amends the Handicapped Parking and Fire Lane sections of the Richmond Code in light of enforcement experience. The objective is to clarify the Statement of Violation and designation of privilege. The offense is committed by the owner of the vehicle which is parked in violation of either section. The fine is standardized at $50.00 for both violations. Subsection (c) of Section 74.30 is unworkable and has been stricken in its entirety. Chief Rice and Jan Hibner, representing the Board of Works, will present the ordinance on first reading. This ordinance can be adopted in a single meeting on two motions to suspend the rules.
