HomeMy Public PortalAbout098-1994 -STRICKEN - SPECIAL ORDINANCE ANNEXING TERRITORY CONTOrdinance No. 98-1994 A SPECIAL ORDINANCE ANNEXING TERRITORY CONTIGUOUS TO THE CITY AT THE REQUEST OF THE OWNER THEREOF. WHEREAS Indiana Code 36-4-3-5(a) provides that if the owners of land located outside of but contiguous to a municipality want to have territory containing that land annexed to the municipality, they may file with the legislative body a petition signed by at least 51 percent of the owners of land in the territory sought to be annexed, and requesting an ordinance annexing the area described in the petition, and WHEREAS an ordinance adopted under said section of the Indiana Code must assign the territory annexed by the ordinance to at least one municipal legislative body district, and WHEREAS the owner of 100 percent of the territory described in attached Exhibit A has signed a etition-w-questing-an_ordinaacc.annexing said terdtory.to the City of Richmond, Indiana, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that: A. The territory described in attached Exhibit A is hereby annexed to the City of Richmond, Indiana. B . Said territory shall become a part of Common Council District 4. C. The zoning classification for the territory shall remain M-1 Light Industrial District as it is currently zoned. D. The City Clerk shall publish and file this ordinance pursuant to Indiana Code 36-4-3-7(a). E. This ordinance shall take effect 60 days after its publication. Dear Members of Council: Richmond Industrial Center, Inc. requests voluntary annexation of approximately 120 acres of ground. The land is contiguous to the present corporate boundaries on three sides and lies to the west of the Industrial Parkway. I have enclosed a map showing the location of the land for which annexation is requested. Under the Indiana Code, a petition for voluntary annexation must meet two requirements: 1. The petition must be signed by 510 of all owners, or owners of 75% of total assessed value. The enclosed petition is signed by the owner of 1000 of land and assessed value. 2. The land must be contiguous to the municipality. The enclosed petition is for the annexation of land which is contiguous to the municipality on three sides (with two small exceptions), as shown on the map. Because the annexation ordinance cannot take effect until at least 60 days after its publication, time is of critical importance to the petitioner.
