Members present: Mayor, Wayne Neddermeyer; Councilmembers, Arthur Theis, Thomas Crosby, Nancy Laurent, William Reiser; Clerk, Donna Roehl; Planning and Zoning Administrator, Anne Dorweiler; Attorney, Richard Schieffer Nancy Laurent asked that minutes of February 1,1977; Item 10 Page 99, be changed to: Motion by l�ancy Laurent, seconded by Wayne Neddermeyer Motion by Arthur Theis, seconded by William Reiser to approve the minutes of February 1, 1977, as corrected. Motion carried unanimously 1. KENNETH VOLKENANT Nancy Laurent recommended that Ken Volkenant be hired as a road department employee. Previous experience and employers were discussed. Discussion of pay per hour and changing the pro- bation period from-6 months to 3 months. ichard Schieffer informed council of employees right to a dismissal hearing if a permanent employee. Motion by Thomas Crosby, seconded by Nancy Laurent to employ Ken Volkenant at $4.00 per hour, subject to 6 month probation with reviewal after 3 months of salary and whether to continue the probation an additional 3 months. Motion carried unanimously 2. MINNEHAHA CREEK WATERSHED DISTRICT Nancy Laurent stated that she had contacted John Holmquist of Minnehaha Creek Watershed as to projects that they might consider funding. Mr. Holmquist informed her that if a project were to cost from $1000 to 32500 they might consider funding. Discussion of the previous ditch cleaning project that had been submitted. Lyle Swanson stated that it would cost them approximately *100 to check the project. Motion by Nancy Laurent, seconded by Arthur Theis to instruct the engineer to check the Tamarack Dr. ditching project at a cost not to exceed $100. Motion carried unanimously Motion by Thomas Crosby, seconded by 4illiam Reiser to apply for $2500 from Minnehaha Creek Watershed District for ditch and culvert work near Tamarr.ck Dr., pending satisfactory engineers report and securing the proper easements. Motion carried unanimously 3. MAIN STREET VACATION 8:10 P.M. Lyle Swanson stated, by letter, that the street would not be needed for sewer and water lines and that all properties are served by other streets,so they would have no objection from an engineering standpoint to vacate the street. Ron Duran, road supervisor, offered no objection. It was noted that the original plat had dedication to the public regarding all of the streets in the Independence Beach plat. Motion by Arthur Theis, seconded by William Reiser to close the Public Hearing. Motion carried unanimously Hearing closed at 8:15 P.M. Motion by Nancy Laurent, seconded by Arthur Theis to adopt Resolution 77-4 allowing for vacation of a portion of Main Street, Independence Beach, Hennepin County. Motion carried unanimously 4. NORTHWEST CINEMA CORPORATION Discussion of theatre license application from Northwest Cinema Corporation for 1977. Police Chief Hoover stated that progress had been made in policing their grounds and that the police had received less calls toward the end of the 1976 season. Discussion of the sewage treatment plant that was to have been removed. Motion by Nancy Laurent, seconded by William Reiser to table approval of the license pending clean-up of the sewage treaement plant. Motion carried unanimously 5. METROPOLITAN COUNCIL 1 0 9 Motion by Wayne Neddermeyer seconded by Arthur Theis to have Thomas Crosby be the contact person with the Metro Council regarding the forthcoming systems statement. Motion carried unanimously 6. REVENUE SHARING REPORTS Motion by Arthur Theis, seconded by Nancy Laurent to accept the Revenue Sharing Actual Use Report No. 7. Motion carried unanimously Motion by Thomas Crosby, seconded by Nancy Laurent to accept statement of assurances for entitlement period No. 8, for Revenue Sharing Funds. Motion carried unanimously 7. ANNE DORWEITgR Charles Pangier Anne Dorweiler stated that Mr, rangier was applying for a variance to construct a house on Lots 10 and 11, Block 7, Independence Beach. The garage plans indicate a 20 ft. set -back and it should be 50 ft. Discussion of the lot combination agreement whereby Mr. Pangier received 2 assessments,one for his house which is on 2 lots and the other for the remaining lots, ne now wishes to combine 2 lots leaving one vacant without an assessment. Discussion of combining the vacant lot with the 1 lot of his neighbor or combining the 3 lots into two 90 ft. lots. Richard Schieffer stated that Mr. Pangier should decide what he wishes to do and make application accordingly. Mr. Pangier stated that he would attempt to negotiate with his neighbor to buy his property and if he could not would inform the city as to how he intended to combine the lots. Richard Schieffer stated that he would prepare the necessary papers after hearing from Mr. Pangier. Louis Rammerschmidt Discussion of Mr. Hamm.erschmidts application for a variance to construct a house on Lots 9 End 10, Block 20, Independence Beach. House to be less than 50 feet from the lot line. Motion by Arthur Theis, seconded by William Reiser to adopt Resolution 77-5, allowing con- solidation of lots 9 and 10, Block 20, Independence Beach; to waive the combination fees and grant the variance. Motion carried unanimously Midland Nursery Mr. Harvey Foss presented plans to construct a 40' x 100' nursery warehouse and an office on 8.5 acres on Hwy. 55. Anne Dorweiler reported that the Planning Commission had approved the plans subject to approval from the Elm Creek Conservation District. She presented an overlay from the Hennepin County Soil Conservation Service which indicated a high water table in the area in which they had planned their sewage disposal system. Lyle Swanson stated that the owners should design a. system and submit it to his office for approval. Motion by Nancy Laurent, seconded by Thomas Crosby to approve Resolution 77-6 approving of Midland Nursery plans contingent upon completion of the items listed. Motion carried unanimously Frieburger Property Gary Lindgren appeared seeking information regarding development of the Freiburger property at Independence Beach. Discussion of various aspects of development, street vacation and con- struction and connection to the existing sewer and water project. Motion by Thomas Crosby, seconded by lyancy Laurent to conceptually approve connection to the sewer and water according to preliminary diagram; subject to payment by developer of all costs of providing sewer and water to lots and paying a hook-up charge to compensate for providing fewer and water to the location. Also to recommend that detailed planning be done with the Tanning Commission. lotion carried unanimously 8. BILLS Motion by William Reiser, seconded by Arthur Theis to pay the bills; Payroll # 4403-4409 in the amount of $2391 47 Motion carried unanimously l (14. STAFF ATTENDANCE AT MEETINGS, ETC. Discussion of staff and committee members attending meetings. Consensus was to deal on an individual basis with all requests to attend meetings. Motion by Nancy Laurent, seconded by Arthur Theis to pay fees of $25.00 each for three Planning Commission members to attend the Planning and Zoning Institute. Motion carried unanimously 10. Community Development Block Grant Funds Discussion as to how to distribute the additional funds made available through the Block Grant Program. Motion by Thomas Crosby, seconded by Arthur Theis to Okoportionately increase the previously approved projects amounts. Motion carried unanimously Discussion of Medina becoming a member of the Minnesota'_Housing Finance Agency in order to provide for grants and loans for home improvements. Motion by Thomas Crosby, seconded by Arthur Theis to approve Resolution 77-7 regarding part- icipation in the MHFA. Motion carried unanimously 11. NORTHWEST SUBURBAN CHAMBER OF COMMERCE Wayne Neddermeyer gave several resons for Medina not joining the Chamber of Commerce in 1977. Motion by Wayne Neddermeyer, seconded by William Reiser not to pay the 1977 dues to the Chamber of Commerce. Motion carried unanimously 12. CRIMINAL JUSTICE SEMINAR Thomas Crosby explained that Hennepin County will set up a community meeting comprising several of the neighboring communities to explain the Criminal Justice System. 13. COMMUNITY NURSING SERVICE Motion by Thomas Crosby, seconded by Wayne Neddermeyer to recommend that we do not pur- chase additional services from Suburban Health Nursing Service for 1977. Motion carried unanimously 14. MEDINA TRAIL SYSTEM Thomas Crosby stated that Bob McCrea had agreed to serve on a committee but did not wish to be chairman. In view of the fact that the Metro Council will be discussing a regional trail plan on March 3rd. Mr. Crosby asked that the item be discussed thoroughly at the March 1st. meeting. 15. CHESTNUT ROAD Thomas Crosby informed members that Morris Holmberg had withdrawn his road dedication plans after being informed that he would have to complete the necessary paper work and that the road would need to be brought up to city standards by property owners before being maintained by the city. 16. VOCATIONAL TECHNICAL SCHOOL Thomas Crosby asked that the Vo Tech School be put on the March 1st agenda so that Council could discuss what they wished to do about the Vo Tech question. 17. REITH VOGLER Mr. Vogler discussed the possibility of obtaining a dance permit for "T.Arthur's". Be has taken over the business and is attempting to eleminate some of the problems. Police Chief Hoover stated that he would need to wait and see if the problems are solved before he could approve the application. Motion by Thomas Crosby, seconded by Arthur Theis to table the matter until the police department can recommend that a license be issued. Motion carried unanimously 18. SALARIES 105 Sewer and Water Department Discussion of Zeo Leuer's letter requesting a 15% increas in salary and .15 per mile travel expense or the purchase of a pickup truck. Motion by Thomas Crosby, seconded by William Reiser to pay Leo Leuer $715 pet month salary and $85.00 per month auto expense, retroactiOg to January 1, 1977. Motion carried unanimously Clerk Motion by Wayne Neddermeyer, seconded by Arthur Theis to pay Sylvia Rudolph $3.50 per hour for office held and if she wishes to be included in PERA and Social Security she make take that amount in lieu of the 250 per hour raise. Increase retroactive to January 1, 1977. Motion carried unanimously Motion by Thomas Crosby, seconded byWilliam Reiser to pay Donna Roehl, Clerk, $470 per month retroactive to January 1, 1977. Motion carried unanimously Thomas Crosby stated that he had discussed the hiring of a City Manager with Dean Lund of League of Minnesota Cities and Mr. Lund would be willing to attend a meeting and dxplain the process. Planning and Zoning Administrator Thomas Crosby stated that he would talk with Anne Dorweiler regarding her salary proposal. Wayne Neddermeyer asked that the per meeting charge be changed to an hourly rate. 19. 911EMERGENCY NUMBER Motion by Arthur Theis, seconded by Thomas Crosby to=lpprove Resolution 77-8 approving Medina's participation in the Hennepin County 911 emergency number program.
