For the good and valuable consideration of the City of McCall agreeing to defer the
connection of 928 Flynn Lane, McCall, ID, legally described as:
Lots 14 and 15, of Flynn Subdivision according to the official plat in the Office of
the Recorder, Valley County, Idaho, recorded November 12, 1971 as Instrument No.
75084, in Book 3 of Plats at Page 49 (the "property")
to the City of McCall domestic water system and recording a Release of that obligation of record in
order to allow Patricia Marie Wilcox to obtain a loan on the property, the parties hereto covenant and
agree with the City of McCall as follows, to -wit:
1. No later than August 31, 2023, the undersigned parties will have caused the property
to be connected to the City of McCall potable water system.
2. That a portion of the proceeds from the loan to be obtained on the property will be
used to effect the connection.
3. Upon connection, the parties will disconnect the private well on the property from the
household domestic water supply.
4. The disconnected private well can still be used on the property for landscape
irrigation only.
5. In the event the undersigned fail to comply with the provisions of this agreement, the
undersigned, jointly and severally, agree to pay a civil penalty of $100.00 per day for each day from
and after September 1, 2023 until all the terms and conditions of this agreement have been met by
the undersigned.
IN WITNESS WHEREOF, the parties have executed this Agreement and made it effective
reinabove provided.

KNOW ALL MEN BY THESE PRESENTS: That the CITY OF McCALL, for good and valuable
consideration, does hereby certify and declare the letter dated June 3, 2019 from the City of McCall
addressed to Patricia M. Wilcox recorded as Instrument No. 421082, in the office of the County
Recorder of Valley County, State of Idaho, on the 5th day of June, 2019, is hereby released and
discharged as to the following described property, to -wit:
