HomeMy Public PortalAboutRES 90/05ARESOLUTION NO. 90 -5A A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, AUTHORIZING THE MAYOR TO TRANSMIT THE TOWN'S RESPONSES TO FINDINGS MADE BY THE PALM BEACH COUNTYWIDE PLANNING COUNCIL AS TO MAPPED POTENTIAL INTERJURISDICTIONAL INCOMPATIBILITIES BETWEEN THE TOWN'S ADOPTED COMPREHENSIVE PLAN AND THE ADOPTED COMPREHENSIVE PLANS OF ADJACENT LOCAL GOVERNMENTS AND AS TO POTENTIAL INTERJURISDICTIONAL INCOMPATIBILITIES BETWEEN THE GOALS, OBJECTIVES AND POLICIES IN THE TOWN'S ADOPTED COMPREHENSIVE PLAN AND THE PLANNING COUNCIL'S ADOPTED FUTURE LAND USE POLICIES. WHEREAS, pursuant to Section 7.8 of the Palm Beach County Charter, the Palm Beach Countywide Planning Council has advised the Town of Gulf Stream of its findings in regard to mapped potential interjurisdictional incompatibilities between the Town's adopted Comprehensive Plan and the adopted comprehensive Plans of adjacent local governments; and WHEREAS, the Town of Gulf Stream has reviewed the findings of the Countywide Planning Council; and WHEREAS, Section 7.8 of the County Charter provides that affected local governments shall be given an opportunity to respond in writing to the Planning Council regarding mapped potential incompatibilities. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, as follows: Section 1. The Mayor is hereby authorized to transmit to the Palm Beach Countywide Planning Council the attached responses to the Planning Council's findings of mapped potential interjurisdictional incompatibilities. Section 2. The Mayor is hereby authorized to inform the Countywide Planning Council that the Town will not respond at this time to the Planning Council's findings of potential interjurisdictional incompatibilities regarding the goals, objectives and policies in the Town's adopted Comprehensive Plan, and further that the Town questions whether the Planning Council has the authority to independently compile policy statements and require a municipality to expend time and financial resources to respond to said policy statements. Section 3. This Resolution shall take effect immediately upon its adoption. Attahced are completed Mapped Potential Interjuris- dictional Incompatibility Resolution Tables related to interjurisdictional incompatibilities associated with land use classifications as designated by the Town of Gulf Stream and adjacent local governments. As to the obligation to respond to the numerous Policy Potential Interjurisdictional Incompatibility Findings, at this time the Town of Gulf Stream declines to commit the time and public funds to address the same. The Town of Gulf Stream has expended substantial resources to date pursuant to its obligations under Fla. Stat. Ch. 163. The Comprehensive Plan of the Town of Gulf Stream was initially found not in compliance pursuant to Chapter 163 by the State of Florida Department of Community Affairs. The Town is currently proposing amendments to its comprehensive plan pursuant to a Stipulated Settlement Agreement to resolve disputed issues of fact and law between the Town and the Department of Community Affairs. Accordingly, it is the position of the Town that until such time as its plan is found in compliance by the Department of Community Affairs, responding to the alleged Policy Potential Interjurisdictional Incompatibility Findings is premature. Annunziato, Executive Director RE: Findings of Interjurisdictional Incompatibilities September 11,1990 Page 2 Further, the Town questions the underlying authority of the Palm Beach Countywide Planning Council to independently compile its own list of policy statements and require a local government to commit extensive time and financial resources to respond to the same. The charter provision authorizing the formation of the Palm Beach Countywide Planning Council mandates a compilation of land use elements as promulgated by each local government within Palm Beach County. It is respectfully suggested that the policy statements of the Planning Council exceed the mission assigned to the Planning Council as well as the underlying authority provided the Planning Council by voter referendum. Please advise if additional information is necessary regarding the above.
