A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 2100, 2104,
2112 and 2116 CHESTER BOULEVARD
WHEREAS the zoning map designates parts of the southeast quarter of section 20,
township 14 north, range 1 west, located at 2100, 2104, 2112 and 2116
Chester Boulevard, Richmond, Indiana, as R-2 One Family Residence District,
and,
WHEREAS it is desirable to change the zoning designation to R-4 Multi -Family Residence
District Special Use to enable the owners to construct medical and dental offices
or clinics as permitted by Article 23.014 of the Zoning Code,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation of the real estate described in attached Exhibit A be and is hereby
changed to R-4 Multi -Family Residence District Special Use subject to the conditions set forth in
attached Exhibit B for 2100 and 2104 Chester Boulevard and the conditions set forth in attached
Exhibit C for 2112 and 2116 Chester B ulevard.
Passed and adopted this day o 1993, by the Common Council of the City of
Richmond, Indiana.

Part of the South half of the Southeast Quarter of Section Twenty (20), Township Fourteen (14)
Range one (1) West, described as follows:
Beginning at a point three hundred thirty-eight and four hundred twenty-five thousandths
(338.425) feet South of the northeast corner of said South Half, thence West five hundred forty-
eight and eighteen hundredths (548.18) feet to a stake; thence South one hundred thirty-eight and
four hundred twenty-five thousandths (138.425) feet to a stake, thence East five hundred forty-
eight and eighteen hundredths (548.18) feet to the center of the Richmond Newport Turnpike;
thence North to the place of beginning, containing one and seventy-five hundredths (1.75) acres,
more or less.

Please advise the members of Richmond Common Council that the Richmond Advisory Plan
Commission conducted a public hearing, Tuesday, February 23,1993, on the petitions of Heritage House
of Richmond, by Robert L. Bever, Agent for the rezoning of 2100 and 2104 Chester Boulevard and
Domingo L. Ang by Jeff Hanna, Agent for the rezoning of 2112 and 2116 Chester Boulevard from R-2 One
Family Residence District to R-4 Multi -Family Residence District Special Use to accommodate the
construction of medical and dental offices or clinics as permitted by Article 23.014 of the Zoning Code.
Letters were sent to adjoining property owners for both tracts which are separated by the existing
dental office of Dr. Delynn W. Stults at 2108 Chester Boulevard. No persons appeared in opposition to
the proposed rezoning.
Mr. Bever explained that Doctors William J. Niemes and Charles L. Johnson are purchasing 2100 and
2104 from Heritage House and will develop three medical/dental office buildings.
Mr. Hanna explained that Dr. Ang plans to construct two medical office buildings on the tract at 2112
and 2116.
Planning staff recommended approval of both rezoning petitions which have been combined into a
single ordinance because they present identical fact situations at virtually the same location. Member
Len Clark moved the adoption of a recommendation in favor of the re -zoning subject to the developers
making every effort to retain the large trees currently situated near Chester Boulevard and drainage
plans being approved by the City Engineer.
There also was discussion about the use of common curb cuts rather than the separate driveways that
now complicate ingress and egress to Chester Boulevard. The commission was advised that the curb cuts
were the jurisdiction of the Indiana Department of Transportation.
Plan Commission voted unanimously to recommend passage of Ordinance No.14-1993.
