A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 3641 EAST
MAIN STREET
WHEREAS the zoning map designates a part of the northwest quarter of section 2,
township 13 north, range 1 west, containing 14.337 acres, more or less,
located at 3641 East Main Street, Richmond, Indiana, as R-4 Multi -Family
Residence District, and
WHEREAS it is desirable to change the zoning designation to C-2 Commercial District,
to accommodate anticipated commercial development of the area,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation of the real estate described in attached Exhibit A be and is hereby
changed to C-2 Commercial District.
Passed and adopted this day o c, 1993, by the Common Council of the City of
Richmond, Indiana.

Being a part.of the Northwest Quarter of Section 2, Township
13 North, Range 1 West in Wayne Township, Wayne County,
Indiana, and being more particularly described as follows,
Beginning at the southwest corner of the Southwest quarter of
Section 35, being 81.46 feet north 89 degrees, 50 minutes and
58 seconds east of the northwest corner of the Northwest
Quarter of said Section 2 and being in the centerline of
proposed Elks Country Club Road extension, and running thence
north 89 degrees, 36 minutes and 04 seconds east, along the
north line of said Northwest Quarter, 800.13 feet to a point;
thence south 00 degrees, 15 minutes and 24 seconds east,
792.42 feet to the centerline of the extension of proposed
South "A" Street; thence south 89 degrees, 59 minutes and 58
seconds west, along said proposed South "A" Street extension,
732.62 feet to said centerline of proposed Elks Country Club
Road extension; thence north 09 degrees, 39 minutes and 52
seconds west, along said centerline of proposed Elks Country
Club Road extension and along a 954.93 foot radius curve to
the right, a chord which bears north 9 degrees, 39 minutes and
52 seconds west a chord distance of 320.63 feet; thence north
00 degrees, 00 minutes and 22 seconds west, along said
centerline, 421.84 feet to the place of beginning, containing
an area of 14.337 acres.

Please advise the members of Common Council that the Richmond Area Plan Commission conducted a
public hearing Tuesday, February 23, 1993, on the petition of Dorothy Thorman et al represented by
Gayle W. Gardner, Agent, requesting the rezoning of 14.337 acres at 3641 East Main Street from R4
Multi -Family Residence District to C-2 Commercial District to accommodate anticipated commercial
development of the area.
Letters were sent to adjoining property owners and no persons appeared in opposition to the request.
Mr. Gardner explained that a bowling alley was proposed for the north portion of the tract but no
binding agreement was in place at this time.
Discussion was held regarding the construction of South 37th Street to the west of the tract and the
intense commercial activity already in the area with the Kroger and Wal-Mart Stores.
Member Shirley Rogers expressed concern about the drainage in the area and it was explained that two
retention basins are already in place to slow down the run-off of storm water.
The planning staff recommended approval because commercial use is obviously the highest and best use
of the area.
The Commission voted nine to one in favor of the proposed rezoning and recommends passage of
Ordinance No. 15-1993.
