Home My Public Portal About016-1993 - VACATION - SIDEWALK ON THE EAST SIDE OF NORTH 13TH S002758 93HA 4 PH 3:26 ORDINANCE NO. 16-1993 A SPECIAL ORDINANCE VACATING A SIDEWALK ON THE EAST SIDE OF NORTH 13TH STREET BETWEEN NORTH F STREET AND THE NORFOLK AND WESTERN RAILROAD RIGHT-OF-WAY WHEREAS Devon Realty Corporation haspetitioned the Common Council of the City of Richmond, Indiana, requesting vacation of a sidewalk on the east side of North 13th Street between North F Street and the Norfolk and Western Railroad Right - of -Way, and WHEREAS The Common Council, pursuant to I.C. 36-7-3-12 conducted a public hearing on said petition March 1, 1993, and WHEREAS A public hearing pursuant to R.C. 155.04(B) was conducted by the Richmond Advisory Plan Commission, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, the public right-of-way described below is hereby vacated: A certain sidewalk, 15 feet in width, contiguous to the west ends of lots 468 through 471 in Elizabeth Starr's 2nd Addition to the City of Richmond, Indiana. GOODWIN Director The Richmond Advisory Plan Commission conducted a public hearing on Tuesday, February 23, 1993 on the petition of Devon Realty Corporation, owner; Donald Simkin, agent; requesting that a part of the right-of-way of North 13th Street be vacated. Specifically, the petitioner is requesting that the eastern most 15 feet of right-of-way for North 13th Street, from North F Street south to the right-of-way of the Norfolk and Western Railroad, be vacated. This area generally appears as the sidewalk along the east side of North 13th Street, and includes all that area from the curb to the building line. Letters have been received from the five utilities confirming that each utility does not object to the vacation of the subject right-of-way. Planning Staff recommended approval of the vacation request based on the following: Property on both sides of the right-of-way in question is owned by the petitioner and there is very little pedestrian use of the sidewalks. Previously, fifteen feet of right-of-way on the east side of North 13th Street, from the railroad right-of-way south to North E Street was vacated to enable an expansion of manufacturing facilities, on property which is not owned by the petitioner. Vacation of the said right-of-way would have no adverse effect upon the surrounding properties and neighborhood. Plan Commission voted ten in favor, none opposed, to recommend approval of this request to Common Council. Respectfully submitted, Robert B.
