A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 2105 AND 2109
CHESTER BOULEVARD
WHEREAS the zoning map designates a part of the southwest quarter of Section 21,
Township 14 north, Range 1 west, containing 1.35 acres, more or less, located
at 2105 and 2109 Chester Boulevard, Richmond, Indiana, as C-2 SU
Commercial District Special Use for construction of a pharmacy as part of a
Planned Unit Development under Article 45 of the Zoning Code, and
WHEREAS it is desirable to change the zoning designation to C-2 Commercial District to
accommodate the establishment of two restaurants which are permitted by
Article 31.003 (16) of the Zoning Code and modify the Planned Unit
Development heretofore approved in order to implement a new traffic plan,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation of the following described real estate be and is hereby changed to C-2
Commercial District, to wit:
A part of the southwest quarter of Section 21, Township 14 North, Range 1 west, Wayne
County, Indiana, more particularly described as follows:
Commencing at a 3/4" dia. I.P. at the northwest comer of the southwest quarter of Section
21, Township 14 north, Range 1 west; thence south 00 degrees 00 minutes 00 seconds west
on the west line of said quarter and the centerline of Chester Boulevard, 1307.87 feet, to a
3/4" dia. T.P. found in the concrete median; thence north 89 degrees 50 minutes 13 seconds
east, 40.00 feet to a 5/8" capped rebar on the east line of Chester Boulevard and the point of
beginning, thence continuing north 89 degrees 50 minutes 13 seconds east, 245.00 feet to a
5/8" capped rebar, thence south 00 degrees 00 minutes 00 seconds west, parallel with the
west line of said quarter section, 245.61 feet to a 5/8" capped rebar on the north line of Engel
Drive, thence along said north line the following 3 courses; south 89 degrees 50 minutes 13
seconds west, 85.06 feet; north 82 degrees 34 minutes 06 seconds west, 75.66 feet; south 89
degrees 50 minutes 13 seconds west, 59.84 feet, thence along a curve to the right, said curve
having a radius of 25.00 feet, the radius point for which lies north 00 degrees 09 minutes 37
seconds west, thence along said curve 39.34 feet to a point which lies south 89 degrees 50
minutes 13 seconds west of said radius point, said point also being on the east line of Chester
Boulevard, thence north 00 degrees 00 minutes 00 seconds east, on said east line, 210.54
feet to the point of beginning, containing 1.350 acres more or less.
Be it ftuther ordained that the Planned Unit Development heretofore approved for subject real estate
be amended to limit the use of the curb cut onto Chester Boulevard to northbound exiting vehicles
only and that a cross -over driveway be constructed between the Cox Supermarket parking lot on
the southern boundary of the Planned Unit Development parcel to the south edge of Engle Drive.
Passed and adopted this 5th day of April, 1993 by the Common until of the City of Richmond,
Indiana.

Dear Ms. Lundy:
Please advise the members of Common Council that the Richmond Advisory
Plan Commission conducted a public hearing, Tuesday, March 23, 1993, on
the petition of Bartlemay Realty, Inc.; by David York, Foster Engineering,
Agent; for rezoning 2105 and 2109 Chester Boulevard from C-2 Special
Use to C-2 to accomodate the construction of two restaurants.
Immediate plans are for construction of a 64 seat Taco Bell restaurant
and a Hot 'N Now drive-thru only restaurant.
Notices were mailed to adjoining landowners and no persons appeared in
opposition to the petition.
The planning staff recommended approval with the following stipulations
being made a part of the ordinance:
1) The rezoning be changed to C-2 Special Use for two restaurants;
2) The curb cut onto Chester Boulevard be limited to a northbound
exit only; and
3) A cross -over be constructed between the Cox Supermarket site
and the southern boundary of the overall PUD parcel under control
of Bartlemay Realty, Inc.
The Commission voted 9 in favor, none opposed to recommend the passage
of Ordinance No. 21-1993.
