MINUTES
The City Council of Medina, Minnesota met in regular session on
February 15, 1994 at 7:30 p.m. in the City Hall Council Chambers.
Present: Council Members James Johnson, Ann Thies, Philip Zietlow
and Mayor Anne Theis.
Absent: Council Member John Ferris.
Also Present: Police Chief Rick Rabenort, Public Works Director
Jim Dillman, City Engineer Shawn Gustafson, Zoning
Administrator Loren Kohnen, City Attorney Ron Batty
and Clerk -Treasurer Jeff Karlson.
1. ADDITIONS TO THE AGENDA
Moved by Mayor Theis, seconded by Thies, to approve the addition of
the following agenda items:
a. Authorization to Advertise for Public Works Position
b. Discussion of Aerial Deer Count
c. Executive Session to Consider Amended Condemnation Resolution
Motion carried unanimously.
2. CONSENT AGENDA
Moved by Thies, seconded by Johnson, to approved the consent
agenda, as follows:
a. Resolution No. 94-7, "Resolution Denying Request from Fred
Keller for Amendment to Comprehensive Plan"
b. Resolution No. 94-8, "Resolution Establishing 1994 Fee
Schedule"
c. Approval of Performance Appraisal Form
Motion carried unanimously.
3. MINUTES
Moved by Thies, seconded by Mayor Theis, to approve the minutes of
the regular meeting of February 1, 1994, as presented.
Motion carried unanimously.
4. ASSESSMENT HEARING FOR SEWER LATERAL TO MEANDER ROAD
Mayor Theis opened the public hearing at 7:35 p.m. to consider
objections to the proposed assessments for a sewer lateral to serve
the five existing homes south of Meander Road and west of County
Road 116.
City Attorney Ron Batty said the purpose of the hearing was to
receive input from property owners who benefitted from the project.
Batty pointed out that the project had not been ordered yet. Batty
said in order for an owner of property to reserve the right to
appeal the assessment, the following three conditions had to be
met: (1) owner must file written objection before the close of the
hearing; (2) assuming that the council adopts the assessment roll,
the owner must file a notice of appeal with the mayor or city clerk
within 30 days after the adoption of the assessment roll; and (3)

owner must file the appeal with the district court of Hennepin
County within 10 days after service upon the mayor or city clerk.
City Engineer Shawn Gustafson said the proposed improvement
consisted of an extension of an 8-inch sanitary sewer lateral line
off of the 12-inch trunk sewer line being constructed to serve the
Lundgren Brothers development north of Highway 55. Gustafson said
MPCA regulations required that the lateral line be a minimum of 8
inches in width. The total project cost was estimated at $55,855.
The assessment for each homeowner ranged from $11,922 to $12,802.
Dale Hendrickson, 825 Meander Road, asked what the typical average
cost is to hook up to city sewer.
Gustafson said a typical assessment for sewer was around $5,000 per
lot, but because of the distance of the lateral, the topography and
the low number of lots, the assessments were considerably higher
for this project.
Jim Johnson asked what the cost would be to replace a septic
system.
Jim Dillman estimated that it would cost a homeowner about $8,500
for a mound system.
Hendrickson asked if they would be assessed for the main trunk line
if the sewer lateral was not constructed.
Ron Batty said the five property owners would not be assessed for
the trunk line until sanitary sewer became available to them.
Phil Zietlow asked if there was any advantage to doing the project
now instead of in the future.
Gustafson said there was really no advantage except that the city
needed to acquire an easement from Wally Doerr for the lateral.
Gustafson said it would be easier to obtain the easement before the
area is developed.
Hendrickson said each of the property owners would like some relief
on the assessment. He said they were all in favor of the project
but objected to the cost.
Phil Zietlow said the city had never subsidized a property owner
for sewer service.
Jim Johnson asked Zoning Administrator Loren Kohnen if all the
homeowners had suitable secondary sites for their septic systems.
Kohnen said some did but not all of them. Kohnen verified that it
cost around $8,500 to replace a septic system.
Dick Theis, 805 Meander Road, said the biggest issue was the land

behind them which was zoned commercial/industrial. Theis said the
land should be zoned residential so that it could be developed and
sewer could be brought in to serve everyone in the area.
Zietlow said development would not occur in this area for at least
five years and certainly not in three years.
Johnson asked what they were willing to pay for the project.
Dick Theis said the city should be willing to absorb some of the
cost by deducting at least $5,000 off each assessment.
Zietlow said if the council went along with this, everyone else in
Medina would have to pay for the sewer line.
Mayor Theis posed the question: If this project does not go
forward, would a stub be placed on the sewer pipe so that a
lateral could be extended in the future?
Gustafson said a drop section would have to placed outside of the
manhole. Gustafson said there was no reason to add the drop
section if the lateral was not added.
Moved by Mayor Theis, seconded Johnson, to close the public hearing
at 8:40 p.m.
Motion carried unanimously.
Moved by Zietlow, seconded by Thies, to not move forward with the
proposal to extend sewer lateral to Meander Road; and to direct
City Engineer Shawn Gustafson to proceed with the acquisition of an
easement from Wally Doerr.
Motion carried unanimously.
5. APPOINTMENT OF PARK COMMISSIONER
Moved by Thies, seconded by Zietlow, to approve the appointment of
John Winston, 3505 County Road 19, to the Park Commission for a
term of three years, commencing February, 1994 and ending January,
1997.
Motion carried unanimously.
6. CREATION OF TASK FORCE TO STUDY LORETTO SEWER PROBLEM
Jim Dillman said the City of Loretto wished to meet with
representatives from Medina to form a task force to study the
Loretto sewer problem.
Moved by Mayor Theis, seconded by Thies, to establish an
information gathering task force to meet with the City of Loretto
regarding their sewer problem and to appoint Council Member Phil
Zietlow, Public Works Director Jim Dillman and City Engineer Shawn
Gustafson as Medina's representatives.
Motion carried unanimously.
7. TWINCO PLAT
Ron Batty said Twinco was asking for an extension for filing their

final plat. Batty said according to the ordinance, once a final
plat has been approved, the applicant has 60 days to file the plat.
Batty said the council can grant up to another 180 days if there is
good cause to do so. Twinco's 60-day filing period expired
February 22, 1994. Batty said Twinco owed the city $7,905.58 for
zoning fees and a park dedication fee.
Moved by Johnson, seconded by Thies, to grant a 75-day filing
extension to Twinco with the condition that the fees be paid in
full by February 16, 1994.
Motion carried unanimously.
8. HAMEL LIONS' FLEA MARKET
Ron Batty said the Hamel Lions needed to request an amendment to
their conditional use permit to include the use of the Cates
property at 300 T.H. 55. Batty said a question was raised last
year as to the legality of the Hamel Lions flea market on the Cates
property when a request for an "auto flea market" at the same
location was rejected.
Batty said the urban industrial/commercial districts allowed all
the conditional uses permitted in the rural commercial district.
Among the uses allowed by CUP in the rural commercial district were
auto sales, open sales lots, and supply yards. Batty pointed out
that a "flea market" was not mentioned specifically as a permitted
or conditional use but was close enough to an "open sales lot" to
allow it to be permitted. Batty said according to the ordinance a
distinction could be made between an auto flea market and a flea
market because the auto flea market involved overnight storage. He
added that the Lions° existing CUP was valid as long as the
conditions were being met.
Batty recommended that the Lions Club apply for an amended CUP with
the Medina Ballroom and Cates acting as co -applicants. Batty also
felt that the issue of allowing rural uses in an urban area should
be revisited.
9. PROPOSED CHANGES TO MOHAWK DR. AND MORGAN RD.
Jim Dillman presented a proposal to change Mohawk Drive and Morgan
Road in order to make the roads safer. Dillman said one
alternative would be to close Mohawk Drive past city hall and
construct a driveway from the police parking lot for access to
Medina Road. Dillman said this would provide better visibility and
would flatten out a vertical curve. He estimated that it would
cost around $6,400 to construct the driveway and pave it.
Phil Zietlow asked Dillman if he had any idea what the traffic
counts were on Mohawk Drive.
Dillman said the traffic was not significant.
Zietlow said the idea should be put on hold until the residents
have had an opportunity to address the issue.

Dillman said a possible solution to improve Morgan Road would be to
move the road to a point where it would intersect with Medina Road
at the top of the hill. Dillman said the city would have to
acquire right-of-way from Bob Roehl.
Mayor Theis asked Dillman to talk to Bob Roehl about the city's
interest in acquiring right-of-way on his property.
10. AUTHORIZATION TO SELL ROAD EQUIPMENT
Moved by Johnson, seconded by Mayor Theis, to authorize the
placement of an advertisement in the city's official newspaper for
the sale of a 1951 Ford water truck and a 1975 Ford dump truck.
Motion carried unanimously.
11. HIGHWAY 12 ALTERNATIVES
Ann Thies talked about the latest alternative being discussed by
the Minnesota Department of Transportation to ease Highway 12
commuter traffic in Orono and Long Lake. Theis said the latest
proposal was to funnel traffic around Long Lake onto County Road 6
just south of the Medina border and Watertown Road south of Highway
12. Thies said the traffic flow on County Road 6 would increase
traffic in Medina. Thies said the council needed to take an
official position on the plan to reroute traffic onto County Road
6. She added that the council had adopted a resolution three years
ago stating its objection to the proposed northern corridors being
considered which included County Road 11 and T.H. 55.
Phil Zietlow said the council should have numbers to verify the
traffic impact that County Road 6 would have on Medina streets to
confirm that this was not the best solution.
Thies suggested that a resolution be drafted using the numbers from
traffic counts contained in the Scoping Document of the T.H. 12
Corridor Study.
12. PRAIRIE ISLAND NUCLEAR PLANT
The City of Red Wing submitted a written request seeking support in
their attempt to gain approval from the State Legislature for the
temporary storage of spent nuclear fuel by Northern States Power at
their Prairie Island Nuclear Power Plant in Red Wing. Red Wing's
concern was that it would lose a large portion of its tax base if
the plant was shut down.
Jim Johnson said he did not feel comfortable going on record as
supporting the storage of nuclear waste without knowing more about
the proposal.
Moved by Thies, seconded by Mayor Theis, to adopt "Resolution
Supporting Legislation to Allow for the Temporary Storage of Spent
Fuel by Northern States Power at their Prairie Island Nuclear Power
Plant."
Ayes: Thies and Mayor Theis. Nays: Johnson and Zietlow.
Resolution failed on a 2-aye and 2-nay vote.

13. AUTHORIZATION TO ADVERTISE FOR PUBLIC WORKS POSITION
Jim Dillman informed the council that Ben Young had been hired by
the City of Minnetonka Beach, although he had not officially
resigned yet. Dillman asked for approval to place an advertisement
for the public works position.
Moved by Mayor Theis, seconded by Zietlow, to authorize the
placement of an advertisement in the Weekly News for a public works
position.
Motion carried unanimously.
14. AERIAL DEER SURVEY
Rick Rabenort said Hennepin Parks conducted a winter aerial deer
survey in the city. Rabenort said the number of deer counted in
Medina was 319, including Baker Park Reserve. The only area of
Medina with a high density of deer was in the southeast corner.
15. PAYMENT OF BILLS
Moved by Thies, seconded by Zietlow, to approve payment of Order
Check Numbers 12902-12958 for $47,637.81 and Payroll Check Numbers
13771-13784 for $11,904.93.
Motion carried unanimously.
16. EXECUTIVE SESSION
City Attorney Ron Batty announced that the council would be going
into executive session on the basis of attorney -client privilege to
consider an amended condemnation resolution.
Moved by Thies, seconded by Mayor Theis, to close the executive
session at 11:15 p.m.
Moved by Thies, seconded by Mayor Theis, to authorize City Attorney
Ron Batty to continue negotiations with Robert Feltl and to adopt
Resolution No. 94-09, "Resolution Authorizing Condemnation
Proceedings and Acquisition of Real Property."
Ayes: Johnson, Thies, Zietlow and Mayor Theis. Nays: None.
Resolution No. 94-09 adopted on a 4-aye and 0-nay vote.
17. ADJOURNMENT
Moved by Thies, seconded by Mayor Theis, to adjourn the meeting at
11:16 p.m.
