A SPECIAL ORDINANCE AUTHORIZING THE BOARD OF PUBLIC WORKS
TO ACQUIRE CERTAIN INDUSTRIAL PROPERTY
WHEREAS Indiana Code 36-1-4-5 enables the City of Richmond to acquire and own
interests in real property, and
WHEREAS the City may lease its interests in property pursuant to Indiana Code 36-1-4-6,
and
WHEREAS the City's Board of Public Works and Safety may proceed pursuant to Indiana
Code 36-1-10.5-5 if the Common Council of the City passes a resolution to the
effect that it is interested in making a purchase of specified land, and
WHEREAS the creation of jobs and economic opportunity for the citizens of the City and
surrounding area is absolutely vital to the future well being of the City, and
WHEREAS an unacceptable high rate of unemployment and considerable under -employment
currently exists in the City and surrounding area, and
WHEREAS an industrial property consisting of approximately 80 acres and 500,000 square
feet of manufacturing and office space is currently for sale by the United States
Steel and Carnegie Pension Fund, said property being the former location of
Wayne Corporation's bus manufacturing plant, and
WHEREAS Mayor Roger Cornett and the Department of Economic Growth and
Development have obtained commitments from Carpenter Manufacturing, Inc.
of Mitchell, Indiana, to move manufacturing operations to Richmond which will
occupy at least 40 percent of the manufacturing space and adjoining land, and
WHEREAS United Auto Workers Local Union 721 has entered into a 7 year collective
bargaining agreement with said Carpenter Manufacturing, Inc., and
WHEREAS it is in the public interest for the City to acquire the former Wayne Corporation
bus manufacturing plant and land from the owner, United States Steel and
Carnegie Pension Fund of New York, New York.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that:
A. This Council as the fiscal body of the City of Richmond, Indiana, resolves that it is interested
in making the purchase of the former Wayne Corporation bus manufacturing plant and land
from its owner, United States Steel and Carnegie Pension Fund of New York, New York;
and
B. That the Richmond, Indiana, Board of Public Works and Safety shall appoint two appraisers
to appraise the fair market value of the land and its improvements; and
C. That the appraisers shall return their separate appraisals to the Board of Public Works and
Safety within 30 days after the date of their appointment; and
D. That the Board of Public Works and Safety shall give a copy of both appraisals to the
members of this Council; and
E. That the Board of Public Works and Safety enter into an agreement to purchase said land
with the improvements thereon for a price no greater than the average of the two appraisals.
F. That the Board of Public Works and Safety consider the environmental realities of this site
and proceed to negotiate the clean up efforts, if required, with the seller.
