HomeMy Public PortalAbout2004-147 (09-07-04)RESOLUTION NO. 2004.147 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ORDERING THE VACATION AND ABANDONMENT OF FOR PUBLIC PURPOSES NICHOLS AVENUE BETWEEN LOUISE STREET AND THE 1-105 FREEWAY, IN THE CITY OF LYNWOOD WHEREAS, the City Council of the City of Lynwood, on the 20th day of July, 2004, adopted Resolution No. 2004.125, declaring its intention to vacate Nichols Avenue between Louise Street and the I-105 Freeway; and WHEREAS, notices of said vacation have been posted in the time, form, and manner required by law; and WHEREAS, a public hearing on the matter was held on the 17th day of August and continued to the 7th day of September 2004, as prescribed by law. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lynwood as follows: Section 1. That the following described portions of street is unnecessary for present or prospective public use, and that the public interest, necessity and convenience require that the City Council of said City hereby order the vacation and abandonment of said street: The right-of-way of Nichols Avenue bounded to the south by the northerly right-of-way of Louise Street and to the north by the southerly right-of-way of the 1-105 Freeway, as shown in Tract No. 10503, in the City of Lynwood, County of Los Angeles, State of California, Map Book 158, Pages 3-4 of maps in the office of the Los Angeles County Recorder. Section 2. That the City Council of the City of Lynwood does hereby determine that the public convenience and necessity require that necessary easements be retained for construction and maintenance of utilities within the limits of said portions of streets as described in Section 1. Section 3. That the City Clerk of the City of Lynwood shall cause a certified copy of said order to be recorded in the office of the Recorder of Los Angeles County. Section 4. This resolution shall take effect immediately upon its adoption. PASSED, APPROVED and ADOPTED this 7th dayof September City of Lynwood ,2004. ATTEST: ANDREA L.
